Regulations of Handan Municipality on Urban and Rural Planning

Chapter I General Provisions Article 1 In order to strengthen the management of urban and rural planning, coordinate the urban and rural spatial layout, protect ecological resources, improve the living environment, and promote the comprehensive, coordinated and sustainable development of urban and rural economy and society, these Regulations are formulated in accordance with the Urban and Rural Planning Law of People's Republic of China (PRC), the Regulations on Urban and Rural Planning of Hebei Province and other relevant laws and regulations, combined with the actual situation of this Municipality. Article 2 The formulation and implementation of urban and rural planning within the administrative area of this Municipality and various construction activities within the planning area must abide by these regulations.

Urban and rural planning as mentioned in these Regulations includes urban system planning, urban planning, town planning, township planning and village planning.

The "planning area" as mentioned in these Regulations refers to the built-up areas of cities, towns and villages, as well as scenic spots, nature reserves, water source protection areas and other areas where planning control is necessary for urban and rural construction and development.

The specific scope of the planning area shall be defined by the relevant people's government in the overall urban planning, town planning, township planning and village planning according to the level of urban and rural economic and social development and the needs of urban and rural overall development. Article 3 The formulation and implementation of urban and rural planning shall follow the principles of overall urban and rural planning, scientific planning, rational layout, land conservation, intensive development and planning before construction. And meet the needs of regional population development, national defense construction, disaster prevention and mitigation, public health and public safety. Article 4 The preparation of urban and rural planning shall be based on the national economic and social development planning and linked with the overall land use planning.

The funds for the preparation and management of urban planning and topographic mapping shall be included in the fiscal budget at the corresponding level. Town, township and village planning, management and topographic mapping funds should be included in the fiscal budget of the people's government at the county level. Article 5 Urban and rural planning approved according to law is the basis of urban and rural construction and planning management, and it may not be amended without legal procedures.

All units and individuals shall abide by the urban and rural planning approved and published according to law, obey the planning management, and have the right to inquire the competent department of urban and rural planning whether the construction activities involving their interests meet the planning requirements. Article 6 The competent department of urban and rural planning shall carry out planning research, encourage the adoption of advanced science and technology, strengthen the construction and management of geographic information and various urban and rural planning databases, strengthen the management of urban and rural planning files, and improve the efficiency of the implementation, supervision and management of urban and rural planning. Article 7 The people's governments of cities and counties (cities) shall set up urban and rural planning committees as the deliberative bodies of urban and rural planning decisions of the people's governments at the corresponding levels. Urban system planning, overall planning, special planning, regulatory detailed planning, important construction detailed planning, major construction projects and important technical specifications and regulations shall be reviewed by the Urban and Rural Planning Committee. The daily work of the Urban and Rural Planning Committee shall be undertaken by the competent department of urban and rural planning of the city and county (city). Article 8 The municipal competent department of urban and rural planning shall be responsible for the management of urban and rural planning within its administrative area. Included in the urban planning area of Handan City, the competent department of urban and rural planning is responsible for urban and rural planning and management.

County (city) competent department of urban and rural planning is responsible for the management of urban and rural planning within their respective administrative areas.

The town (township) people's government shall determine the corresponding institutions or personnel responsible for urban and rural planning and management within their respective administrative areas. Article 9 The municipal competent department of urban and rural planning shall, according to the relevant national and provincial technical specifications, organize the formulation of technical specifications for urban and rural planning management, which shall be promulgated and implemented after being approved by the Municipal People's Government. Chapter II Formulation of Urban and Rural Planning Article 10 The overall urban planning shall be formulated by the Municipal People's Government, reviewed by the Standing Committee of the Municipal People's Congress and audited by the provincial people's government, and submitted to the State Council for approval.

The overall urban planning of county-level cities shall be organized by the county-level municipal people's government, reviewed by the Standing Committee of the county-level municipal people's congress, reviewed by the municipal people's government, and submitted to the provincial people's government for examination and approval.

The overall planning of the town where the county people's government is located shall be organized by the county people's government, deliberated by the Standing Committee of the county people's congress and reported to the Municipal People's government for approval.

The overall planning of other towns under the jurisdiction of the county (city) shall be organized by the town people's government, and shall be submitted to the county (city) people's government for approval after being reviewed by the town people's congress.

Township planning shall be organized by the Township People's Government, reviewed by the Township People's Congress and submitted to the county (city) people's government for approval.

When the planning organ submits the overall urban planning, town planning and township planning, it shall submit the deliberation opinions of the members of the Standing Committee of the people's congress at the corresponding level or the representatives of the town (township) people's congress and the revision of the plan according to the deliberation opinions.

Village planning shall be organized by the township (town) people's government and submitted to the county (city) people's government for approval after discussion and consent by the villagers' meeting or the villagers' representative meeting. Eleventh town planning, township planning and village planning within a planned urban area shall conform to the requirements of the overall urban planning. Towns, townships and villages included in the scope of urban planning and construction land are no longer planned separately; Included in the village planning and construction land within the scope of the village, no longer separate village planning. Twelfth independent industrial and mining areas, farms, forest farms and other units shall organize the preparation of local master plans and regulatory detailed plans, and report them to the people's government for approval. Thirteenth city and county people's government is located in the town of special planning by the relevant departments of the city and county people's government according to the overall planning organization, after the audit by the competent department of urban and rural planning at the same level, reported to the city and county people's government for approval.

The special planning of other towns shall be organized by the town people's government and submitted to the municipal and county people's governments for approval.
