Regulations on the Protection of National Traditional Buildings in Xishuangbanna Dai Autonomous Prefecture, Yunnan Province

Article 1 In order to strengthen the protection of national traditional architecture, inherit and carry forward the national traditional architectural culture, these Regulations are formulated in accordance with the Urban and Rural Planning Law of People's Republic of China (PRC), the Regulations on the Protection of National Folk Traditional Culture of Yunnan Province and the actual conditions of Xishuangbanna Dai Autonomous Prefecture (hereinafter referred to as the Autonomous Prefecture). Article 2 The national traditional architecture as mentioned in these Regulations refers to the trunk buildings of the world's ethnic minorities, towers, temples, pavilions, sculptures and other buildings and structures in Southern Buddhism, as well as various traditional architectural decorations. Article 3 All units and individuals in the Autonomous Prefecture have the obligation to protect traditional national buildings and shall abide by these regulations. Article 4 The protection of national traditional buildings shall follow the principle of giving priority to protection and inheriting and developing, adhere to the combination of key protection and regional protection, and combine architectural protection with other humanities and natural protection to promote the coordinated development of national traditional culture and economy and society. Fifth autonomous prefectures and counties (cities) planning and construction administrative departments responsible for the protection, management and service of traditional ethnic buildings within their respective administrative areas. Development and reform, finance, ethnic, cultural, religious and other departments shall, in accordance with their respective responsibilities, do a good job in the protection of traditional ethnic buildings.

The township (town) people's government shall do a good job in the protection and management of traditional ethnic buildings within its jurisdiction. Article 6 The people's governments of autonomous prefectures and counties (cities) shall set up special funds for the protection of ethnic traditional buildings, which shall be used for the formulation of protection plans for ethnic traditional buildings, subsidies for difficulties in new construction and maintenance, architectural design, technology and material research, etc.

The main sources of special funds for the protection of ethnic traditional buildings: financial budget arrangements of autonomous prefectures and counties (cities), social donations and other funds. Article 7 The people's governments of autonomous prefectures and counties (cities) shall promote the construction of towns and villages with national and local characteristics. When building or repairing houses, units and individuals shall maintain the style and technology of national traditional buildings and save land and materials. Eighth county (city) people's government shall, according to the distribution and present situation of national traditional buildings, organize the preparation of the overall planning of village and town construction style, and report it to the Autonomous Prefecture People's government for approval before implementation.

The overall planning of architectural style should be connected with the overall planning of the city. The construction of towns and villages in Autonomous Prefecture shall conform to the overall planning of construction style. Article 9 The planning and construction administrative departments of autonomous prefectures and counties (cities) shall strengthen the research on the style, structure, technology and materials of traditional ethnic buildings, organize the design, compilation and publication of atlas and decorative patterns of traditional ethnic buildings, and popularize and apply new building technologies and materials. Tenth autonomous prefectures and counties (cities) planning and construction administrative departments to set up protection signs for the following traditional ethnic buildings, the implementation of listing protection:

(1) National traditional buildings with certain architectural age, artistic characteristics and historical research value;

(2) Town blocks and villages where traditional ethnic architecture is concentrated.

The listing protection of individual-owned national traditional buildings shall solicit the opinions of the property owners. Article 11 The owners of the property rights of the national traditional buildings listed in the List for protection shall be responsible for the repair and maintenance of the buildings and bear the corresponding expenses. Unless otherwise agreed by the property owner and the user, such agreement shall prevail. If it is indeed difficult for the property owner to bear the maintenance costs, he may apply to the people's government of the autonomous prefecture or county (city) for subsidies.

When maintaining the national traditional buildings listed for protection, the features such as elevation and structure of the buildings shall not be changed. The maintenance plan shall be submitted to the county (city) planning and construction administrative department for approval before construction.

The implementation of listing protection of traditional national buildings need to be removed, it should be reported to the state and county (city) planning and construction administrative departments for approval. Twelfth national traditional buildings protected by listing need to be transferred or leased, and the transferor and lessor shall inform the transferee and lessee of the relevant protection requirements in writing. The lessee shall undertake the daily maintenance obligations of national traditional buildings during the lease period. Thirteenth new construction, renovation and expansion projects in the Autonomous Prefecture shall be designed in accordance with the planning and design conditions stipulated by the administrative department of planning and construction.

If a construction project is newly built, rebuilt or expanded on both sides of the main street in the urban planning area, the architectural appearance design scheme shall be provided when the project planning and design scheme is declared. For buildings that may affect the urban landscape, the administrative department of planning and construction may require the applicant of the construction project to provide a landscape analysis map.

The approved construction project planning and design scheme shall not be changed by any unit or individual without authorization. If it is really necessary to change, it shall be reported to the original examination and approval department for approval. Fourteenth Autonomous Prefecture People's government advocates the use of national traditional architectural ornamentation for building facade decoration. All kinds of buildings on both sides of the main streets in urban planning areas shall not use decorative patterns that hinder the traditional architectural style. Fifteenth villages and township (town) people's governments shall formulate protection measures. The villagers' committee shall assist the township (town) people's government in implementing protective measures.

Protective measures shall include the following contents and standards:

(1) Architectural features, environment and landscape;

(two) the style, height, number of floors and external decoration of the new building;

(three) roads, pipelines and fire safety facilities;

(4) Green area and tree species. Sixteenth new residential buildings in villages listed for protection shall be started only after obtaining the village planning and site selection opinions and the village construction planning permit issued by the county (city) planning and construction administrative department.

The county (city) planning and construction administrative department shall waive the supporting fees for village infrastructure and provide free architectural design standard drawings and construction technical guidance for the construction projects that conform to the overall planning of village construction style in the villages included in the scope of protection. The forestry administrative department shall give priority to the timber needed by villagers to build or maintain houses in accordance with relevant regulations.
