Cultivated land refers to the land where crops are planted, including cultivated land, newly developed and reclaimed land, and leisure land (including leisure land and fallow land); Land where crops (including vegetables) are the main crops and fruit trees, mulberry trees or other trees are planted sporadically; On average, one season of aquaculture beaches and beaches can be harvested every year. Cultivated land includes ditches, canals, roads and ridges, the width of which is less than 1.0m in the south and less than 2.0m in the north, such as medicinal materials, turf, flowers and seedlings. Cultivated land that belongs to temporary planting, temporarily planting fruit trees, tea trees and trees, and the cultivated layer has not been destroyed, and other temporarily changed cultivated land.

It can be seen from the above that the cultivated land is mainly planted with crops (including vegetables), and fruit trees, mulberry trees or other trees are allowed to be planted sporadically. Moreover, it is allowed to temporarily plant fruit trees, tea trees and trees on cultivated land, as long as it does not destroy the cultivated layer.

However, as we all know, China's cultivated land is divided into general cultivated land and basic farmland. Basic farmland refers to the cultivated land that cannot be occupied according to the demand of population and social and economic development for agricultural products in a certain period and the overall land use planning. The Land Management Law, Regulations on the Protection of Basic Farmland and other laws and regulations stipulate that it is strictly forbidden to plant trees in basic farmland, so it is not allowed to plant trees casually in basic farmland.

The Emergency Notice of the State Council on Resolutely Stopping the Occupation of Basic Farmland for Tree Planting points out that it is necessary to resolutely stop the occupation of basic farmland for tree planting. Where afforestation (including planting fast-growing and high-yield forests), pond digging and fish farming, green passage and urban green belt construction are carried out on basic farmland, they must be stopped and corrected immediately. Those who occupy basic farmland to plant fast-growing and high-yield forests shall resume farming within a time limit.
