Regulations of Shanxi Province on the Administration of Sports Business Activities

Chapter I General Provisions Article 1 In order to strengthen the management of sports business activities and promote the healthy development of sports business activities, these Regulations are formulated in accordance with the provisions of the Sports Law of the People's Republic of China and relevant laws and regulations, combined with the actual situation of this province. Article 2 Those who engage in sports business activities within the administrative area of this province shall abide by these regulations. Article 3 The term "sports business activities" as mentioned in these Regulations refers to profit-making activities that take sports activities as the content and means and enter the market in the form of commodities, including:

(a) business sports clubs, sports activity centers, sports resorts, stadiums and other places with fixed sports facilities;

(two) business sports competitions, performances, fitness, bodybuilding and entertainment activities;

(three) business sports training, counseling, consulting and information services;

(four) business physical fitness test and physical rehabilitation activities;

(five) sports brokerage activities, sports advertisements, exhibitions and sports lottery sales activities;

(six) the use of sports competitions, performances, special signs or sports organizations in the name of business activities, as well as other sports intangible assets for commercial development;

(seven) paid transfer of broadcasting rights of sports activities, competitions, performances and related sports programs;

(eight) other sports business activities. Article 4 The sports involved in sports business activities refer to the traditional national and folk sports which are recognized by international sports organizations and approved by the national sports authorities and can enhance physical fitness and entertain the body and mind. Specific projects proposed by the provincial sports administrative department, announced after the approval of the provincial people's government. Fifth sports business activities should adhere to the principle of combining economic benefits with social benefits, and promote the construction of socialist material civilization and spiritual civilization. Article 6 People's governments at or above the county level shall strengthen their leadership over the management of sports business activities, and guide and support the development of sports business activities within their respective administrative areas. Article 7 Citizens, legal persons and other organizations are encouraged and supported to set up sports business places and engage in healthy and beneficial sports business activities.

Encourage and support organizations and individuals engaged in sports business activities (hereinafter referred to as sports operators), and commend and reward sports operators who have made outstanding contributions to the implementation of the national fitness plan and the training of outstanding sports talents. Eighth sports administrative departments at or above the county level or institutions authorized by the people's government at the same level shall be responsible for the supervision and management of sports business activities within their respective administrative areas, and their main responsibilities are:

(a) to publicize and implement the laws and regulations on the management of sports business activities.

(two) to formulate and organize the implementation of sports business activities development plan, establish and improve the management system of sports business activities;

(three) to formulate employment conditions, standards and approval procedures for various sports business activities, and to assess sports operators engaged in sports business activities;

(4) Training, assessment and qualification certification of sports management personnel and professional and technical personnel;

(five) other duties as prescribed by laws and regulations. Article 9 Departments of industry and commerce, public security, taxation, price, finance, health, planning and technical supervision at or above the county level shall, according to their respective functions and duties, supervise and manage sports business activities according to law. Tenth sports administrative departments at or above the county level may entrust organizations that meet the conditions stipulated in Article 19 of the Administrative Punishment Law of the People's Republic of China to supervise and manage sports business activities. Chapter II Application and Approval Article 11 To engage in sports business activities, the following conditions shall be met:

(a) there is a place that meets the requirements of sports business activities;

(2) Having the necessary funds, facilities, equipment and equipment that meet the national standards;

(3) Having sports professionals who have obtained qualification certificates;

(4) There must be safety conditions;

(5) Other conditions stipulated by laws and regulations. Article 12 To engage in sports business activities with strong professional skills, great risks and great social impact, it shall be examined and approved by the sports administrative department at or above the county level or the institution authorized by the people's government at the same level, and after obtaining the sports business license, it shall apply to the administrative department for industry and commerce for a business license. Specific projects announced by the provincial people's government.

Temporary sports business activities such as sports competitions and performances shall be examined and approved by the sports administrative department at or above the county level or the institution authorized by the people's government at the same level, and relevant formalities shall be handled with the administrative department for industry and commerce. Thirteenth sports business activities of the examination and approval of the implementation of hierarchical management. Specific measures shall be formulated by the provincial people's government. Article 14 To apply for a sports business license, the following materials shall be provided:

(a) the application and related certification materials;

(2) A copy of the contract or agreement;

(three) sports venues, facilities, equipment and equipment information;

(4) Information of sports professionals;

(5) Other necessary information.

Those who apply for engaging in dangerous sports business activities shall also provide a feasibility study report. Fifteenth sports administrative departments at or above the county level or institutions authorized by the people's government at the same level shall make a reply within 30 days from the date of receiving the application. Approved, issued a sports business license; If it is not approved, it shall explain the reasons to the applicant in writing.
