Decision of the Standing Committee of Wuxi Municipal People's Congress on Amending the Regulations of Wuxi Municipality on the Protection of Traditional Arts and Crafts (1997)

First, the term "county (city)" as mentioned in these Regulations is amended as "city without districts". 2. Paragraph 1 of Article 4 is amended as: "The administrative department of arts and crafts of the people's government of a city or a city without districts is the supervision and administration department for the protection of traditional arts and crafts within its administrative area, and is specifically responsible for the implementation of relevant laws and regulations."

Delete the second paragraph.

The word "leader" in item 3 of paragraph 3 is changed to "organization". 3. Paragraph 1 of Article 9 is amended as: "Enterprises and self-employed households that produce traditional arts and crafts shall be examined and approved by the competent department of arts and crafts, and the competent department of industry and commerce shall issue business licenses." 4. Article 10 is amended as: "Where an enterprise that produces traditional arts and crafts stops production, changes production or adjusts its product structure, it shall go through the corresponding procedures for stopping production or changing registration with the administrative department for industry and commerce after being examined by the competent department of arts and crafts." Article 19 is amended as: "Enterprises that produce and sell traditional arts and crafts products may apply to the tax authorities for tax reduction or exemption in accordance with state regulations." Six, delete thirtieth. Seven, article thirty-first is amended as: "in any of the following circumstances, shall be commended and rewarded by the unit, the competent department and the people's government:

"(a) protection, excavation or research of traditional arts and crafts have made outstanding achievements;

"(two) the traditional arts and crafts designed or produced have been rated as national or provincial treasures, or won prizes in major appraisal activities at home and abroad;

"(three) remarkable achievements have been made in cultivating traditional arts and crafts talents;

"(4) Other persons who have made significant contributions to the prosperity and development of traditional arts and crafts." Eight, thirty-second, thirty-third shall be amended as "in any of the following circumstances, the relevant administrative departments of arts and crafts, industry and commerce, technical supervision, geology and mineral resources shall be punished according to their respective functions and powers:

"(a) without a business license, unauthorized production and sales of traditional arts and crafts, shall be ordered to stop production and sales, confiscate the illegal income, and may impose a fine of five thousand yuan;

"(two) illegal theft of traditional arts and crafts production techniques and equipment, or reveal the secrets of traditional arts and crafts, confiscate the illegal income, and may impose a fine of less than 50% of the illegal income; If a crime is constituted, criminal responsibility shall be investigated by judicial organs;

"(3) Whoever transfers, sells, imitates, alters, embezzles traditional arts and crafts certificates and celebrity seals, or plagiarizes or imitates traditional arts and crafts patterns within the protection period shall have his illegal income confiscated and may be fined not more than 5,000 yuan, and compensate the victims for their economic losses;

"(four) illegal exploitation, occupation and theft of natural resources (Huishan mud, purple sand mud, etc.). Those who produce traditional arts and crafts shall have their illegal income confiscated and may be fined not more than 5,000 yuan. " Nine, delete thirty-fifth, thirty-sixth.

In addition, according to this decision, the order of some articles is adjusted accordingly.

This decision shall come into force as of the date of promulgation.

The "Regulations" of Wuxi Municipality on the Protection of Traditional Arts and Crafts shall be revised according to this decision and re-promulgated.
