Can farmland be used to build graves?

China's regulations on building graves can be found in the Land Management Law, the Regulations on Funeral Management in the State Council and the Measures for the Implementation of the Regulations on Funeral Management. These laws, regulations or rules stipulate that: First, the establishment of public welfare cemeteries and other funeral facilities for rural villagers must be approved. For example, Article 9 of the Regulations on Funeral Management stipulates: "No unit or individual may build funeral facilities without approval. Rural public cemetery shall not provide grave land for people other than villagers. It is forbidden to establish or restore clan cemeteries. " The second is to limit the location of the grave. Article 75 of the Land Management Law of People's Republic of China (PRC) violates the provisions of this law by occupying cultivated land to build kilns and graves, or building houses, digging sand, quarrying, mining and taking soil. Unauthorized reclamation of cultivated land, destruction of planting conditions, or land desertification and salinization caused by land development, shall be ordered by the competent department of natural resources of the people's government at or above the county level and the competent department of agriculture and rural areas to make corrections within a time limit and may also be fined; If a crime is constituted, criminal responsibility shall be investigated according to law. Article 10 of the Regulations on Funeral Management prohibits the construction of graves in the following areas: (1) cultivated land and forest land; (two) city parks, scenic spots and cultural relics protection areas; (3) Near reservoirs, river dams and water source protection areas; (four) on both sides of the railway and highway trunk lines. Existing graves in the areas specified in the preceding paragraph shall be moved or buried within a time limit, except for cemeteries with historical, artistic and scientific value protected by the state, and no graves shall be left.
