Party A shall ensure that Party B's production and living water and electricity consumption are normal, and the price of water and electricity charged to Party B is% higher than that of villagers in the village, and ensure that the road leading to the leased land in the village is used free of charge, and compensate for the damage.
8. During the lease term, Party A shall not interfere with Party B's legal management right for any reason, including all income and expenditure on cultivated land and the use of legal temporary buildings and tree planting facilities.
9. During the performance of this contract, Party A shall not contract the cultivated land repeatedly. During the lease period, Party A shall be responsible for the settlement of farmland disputes arising from the contracted scope. If Party B suffers serious economic losses, Party A shall compensate it according to relevant state regulations. Party A must ensure that Party B will not be unreasonably disturbed during the contract period.
10. Provide Party B with other equal treatment for local villagers.
(II) Rights and obligations of Party B
1. Party B has the right to legally use and operate the contracted cultivated land according to the purpose and time limit stipulated in the contract.
2. Party B's management right and income right of contracted farmland are independent according to law, and no unit or individual may interfere. All creditor's rights and debts incurred shall be enjoyed and borne by Party B alone and have nothing to do with Party A. ..
3. Party B has the right to legally build temporary breeding and living facilities related to the purposes agreed in this contract on the contracted cultivated land, and Party A and its village do not charge any fees.
4. Party B has the right to carry out basic transformation of leased farmland during the lease term. If all the assets such as power grid and water conservancy facilities formed by transformation are invested by Party B, Party B has the right to dispose of them after the lease contract expires.
5. After the lease expires, under the same conditions, Party B has the priority to continue to lease the original leased farmland.
6. Party B shall pay the rent to Party A in full and on time as agreed in this contract, and has the right to refuse to pay any other non-state expenses except the rent stipulated in this contract.
7. Party B's project operation activities shall not pollute the water source of Party B's village, and shall not cause other ecological environment pollution that affects the villagers' lives.
8. Party B shall protect natural resources and make rational use of land.
9. After the lease contract ends, Party B shall be responsible for cleaning up the paddy field sundries and cultivating the cultivated land (restoring the normal cultivated land state). If Party B fails to ridge the cultivated land (restore the normal cultivated land status), Party B shall pay a ridging fee of RMB 0,000 per mu/kloc-0 (restore the normal cultivated land status) to Party A, and confiscate the performance bond.
Article 6 Subcontracting
Within the validity period of this contract, Party B may independently transfer the contracted land management right by subcontracting, transferring or leasing, provided that it does not violate the mandatory provisions of national laws and administrative regulations. All the proceeds from the transfer of the land contractual management right shall be enjoyed by Party B, and Party A shall not claim any rights in this regard. After subcontracting this contract, both parties shall still exercise their rights and undertake their obligations as agreed in the original contract; Party B and the third party shall exercise their rights and assume their obligations in accordance with the provisions of the subcontract. After subcontracting this contract, if the subcontract cannot be performed due to Party A's reasons, thus causing losses to the subcontractor, Party A shall bear corresponding responsibilities.
Article 7 Modification and rescission of the contract
1. Once this contract is signed, it is legally binding, and no unit or individual may change or terminate it at will. This contract can only be modified or dissolved after both parties sign a written agreement through consultation.
2. If Party A and Party B are unable to perform this contract due to force majeure, or this contract really needs to be modified or dissolved, this contract can be modified or dissolved according to legal procedures after negotiation between both parties, and the economic losses caused thereby shall be borne by both parties themselves or solved through negotiation.
3. If Party A repeatedly contracted the land or cut off power, water and road without authorization, which made Party B unable to operate, Party B has the right to terminate this contract, and Party A shall bear the liability for breach of contract.
4. If Party B fails to pay the rental fee in full and on time, and Party A refuses to pay after being urged by Party A, Party A has the right to terminate this contract, and Party B shall bear the liability for breach of contract.
Article 8 Liability for breach of contract
1. During the performance of this contract, any party who violates the above provisions of this contract shall be regarded as a breach of contract.
2. If this contract is terminated due to Party A's breach of contract, Party A shall pay the annual rent to Party B as liquidated damages and return the performance bond paid by Party B; Where the Contract is terminated due to Party B's breach of contract, Party A will not refund the contract fee and performance bond fee to Party B and terminate the Contract. If the contract is terminated due to the fault of both parties, they shall bear corresponding liabilities for breach of contract.
Article 9 Measures for Settlement of Contract Disputes
In case of any dispute during the performance of the contract, both parties to the dispute shall settle it through consultation. If negotiation fails, it may apply to the higher authorities for mediation or bring a lawsuit directly to the local people's court.
Article 10 the contract comes into effect
This contract shall come into effect after being signed and sealed by both parties.
Article 11 Other matters
1. Matters not covered in this contract can be used as a supplementary agreement after both parties agree, and the supplementary agreement is the same as this contract.
