Measures for the protection and management of Yulin historical and cultural city

Introduction: The Measures for the Protection and Management of Yulin Historical and Cultural City was discussed and passed at the 2nd executive meeting of Yulin Municipal People's Government on June 1 2002, and is hereby promulgated and shall come into force on April 1 2002. The following is my collection of measures for the protection and management of Yulin's historical and cultural city. Welcome to reading.

Chapter I General Provisions

Article 1 In order to strengthen the protection and management of state-level historical and cultural cities, excavate and inherit outstanding historical and cultural heritage, carry forward national history and culture, and correctly handle the relationship between protection and construction and development, these Measures are formulated in accordance with the Urban Planning Law of People's Republic of China (PRC), the Law on the Protection of Cultural Relics of People's Republic of China (PRC), the Regulations on the Protection and Management of Cultural Relics of Shaanxi Province and relevant laws and regulations, combined with the actual situation of this Municipality.

Article 2 The protection and management of Yulin historical and cultural city should adhere to the principle of "unified standardization, comprehensive consideration, first rescue, overall protection, highlighting key points and sustainable utilization", and carry out protection, maintenance and transformation under the premise of maintaining the original pattern and architectural style.

Article 3 The protection scope of Yulin historical and cultural city includes the historical and cultural heritage and scenic spots within the administrative area of Yulin Ancient City and Yuyang District.

Fourth Yulin historical and cultural city protection content:

(1) Characteristics of natural environment: geographical environment and ecological environment;

(2) Characteristics of artificial environment: urban pattern, spatial form, traditional features, residential buildings, commercial shops, ancestral temples, scenic spots, ancient trees and famous springs, etc.

(3) Characteristics of humanistic environment: folk culture, traditional customs, local customs, etc.

Fifth Yulin historical and cultural city protection focus:

(1) The ancient military defense system represented by the Great Wall of Qin and Ming Dynasties, Zhenbeitai and its affiliated buildings along the line.

(2) Ancient City Pool represented by Yulin City Wall.

(3) Ancient and modern buildings represented by Xinming Pagoda, Wanfo Pagoda, Meihua Pagoda, Lingxiao Pagoda and Bell Tower.

(4) Traditional houses and shops dominated in Ming and Qing Dynasties.

(5) Blocks and roadways represented by streets.

(6) Temple buildings represented by Daixing Temple and Qingqu Temple.

(7) Ancient cultural sites represented by Baicheng Station.

(8) Ancient tombs represented by Zoumaliang Han Tomb.

(9) Grottoes, stone carving art and scenic spots represented by Hongshixia and Heilongtan.

Sixth Yulin historical and cultural city protection and management, the implementation of unified leadership, division of responsibilities, functional management and social supervision.

The Municipal People's Government established the Yulin Historical City Protection Management Committee, which has two offices. The Planning Management Office is located in the Urban and Rural Construction Bureau, and the Cultural Relics Management Office is located in the Cultural Relics Bureau.

The Municipal Urban and Rural Construction Bureau and the Cultural Relics Bureau shall, in accordance with their respective functions, exercise their duties of protection and management of historical and cultural cities according to law.

Seventh District, Township People's governments and sub-district offices shall, according to the needs of the protection and management of Yulin historical and cultural city, do a good job in the protection and management of this administrative region.

Eighth organs, enterprises and other organizations and individuals should establish the awareness of famous cities, consciously protect historical and cultural cities, and can report acts that damage historical and cultural cities.

Ninth units and individuals that have made remarkable achievements in the protection of historical and cultural cities shall be commended and rewarded by the Municipal People's Government.

Tenth Yulin historical and cultural city protection and management funds should be included in the municipal and district budget. The establishment of historical and cultural city protection fund, strive for national and provincial departments funding, encourage domestic and foreign social groups, other organizations and individuals to invest and sponsor, protect the ancient city.

Chapter II Planning and Construction Management

Eleventh Municipal People's Government shall organize the preparation of special protection rules for Yulin historical and cultural city, and formulate detailed planning and management measures for the protection of historical and cultural city according to the overall urban planning and special protection planning.

Twelfth Yulin historical and cultural city special protection planning of local adjustment or change, must be approved by the municipal government, and reported to the Standing Committee of the Municipal People's Congress for the record. Major amendments shall be approved according to the original examination and approval procedures.

Thirteenth Yulin historical and cultural city protection, in accordance with the guiding principle of focusing on key points and phased implementation, the implementation of zoning and grading protection.

Key protected areas. To implement first-class protection, we must maintain the original pattern and style.

General protected area. The implementation of secondary protection, the protection of existing traditional buildings, new buildings should be coordinated with the style of famous buildings.

Building area. The implementation of three-level protection can be coordinated with the transformation and construction of cultural cities in this area.

Article 14 The scope of protected areas shall be defined by the competent department of urban construction planning and the competent department of cultural relics according to the level of cultural relics protection units and the special protection plan for historical and cultural cities.

Article 15 Units and individuals carrying out construction activities in historical and cultural city protection areas must design, construct and accept in accordance with the People's Republic of China (PRC) Urban Planning Law, the People's Republic of China (PRC) Cultural Relics Protection Law, the Shaanxi Provincial Cultural Relics Protection Management Regulations and these Measures, and the special protection plan for famous cities, and go through the examination and approval procedures in strict accordance with the examination and approval requirements.

Article 16 When cultural relics are found in various construction activities, the construction activities shall be stopped, and the cultural relics management department shall be immediately notified to organize inspection and exploration. If excavation is required after exploration, the construction can be continued only after the excavation is completed; If it is necessary to leave remains of great archaeological value, the construction must be terminated.

Chapter III Protection of Ancient Cities

Article 17 within 50 meters on both sides of the red line of the street road, it is a key protected area. In some areas, the decoration and maintenance of shops along the street shall not change their facade modeling, color and building materials, and remain unchanged. The repair and maintenance of Jufa maintained the original architectural form and style.

Within the scope of key protected areas, houses and new structures that have changed their architectural forms should be gradually dismantled and traditional architectural forms restored.

Eighteenth key protected areas extend 100 meters to the west, and the ancient city wall to the east is a general protected area. To protect the existing traditional buildings in this area, the buildings that really need to be repaired should be coordinated with the traditional buildings, and the traditional buildings should be preserved, and the building height should not exceed 7.5 meters.

Nineteenth areas outside the general protected areas are buildable areas. In this area, the construction can be coordinated with the environment of the ancient city, and the green space rate is not less than 25%.

Article 20 The four courtyards of Ming and Qing Dynasties are basically well preserved in the ancient city. It should be signed, listed and protected, and a maintenance plan should be made to maintain the architectural style. Encourage residents to use it for folk arts and crafts collection, trade show, folk tourism and other development activities.

Twenty-first restore the traditional names and shop names of the gatehouses, zhaobi, streets and shops of residents' houses in the ancient city; Advertisements and doorplates along the street should be designed and produced according to the traditional style, and the setting of municipal public facilities should be coordinated with the style of the ancient city.

Article 22 Excavate and sort out the ancient architectural crafts with local characteristics and the architectural arts of Ming and Qing Dynasties, and encourage old artists to inherit their skills and inherit and carry forward excellent traditional architectural crafts.

Twenty-third key protected areas in the existing power, telecommunications and other pole lines should be gradually changed into underground pipelines, residents and catering industry should use environmentally friendly and clean energy.

Article 24 After the street is changed into a pedestrian street according to the special plan for the protection of famous cities, except for the approved special vehicles for living, sanitation, fire fighting and municipal affairs, other motor vehicles are prohibited from passing, and small motor vehicles should pass within a limited time.

Chapter IV Protection of Historical and Cultural Heritage

Twenty-fifth focus on the protection of revolutionary sites, memorial buildings, ancient city walls, ancient buildings, ancient tombs, ancient stone carvings, ancient murals and other cultural relics.

Twenty-sixth important cultural relics within the scope of protection of historical and cultural cities should be marked according to the provisions of the scope of protection, files should be established, and management personnel should be equipped to do a good job in protection and management.

Key protected areas: key protected areas shall be implemented in accordance with relevant national laws and regulations. Strictly protect the traditional architectural group pattern, spatial style, body color and building materials. Maintenance, restoration and reconstruction must be carried out in accordance with the original style, protecting the original structure, original components, original technology and raw materials. No other buildings unrelated to the protection of cultural relics shall be built.

General protected areas: protect the layout and features of existing buildings, and respect the original features in protection and restoration. New construction and reconstruction must be coordinated with the surrounding environment, cultural relics and historical sites.

Constructable area: protect the layout and style of existing traditional buildings and improve the environmental quality.

Twenty-seventh no unit or individual may occupy the cultural relics protection units, and those who have occupied them must move out within a time limit. Approved cultural relics protection units must sign contracts with the administrative departments of cultural relics to be responsible for the protection and repair of cultural relics.

Twenty-eighth to strengthen the collection, collation, research and utilization of historical and cultural heritage and folk culture and art, within the scope of the main street, can organize folk art performances, local snacks and traditional handicrafts.

Twenty-ninth within the scope of protection of historical and cultural cities, the use of cultural relics and scenic spots to enter the ground video recording, shooting TV, movies and other activities must be approved by the relevant competent departments. If the above activities involve cultural relics, they must be approved by the relevant cultural relics bureau and implement the Interim Measures for the Administration of Cultural Relics Shooting.

Chapter V Protection of Scenic Spots

Chapter VI Legal Liability

Article 34 The acts of destroying cultural relics and historic sites shall be punished by the relevant departments in accordance with the Law of People's Republic of China (PRC) on the Protection of Cultural Relics, the Law of People's Republic of China (PRC) on Urban Planning and other laws and regulations. If the circumstances are serious enough to violate the criminal law, they shall be handed over to judicial organs for criminal responsibility according to law. If the signs of cultural relics protection are removed or damaged without authorization, the administrative department for cultural relics protection shall order them to restore to their original state and impose a fine of more than 500 yuan 100 yuan.

Article 35 Where a unit or individual arbitrarily sets up billboards or posts promotional materials, the municipal administrative department for construction and industry and commerce shall, in accordance with the Advertising Law of People's Republic of China (PRC) and other relevant laws and regulations, order it to stop the illegal act, take remedial measures to restore the original state, and impose a fine of more than 2,000 yuan in 200 yuan.

Article 36 In the protected area, those who withdraw from the renovation, demolition and maintenance of traditional buildings without approval shall be ordered by the municipal administrative department of construction planning to stop the illegal behavior, restore the original appearance of traditional buildings, and be fined 3%- 10% of the project cost; New buildings and structures built without authorization shall be removed according to law.

Article 37 If a party refuses to accept the decision on administrative punishment, it may bring an administrative reconsideration or an administrative lawsuit according to law. If a party fails to apply for reconsideration within the time limit, nor directly bring a demolition lawsuit to the people's court, nor complies with the decision on punishment, the organ that made the decision on punishment shall apply to the people's court for compulsory execution.

Article 38 Any staff member of the relevant administrative department who neglects his duty, abuses his power or engages in malpractices for personal gain shall be given administrative sanctions by his unit or the competent authority at a higher level. If it constitutes a crime, it shall be investigated for responsibility according to law.

Chapter VII Supplementary Provisions

Thirty-ninth problems in the specific application of these Measures shall be interpreted by the Municipal Urban and Rural Construction Bureau and the Cultural Relics Bureau respectively.

Article 40 These Measures shall come into force as of April 1 day, 2002.
