When is the departure date?

According to the relevant laws and regulations of our country, the date of resignation refers to the date when the company terminates the employee after consultation with the unit and the employee goes through the resignation formalities in the unit. On the day of resignation, employees need to confirm the termination of labor relations with the unit. When the employee terminates the labor relationship with the unit, the unit shall pay the employee's salary in one lump sum and shall not be in arrears. If the employee resigns, the date of resignation shall be counted from the date when the employee submits the resignation application, and the time for terminating the labor relationship shall be 30 days later.

Legal basis:

Article 36 of the Labor Contract Law of People's Republic of China (PRC) stipulates that the employer and the employee may terminate the labor contract through consultation.

Article 37 of the Labor Contract Law of People's Republic of China (PRC) stipulates that the employee may terminate the labor contract by giving a written notice to the employer 30 days in advance. The employee may terminate the labor contract by notifying the employer three days in advance during the probation period.
