Regulations of Guangdong Province on the Administration of Precursor Chemicals

Chapter I General Provisions Article 1 In order to strengthen the management of precursor chemicals and prevent and punish illegal drug activities, these Regulations are formulated in accordance with the provisions of the Criminal Law of People's Republic of China (PRC) and the Decision of the NPC Standing Committee on Drug Control, combined with the actual situation of this province. Article 2 These Regulations shall apply to the administration of the production, sale, warehousing, storage, purchase, transportation (including carrying, the same below) and import and export of precursor chemicals within the administrative area of this province. Article 3 Precursor chemicals as mentioned in these Regulations refer to the chemical raw materials and preparations listed in the schedule that can be used to manufacture and process heroin, methamphetamine (ice), cocaine and other narcotic drugs and psychotropic drugs that can make people addicted to drugs. Article 4 People's governments at all levels shall strengthen their leadership over the management of precursor chemicals.

Drug control committees at all levels are responsible for organizing and coordinating the management of precursor chemicals. Article 5 The relevant administrative departments of the people's governments at all levels shall strengthen coordination and cooperation, and do a good job in the supervision and management of precursor chemicals according to their respective responsibilities.

Public security organs are responsible for the control of precursor chemicals.

The economic and trade administrative department is responsible for the supervision and management of the production, sale, storage, purchase and use of precursor chemicals in the chemical and light industries.

The administrative department for industry and commerce is responsible for the supervision and management of the marketing activities of precursor chemicals.

The pharmaceutical supervisory and administrative department is responsible for the supervision and management of the production, sale, storage, purchase and use of precursor chemicals in the pharmaceutical industry. Article 6 Any unit or individual that discovers illegal production, sale, storage, custody, purchase, use, transportation and smuggling of precursor chemicals shall report to the relevant departments.

The relevant competent departments shall commend and reward the units and individuals who have made meritorious reports. Chapter II Administration and Supervision Article 7 The production, sale, warehousing, storage, purchase, transportation and import and export administration of ephedrine, a precursor chemical, shall be carried out in accordance with relevant state regulations. Article 8 Units that produce, sell and store Class II precursor chemicals shall apply to the economic and trade administrative department for a production license or business license, register with the administrative department for industry and commerce and obtain a business license. Article 9 Units that store and keep Class II precursor chemicals shall set up special warehouses and designate special personnel to manage them. Article 10 Units that produce, sell, store and repackage precursor chemicals shall stick labels that are not easy to fall off in the obvious position of product packaging, and indicate the names consistent with the schedules of these Regulations. Article 11 Units that purchase and use Class II precursor chemicals shall apply to the administrative department of economy and trade for a certificate of purchase and use. Where the pharmaceutical industry purchases or uses Class II precursor chemicals, it shall apply to the pharmaceutical supervisory and administrative department for a certificate of purchase and use. The certificate of purchase and use shall indicate the validity period, and one certificate shall be valid once.

It is forbidden to sell precursor chemicals of Category II to individuals and units that have not obtained purchase vouchers. Article 12 Units that produce, sell, store, purchase, import and export precursor chemicals shall register with the local public security organs at or above the county level. Article 13 Units that produce, sell, store, purchase, import and export precursor chemicals shall truthfully record the quantity, date and purpose of their operations or purchases, and report to the local public security organs at or above the county level every quarter. Records should be kept for two years for future reference.

The public security organ shall regularly check the records of the units listed in the preceding paragraph. Article 14 For the transportation of Class II precursor chemicals, the supplier shall apply to the municipal public security organ for a transportation license.

Transportation across cities and counties in the province or transportation outside the province shall apply to the public security organ at the prefecture level listed in the place where it is shipped out; Those who enter the province by transportation from outside the province shall apply for a transportation license to the public security organ at the prefecture level and listed in the province first.

Transportation within the administrative area of this county (including county-level cities and districts, the same below) may be exempted from transportation permits. Article 15 The name, quantity, route, purpose and destination of transporting precursor chemicals shall be consistent with those stated in the transport license.

The transport license goes with the goods, and one license is valid once. Article 16 If the transport license is actually delivered for transport after collection, the carrier shall, within 15 days from the date of arrival, hand it over to the consignee, sign and seal it, and return it (including mailing) to the issuing authority.

If the transportation certificate is not actually delivered within the validity period after receiving it, the issuing unit shall return the transportation certificate to the issuing authority within 15 days from the date of expiration. Article 17 If the shipper fails to provide a license for the transportation of precursor chemicals that requires permission according to regulations, the carrier shall not carry it. Chapter III Legal Liability Article 18 Whoever produces, sells or stores Class II precursor chemicals without obtaining a production license or business license shall be confiscated by the economic and trade administrative department at or above the county level, and shall be fined at least 1 10,000 yuan10,000 yuan.

Those who engage in the business activities mentioned in the preceding paragraph without a business license or beyond the business scope shall be handled by the administrative department for industry and commerce in accordance with the relevant provisions of the state. Article 19 Where a special warehouse has not been set up or a special person has not been appointed to manage the storage and custody of precursor chemicals of Category II, the competent economic and trade administrative department at or above the county level shall order it to make corrections within a time limit. If no correction is made within the time limit, a fine ranging from 1000 yuan to 5,000 yuan shall be imposed.
