Xi Measures for the Administration of Road Transport Service Industry (revised in 2008)

Article 1 These Measures are formulated in accordance with the Regulations of the People's Republic of China on Road Transportation and the Regulations of Shaanxi Province on Road Transportation Management, with the actual situation of this Municipality, in order to strengthen the management of road transportation service industry, ensure legal operation and maintain the order of transportation market. Article 2 Units and individuals engaged in road transport services such as goods storage, tally, transportation information consultation, stowage, combined transport, logistics services (including international container import and export at sea and inland transit freight services), vehicle services and operating parking services within the administrative area of this Municipality shall abide by these measures. Article 3 The road transport service industry shall follow the principles of overall planning, rational layout, diversified business and coordinated development, encourage horizontal alliance, and gradually form a service network through quality service and legal competition. Article 4 Xi Transportation Bureau is the competent department of road transportation service industry in this Municipality. Road transport management institutions at all levels are responsible for the implementation of these measures. Article 5 Units and individuals engaged in road transport services shall submit a written application report to the municipal road transport management institution in accordance with the Regulations of the People's Republic of China on Road Transport, and the road transport management institution shall complete the examination and approval procedures within 20 days, and issue a road transport business license to those who meet the requirements; Units or individuals engaged in road transport services in yanliang district, Lintong District, Chang 'an District and counties under the jurisdiction of the city shall go through the examination and approval procedures at the road transport management institution of the district or county where they are located. Article 6 Units and individuals engaged in road transport services shall apply to the local industrial and commercial and tax authorities for registration with the road transport business license issued by the road transport management institution. Seventh units or individuals engaged in road transport services to change the licensing matters, shall go through the registration of change at the original licensing authority. Eighth units and individuals engaged in road transport services must comply with the following provisions:

(a) conscientiously implement the relevant laws and regulations of the state, operate in good faith within the approved scope, and hang the road transport business license in a prominent position in the business premises.

(two) in accordance with the "People's Republic of China (PRC) contract law" and the Ministry of communications "rules" and other relevant provisions, signed a contract with the service object.

(three) strictly implement the charging items and standards approved by the transportation and price management departments, and publish them in the business premises. It is not allowed to set up charging items and self-determined charging standards without authorization.

(four) do not engage in regional or departmental blockade, do not take monopoly, reselling goods, AG low prices, intermediary exploitation and other ways to make profits. The transport and stowage of goods shall not be entrusted to operators without road transport business licenses.

(five) must use the unified special invoices supervised by the tax authorities, and are not allowed to make bills or use other settlement vouchers without permission. Ninth units and individuals engaged in road transport services shall regularly submit the required statistical reports to the road transport management institutions that issue road transport business licenses. Tenth road transport service practitioners must participate in the training and assessment of legal knowledge, professional ethics and business knowledge, and improve the level of road transport services. Eleventh road transport management institutions should actively support and guide the development of road transport service industry, and implement effective supervision and management and services. It is necessary to regularly check the business conditions, business behaviors and safety measures of operators. Units and individuals under inspection shall take the initiative to provide relevant statements, account books and materials, and shall not refuse or obstruct them. Twelfth in violation of the provisions of article seventh, article eighth (a), impose a fine of more than 500 yuan 1000 yuan; In violation of other provisions of these measures, it shall be punished according to the Regulations of the People's Republic of China on Road Transportation. Thirteenth if a party refuses to accept the punishment decision of the road transport management institution, it may apply for administrative reconsideration or bring an administrative lawsuit according to law. Fourteenth road transport management institutions and their staff should enforce the law impartially, establish an open service system, and consciously accept the supervision of operators and the masses. Fifteenth units and individuals who have been engaged in road transport services before the promulgation of these measures must go through the examination and approval procedures in accordance with the provisions of Article 6 within 30 days from the date of promulgation of these measures. Sixteenth foreign, Hong Kong, Macao and Taiwan enterprises resident representative offices and foreign-invested enterprises engaged in road transport services, with reference to these measures. Article 17 These Measures shall be implemented as of the date of promulgation.
