How to punish the traffic police for checking the unqualified exhaust gas?

If the motor vehicle exhaust sampling finds unqualified, the traffic police department will temporarily detain the vehicle driving license on the spot, and the owner must carry out maintenance and rectification within 7 days. The driving license can only be exchanged with the re-inspection certificate, and there is no need to pay extra for the re-inspection. After being ordered to treat within a time limit, those who refuse to treat within the time limit shall be fined in 200 yuan and scored three points.

According to Articles 59 and 114 of the Law on the Prevention and Control of Air Pollution, a fine of less than 5,000 yuan will be imposed on heavy-duty diesel vehicles with excessive emissions and unqualified indicators, and a fine will be imposed on light-duty diesel vehicles that fail to rectify within the time limit in 500 yuan.

Article 90 Motor vehicle drivers who violate the provisions of laws and regulations on road traffic safety shall be given a warning or fined from 20 yuan to 200 yuan. If there are other provisions in this law, it shall be punished in accordance with the provisions; If it is still in the annual inspection period, but the exhaust gas is found to be unqualified on the road, the traffic police will first issue a Notice of Correction within a Time Limit to the driver and ask him to go to the environmental protection department for re-inspection within 15 days. If the driver fails to re-examine within 15 days, or fails to pass the re-examination, he will face a fine from 200 yuan.

Article 95 If a motor vehicle running on the road does not carry a motor vehicle number plate, inspection mark or insurance mark, or does not carry a driving license or driver's license with it, the traffic control department of the public security organ shall detain the motor vehicle, notify the parties concerned to provide the corresponding number plate or mark or go through the corresponding formalities, and may impose penalties in accordance with the provisions of Article 90 of this Law. If the party concerned provides the corresponding number plate, logo or goes through the corresponding formalities, it shall return the motor vehicle in time.
