Regulations on the Protection and Development of Minority Villages in Sanjiang Dong Autonomous County
The protection list of ethnic minority villages in Autonomous County shall be announced to the public.
Autonomous County People's Government shall actively strive for the higher authorities to give policy, project, technology and financial support for the protection of ethnic minority villages. Article 6 In the minority villages listed in the autonomous county protection list, the proportion of minority population is not less than 30%, the total number of households is not less than 30, and the characteristic houses are not less than 50% of the village houses, and one of the following conditions is met:
(1) Industries with ecological natural landscape and national characteristics;
(two) the main buildings with ethnic characteristics, coordinated layout, typical style;
(3) National traditional customs are well preserved;
(four) the traditional folk crafts or skills are well preserved and still in use today, which is unique;
(five) the protection of cultural relics related to national traditional culture or major historical events and historical celebrities.
With the conditions of the village mentioned in the preceding paragraph, after discussion and consent by the villagers' meeting or the villagers' representative meeting, the villagers' committee shall apply to the township (town) people's government, and the township (town) people's government shall report to the Autonomous County People's government after preliminary examination, and the Autonomous County People's government shall organize relevant experts to make a comprehensive evaluation before deciding whether to take the village.
The village is listed in the protection list of ethnic minority villages in Autonomous County.
When applying to the township (town) people's government, the villagers' committee shall submit a description of the basic situation of the village. Seventh included in the autonomous county protection list of ethnic villages, within two years from the date of inclusion in the protection list, by the township (town) people's government organization to complete the preparation of protection planning.
When preparing the protection plan, the township (town) people's government that organizes the preparation of the plan shall publish the draft plan, and extensively solicit the opinions of relevant departments, experts and villagers through demonstration meetings, hearings or other means.
The protection plan shall be discussed and agreed by the villagers' meeting or the villagers' representative meeting in the village, submitted to the township (town) people's congress for deliberation, and reported to the people's government of the autonomous county for examination and approval.
Within fifteen days after the protection plan is approved by the people's government of the autonomous county, the township (town) people's government that organizes the planning shall announce it to the public. Article 8 The protection plan for ethnic minority villages shall include the following contents:
(1) Protection principles, protection contents and planning areas;
(two) protection measures, development intensity and construction control requirements;
(3) Requirements for protecting the traditional pattern and historical features;
(four) the scope of the protection core area, the construction control area and the style coordination area;
(five) the phased implementation plan of the protection plan. Article 9 The protection plan approved according to law shall not be modified without authorization; If it is really necessary to modify the village protection, the township (town) people's government that organizes the preparation of the protection plan shall submit a special report to the Autonomous County People's government, and the revised plan can only be prepared after the approval of the Autonomous County People's government. The revised protection plan shall be submitted for approval in accordance with the examination and approval procedures stipulated in Article 7 of these Regulations. Article 10 Buildings and places such as Diaojiaolou, Drum Tower, Zhaimen, Stage, Storm Bridge, Treadmill, Arena, etc. in the protection planning area of ethnic minority villages shall be protected, repaired and kept in good condition.
New construction, renovation, expansion and maintenance of buildings and structures in the protection planning area shall conform to the requirements of construction control, resource conservation and disaster prevention stipulated in the protection planning, and maintain the original features, local characteristics and national style of the village.
If a construction project is carried out in the protection planning area, the construction permit shall be handled according to law before the start of construction. Upon approval according to law, the construction unit shall formulate a construction plan, take effective measures to protect the cultural landscape and surrounding vegetation, water bodies and landforms, and shall not cause pollution or damage; After the completion of the project, the construction unit shall promptly clean up the construction site and restore it to its original state. Article 11 In the planning area for the protection of ethnic minority villages, if the built buildings and structures are uncoordinated and inconsistent with the overall architectural style of the village, they should be gradually transformed or moved out according to the protection plan, and the Autonomous County People's Government should make corresponding compensation according to law. Twelfth minority villages should strengthen fire safety publicity and education, and do a good job in preventing and eliminating fire hazards.
Where it is necessary to rebuild a village with ethnic characteristics due to fire safety, fire exits should be set up as far as possible and equipped with fire control facilities on the basis of not destroying the original appearance of the village.
No organization or individual may occupy, block or close the fire escape, and may not damage, misappropriate, dismantle or stop the fire control facilities and equipment without authorization.
