Measures for the Administration of Cargo Transportation of Motor Vehicles from Foreign Countries in Shanghai

Article 1 (Purpose and Basis)

In order to strengthen the management of goods transportation of foreign motor vehicles in Shanghai, standardize the road goods transportation market in the city, and maintain the market order of road goods transportation, these Measures are formulated in accordance with the "Shanghai Municipal Road Transportation Management Regulations" and the relevant provisions of the State. Article 2 (Definition)

The foreign motor vehicle cargo transportation in Shanghai (hereinafter referred to as the Shanghai cargo transportation), refers to the use of non-motor vehicles with local license plates in the city to engage in cargo transportation business activities. Article 3 (Scope of Application)

These measures are applicable to the management of foreign motor vehicles engaged in the transportation of goods in the administrative area of the city. Article 4 (competent and co-management)

Shanghai Municipal Administration of Transportation (hereinafter referred to as the municipal administration of transportation) is the competent authority for the transportation of goods in Shanghai, and the Shanghai Municipal Administration of Land Transportation (hereinafter referred to as the Municipal Administration of Land Transportation) is responsible for the specific management of its subordinate departments.

Districts and counties, in accordance with their respective responsibilities, are responsible for the management of freight transportation in Shanghai under their jurisdiction.

Industry and commerce, taxation, price, public security, market, construction project management and other departments should be in accordance with their respective responsibilities, and work together to do a good job in the management of freight transportation in Shanghai. Article 5 (Management Principles)

The management of goods transportation in Shanghai, the implementation of the introduction of the best according to need, encourage legal competition, improve the quality of transportation, the implementation of the principle of total control. Article 6 (total regulation)

The municipal transportation management department shall, according to the actual situation in the city, determine the total amount of regulation on the capacity, scale of operation and technical composition of the Shanghai-based cargo transportation, and implement regular adjustments. Article 7 (Conditions for Application)

Applicants for goods transportation in Shanghai must have the following conditions:

(1) having the legal personality of the transportation enterprise;

(2) having the business license issued by the competent department of industry and commerce and transportation in the place where the vehicle is located, the road transportation operation license and the road transportation certificate;

(3) having the operation place and parking place in this city which are suitable for its scale of operation;

(4) having a business place and a parking place in this city which are suitable for its scale of operation. (C) in the city has a business premises and its scale of operation of the parking lot;

(D) motorized freight vehicles with good technical performance, neat and tidy;

(E) management personnel, dispatchers, drivers by the city of road transport vocational training and assessment;

(F) in accordance with the provisions of the city of Shanghai to complete the other formalities of the personnel. Article 8 (Materials to be submitted when applying)

Application for goods transportation in Shanghai shall provide the following materials:

(1) application for goods transportation in Shanghai;

(2) copy of business license, road transport operation permit, road transport certificate and a copy of the vehicle's driving license;

(3) the county-level or above of the vehicle registration of the transport management department agreed to engage in goods transportation in the city's approval documents;

(d) the city has a business premises, proof of parking space;

(e) the city's Class A automobile comprehensive performance testing station issued by the vehicle testing certificate;

(f) the city's transport management department issued by the certificate of vocational training;

(g) the personnel stationed in Shanghai in accordance with the provisions of the city to apply for materials for the relevant procedures.

Foreign construction units approved by the Shanghai Municipal Construction Industry Management Office to enter Shanghai, apply for goods transportation in Shanghai, only need to provide the materials listed in the preceding paragraph (a), (d), (e), (f), (g). Article IX (approval procedures)

Application for goods transportation in Shanghai, the unit shall apply to the district or county transportation management department where its business premises in Shanghai, after examination and approval, reported to the Municipal Land Management Division for approval.

The municipal land management office in accordance with the total amount of regulation determined by the municipal transportation management department and the relevant technical and economic conditions for the opening of the transportation industry, within 30 days from the date of receipt of the application to make a decision on approval. After examination, shall approve the scope of business and operating vehicles, issued a temporary operating permit, and issued a temporary road transport certificate by vehicle; after examination, shall be unqualified, shall be given a written reply. Article X (Registration)

Approved to engage in the Shanghai freight transport business units (except for contracting construction projects), shall hold a temporary business license, to the district or county where the Shanghai business place of business, industry and commerce, the tax department to complete the registration formalities, before operating. Article 11 (Term of Operation and Extension Procedures)

The term of operation for the transportation of goods in Shanghai shall be 12 months. If it needs to be extended due to special circumstances, it shall apply for extension procedures to the Municipal Land Management Office and accept the annual verification of its business qualification and business behavior by the municipal transportation management department.

The motorized freight vehicles of the operating units shall be subject to secondary maintenance by the repair units qualified for secondary maintenance of automobiles in the city and shall be tested and passed by the comprehensive performance testing stations of Class A automobiles in the city before applying for the extension procedures. Article XII (vehicle increase or decrease)

Operating units need to increase the Shanghai motorized freight vehicles, shall be in accordance with the approval procedures set forth in these measures to apply for a separate application; need to reduce the Shanghai motorized freight vehicles, should be the original acceptance of the application of the district or county transportation management department to surrender the vehicle's temporary road transport certificate, and to handle the relevant procedures. Article XIII (termination of business)

Operating units need to terminate the Shanghai freight transport, should be 30 days before the termination date of the original acceptance of the application to the district or county transportation management department, by the relevant district or county transportation management department reported by the municipal land management department for the record after the cancellation of its temporary business license, temporary road transport certificate, the city's unified invoice of the transportation industry, and by the operating units of the business to the industry and commerce, Taxation department for the relevant procedures.
