Article 3 The people's governments at or above the county level shall strengthen the leadership over the management of overloading of freight vehicles.
The transportation departments of the people's governments at or above the county level and the public security organs are responsible for the overload control of freight vehicles within their respective administrative areas, and their comprehensive transportation law enforcement agencies and traffic management departments of public security organs are specifically responsible for the overload control of freight vehicles within their respective administrative areas according to their division of responsibilities.
The relevant departments of the people's governments at or above the county level, such as development and reform, industry and informatization, market supervision and management, finance, natural resources, urban and rural housing construction, water conservancy, and emergency management. , should be in accordance with their respective responsibilities, do a good job in the overload management of freight vehicles.
Township (town) people's governments and sub-district offices shall assist relevant functional departments to do a good job in the management of overloading and overloading of freight vehicles within their respective jurisdictions. Chapter II Source Management Article 8 Enterprises that produce and sell vehicles shall not produce or sell freight vehicles that do not meet the national safety technical standards for motor vehicles, and shall not modify or assemble freight vehicles without authorization. Automobile maintenance enterprises shall not modify or assemble freight vehicles without authorization.
The traffic administrative department of the public security organ shall not license or conduct annual inspection on vehicles that have been modified or assembled without authorization. For illegally modified and assembled vehicles, they shall be ordered to restore to their original state or be scrapped according to regulations. Article 9 Loading places of coal, steel, cement, concrete, sand and gravel, earthwork and other goods, as well as large operators of logistics parks, freight stations (yards) and ports and docks (hereinafter referred to as freight units) shall be equipped with freight metering, weighing and monitoring equipment that meets the standards in accordance with regulations, and shall be networked with the information platform for overload control of freight vehicles at or above the county level.
Freight units shall not have the following acts:
(1) Loading goods for a freight vehicle without a license plate, vehicle driving license, vehicle operation license or unauthorized modification or assembly;
(2) Loading and loading goods or releasing overloaded freight vehicles beyond the standard;
(three) to provide false proof of loading and stowage for out-of-gauge freight vehicles. Article 10 A cargo transport operator shall not commit any of the following acts:
(a) the use of unauthorized modification or assembly of freight vehicles;
(2) employing a freight vehicle driver who has no qualification certificate or whose qualification certificate is invalid to engage in cargo transportation;
(3) instigating or forcing the driver of a freight vehicle to overload or transport goods beyond the limit without permission. Article 11 The driver of a freight vehicle shall carry the cargo loading certificate with the vehicle in accordance with the regulations.
Drivers are not allowed to drive freight vehicles that have been modified or assembled without authorization.
