Regulations on the protection and management of silicified wood in Changji Hui Autonomous Prefecture

Article 1 In order to strengthen the protection and management of the ecological environment of silicified wood natural relics in Autonomous Prefecture and make rational use of silicified wood resources, these Regulations are formulated in accordance with the Regulations of People's Republic of China (PRC) Nature Reserve and relevant laws and regulations, combined with the actual situation of Autonomous Prefecture. Article 2 Silicified wood as mentioned in these Regulations refers to the natural environment of middle and upper Jurassic plant fossils and plant fossils, which were mainly composed of cycads, conifers, ginkgo and other plants about 654.38+0.5 billion years ago. Article 3 The people's government of Autonomous Prefecture shall designate protected areas in areas where silicified wood of various plants is concentrated, and all units and individuals that conduct activities in the silicified wood protected areas shall abide by these regulations. Fourth autonomous prefecture forestry administrative departments in charge of the state-wide protection of silicified wood and the management of silicified wood protected areas in nature reserves. County (city) forestry administrative department is responsible for the protection and management of silicified wood within its jurisdiction.

Land and resources, cultural relics, tourism, animal husbandry, public security and frontier defense departments actively cooperate with forestry departments to do a good job in the protection and management of silicified wood according to their respective responsibilities. Article 5 The competent administrative department of environmental protection of the people's governments at or above the county level shall supervise and inspect the protection and management of silicified wood within their respective administrative areas. Sixth Autonomous Prefecture People's governments at all levels shall strengthen the propaganda work, educate citizens to abide by these regulations, and support the forestry administrative departments to do a good job in protection and management.

All units and individuals have the obligation to protect silicified wood, and have the right to stop, report and accuse the acts of occupying and destroying silicified wood. Those who report meritorious service shall be rewarded by the administrative department of forestry. Seventh Autonomous Prefecture People's Government shall invest in the protection and management of silicified wood.

Encourage units or individuals to invest in silicified wood protection. Eighth county (city) forestry administrative departments shall, according to the distribution of silicified wood in the local area, put forward a plan for the delineation of silicified wood protected areas, which shall be implemented after being approved by the county and municipal people's governments and reported to the people's governments of autonomous prefectures.

Delineation of silicified wood protected areas in nature reserves shall be proposed by the state forestry administrative department and reported to the state people's government for approval.

The approved silicified wood protected area shall be marked with boundaries and announced. No unit or individual may move boundary markers in silicified wood area without authorization. Ninth responsibilities of the competent department of silicified wood reserve:

(a) to implement the laws, regulations, principles and policies of the state on the protection of natural heritage.

(two) to formulate the management system of silicified wood protected areas, and to manage silicified wood in a unified way.

(3) Investigate the natural heritage resources of silicified wood and establish archives.

(five) to organize or assist the relevant departments to carry out scientific research on silicified wood. Article 10 Whoever enters the unopened silicified wood protection zone to engage in scientific research, investigation, visit, teaching practice, specimen collection, film and television shooting, tourism, herb collection, exploration and other activities must submit an activity plan to the forestry administrative department at or above the county level, and can enter only after approval. Without approval, no unit or individual may enter the silicified wood reserve to engage in the above activities. Article 11 Where there are conditions to carry out development activities in the silicified wood protection zone, in addition to going through the relevant formalities according to law, the project development unit or individual shall submit an application to the local county (city) people's government with the project design, project task book and environmental impact report, which shall be examined and approved by the county (city) people's government, put forward by the state forestry administrative department, and put forward environmental evaluation opinions by the state environmental protection department, which shall be submitted to the state people's government for approval and implementation.

Development units or individuals must take protective measures to prevent the natural environment and natural resources in the silicified wood reserve from being destroyed.

Forestry administrative departments at or above the county level have the right to supervise and inspect the activities of development units in the silicified wood protection zone. Article 12 Units and individuals that have been approved to enter the silicified wood reserve for scientific research, investigation, visit, specimen collection, tourism, film and television shooting, herb collection, exploration and other activities shall pay resource protection and management fees to the silicified wood management institution according to regulations. The charging standard shall be stipulated by the national price department. Thirteenth, except for scientific research, teaching, exhibition and so on, it is really necessary to collect a small amount. Without the approval of the state forestry administrative department and the state people's government, it is not allowed to dig, carry, transport, trade or process silicified wood. Fourteenth foreigners need to enter the silicified wood protection zone, the reception unit must go through the examination and approval procedures in accordance with the relevant provisions of the state. Article 15 Whoever, in violation of the provisions of this Ordinance, moves boundary markers of silicified wood protected areas without authorization or enters the protected areas without approval, and disobeys management, shall be ordered by the forestry administrative department at or above the county level or the nature reserve management institution to make corrections and be fined according to the circumstances. Enter without approval and disobey management, and be fined above 500 yuan 100 yuan; Unauthorized movement of landmarks, change of protected areas, punishable by a fine of more than 2000 yuan in 500 yuan; Those who move boundary markers or change protected areas without authorization, resulting in the theft or damage of silicified wood, shall be fined between 2,000 yuan and 5,000 yuan. Article 16 Anyone who enters the silicified wood reserve to engage in development activities without approval shall be ordered by the forestry administrative department at or above the county level or the nature reserve management institution to restore to the original state, and be fined 1000 yuan or more 1000 yuan or less depending on the circumstances. Seventeenth in violation of the provisions of this Ordinance, any of the following acts shall be punished by the administrative department of forestry at or above the county level or the nature reserve management institution in accordance with the following standards:

(a) unauthorized mining, carrying silicified wood, in addition to the confiscation of physical objects, and according to the illegal mining, carrying silicified wood per kilogram fine 1000 yuan.

(2) Anyone who buys, sells or processes silicified wood without authorization shall have his physical objects and illegal income confiscated, and be fined 1000 yuan per kilogram of illicitly bought, sold and processed silicified wood.

(three) transport silicified wood in violation of these regulations, in addition to the confiscation of illegal income, and impose a fine of 3 times the freight.

(4) Damaging the natural state of silicified wood (trunk, root and stump), if the circumstances are serious and cause damage, a fine of 10000 to 50000 yuan shall be imposed depending on the circumstances.

(five) the destruction of the infrastructure of the silicified wood reserve, depending on the seriousness of the case, shall be fined 5000 yuan.

If one of the acts listed in the preceding paragraph causes losses, he shall be liable for compensation according to law, and if the case constitutes a crime, he shall be investigated for criminal responsibility according to law.
