Regulations on the Protection of Traditional Villages and Ethnic Villages in Enshi Tujia and Miao Autonomous Prefecture

Chapter I General Provisions Article 1 In order to protect and utilize traditional villages and ethnic villages, safeguard the legitimate rights and interests of villagers (residents), inherit and carry forward excellent traditional culture, and promote rural revitalization, according to the provisions of People's Republic of China (PRC) Urban and Rural Planning Law, People's Republic of China (PRC) Cultural Relics Protection Law, People's Republic of China (PRC) Intangible Cultural Heritage Law and other laws and regulations, combined with the actual situation of this state, Article 2 These Regulations are applicable to the protection and utilization of traditional villages and ethnic villages within the administrative area of this state.

The term "traditional villages" as mentioned in these Regulations refers to natural villages or administrative villages with material and intangible cultural heritage and high historical, cultural, scientific, artistic and ecological values that are listed and named at or above the county level within the administrative area of this state.

The ethnic villages mentioned in these Regulations refer to ethnic villages listed in the list at or above the county level and named within the administrative area of this state, that is, natural villages or administrative villages with relatively concentrated minority population, high proportion, relatively complete production and living functions, and obvious cultural characteristics and residential characteristics of ethnic minorities. Article 3 The protection and utilization of traditional villages and ethnic villages shall follow the principles of giving priority to protection, scientific planning, rational utilization and sustainable development, and implement the working mechanism of government-led, villagers' autonomy and social participation. Article 4 The people's government of the prefecture is responsible for coordinating and guiding the protection and utilization of traditional villages and ethnic villages within its administrative area. County (city) people's government is responsible for the protection and utilization of traditional villages and ethnic villages within their respective administrative areas.

State and county (city) people's governments shall incorporate the protection and utilization of traditional villages and ethnic villages into the national economic and social development plan and the overall urban and rural planning, include the funds for protection and utilization in the fiscal budget at the corresponding level, regularly inspect and evaluate the protection and utilization of traditional villages and ethnic villages within their respective administrative areas, and report the inspection and evaluation to the Standing Committee of the people's Congress at the same level. Article 5 State, county (city) housing and urban-rural construction departments shall be responsible for the unified management of the protection and utilization of traditional villages together with the departments of culture and tourism, ethnic affairs departments shall be responsible for the unified management of the protection and utilization of ethnic villages together with the departments of culture and tourism, and other relevant departments shall be responsible for the protection and utilization of traditional villages and ethnic villages according to their respective functions and duties.

The people's government of a township (town) shall organize the preparation of the protection and utilization plan for traditional villages and ethnic villages and be responsible for its implementation, and perform the duties of cultural protection, economic development, environmental improvement and safety prevention of traditional villages and ethnic villages according to law. Article 6 The village (neighborhood) committees where traditional villages and ethnic villages are located shall assist the township (town) people's governments and sub-district offices in their work, organize and guide the village (neighborhood) people to participate in the protection and utilization, and give play to the role of village rules and regulations in the protection and utilization. Seventh state, county (city) and township (town) people's governments should strengthen publicity and education on the protection and utilization of traditional villages and ethnic villages, and enhance public awareness of protection and utilization.

State, county (city) and township (town) people's governments should tap the excellent ideas, humanistic spirit and moral norms contained in traditional villages and ethnic villages, and cultivate civilized rural style, good family style and simple folk customs. Article 8 State and county (city) people's governments shall establish an expert consultation system for the protection and utilization of traditional villages and ethnic villages, and organize experts to conduct consultation and demonstration on major issues such as the declaration, identification, planning and construction of traditional villages and ethnic villages. Ninth state and county (city) people's governments should encourage enterprises, social organizations and individuals to participate in the protection and utilization of traditional villages and ethnic villages through donations, sponsorship and investment.

Units and individuals that have made outstanding contributions to the protection and utilization of traditional villages and ethnic villages shall be commended and rewarded. Chapter II Declaration, Identification and Planning Article 10 The county (city) people's government shall organize a general survey of the resources of traditional villages and ethnic villages within its administrative area, and put forward a list of suggestions for declaring traditional villages and ethnic villages according to the general survey. Eleventh traditional villages and ethnic villages at the county level shall be declared by the local township (town) people's government and sub-district offices according to the recommended list. National traditional villages and ethnic villages are declared by the county (city) people's government from the county directory. Specific measures for evaluation, identification and naming shall be formulated by the state people's government.

The declaration of national and provincial traditional villages and ethnic villages shall be implemented in accordance with the provisions of the relevant departments of the State Council and the provincial people's government. Twelfth natural villages or administrative villages that meet the following conditions can declare traditional villages at the county level:

(a) traditional architecture reflects the style of a certain historical period, the main structure and use function are basically well preserved, with regional and national characteristics;

(2) The village site selection, planning and construction have historical, cultural, scientific, artistic and ecological values, and the overall pattern and form of topography, mountains and rivers, street space and supporting facilities for production and life are well preserved;

(three) the historical and cultural precipitation is profound, and it has cultural relics or intangible cultural heritage;

(4) Good ecological environment.

The declaration of traditional villages at the county level shall be discussed and agreed by the village (neighborhood) people's meeting or the villagers' representative meeting.
