Interim Measures of the Ministry of Energy for the Administration of Commodities with Self-owned Foreign Exchange Import Quotas

Article 1 Types of quota commodities and centralized management departments

At present, there are 47 commodities subject to the import quota system:

1. Commodities directly balanced by the State Planning Commission: crude oil, refined oil, carbonated beverage products and concentrated solution, wool, polyester, acrylic fiber, polyester chips, and production lines whose import is suspended by the state;

2 products balanced by the State Planning Commission in conjunction with relevant departments:

Materials and Equipment Department: steel, scrapped ships, wood, plywood, rubber (including synthetic rubber), ABS resin, automobile tires, (including used tires) and polycarbonate;

Materials and Equipment Department of Metallurgical Ministry: steel billet and scrap steel;

Materials and Equipment Department of Ministry of Chemical Industry: sodium cyanide;

Ministry of Chemical Industry and Ministry of Commerce: pesticides;

Ministry of Commerce: sugar and fertilizer;

Ministry of light industry: wood pulp;

Tobacco Monopoly Bureau: tobacco, cigarette filter, cellulose diacetate tow;

State administration of traditional chinese medicine: Southern Medicine.

3. The State Planning Commission cooperates with the State Council Mechanical and Electrical Equipment Import Review Office to summarize and balance the goods approved for import in the State Council: mechanical and electrical products restricted by the state (see attached table 1).

Border trade, barter trade, trade with Taiwan, processing with materials, processing with materials and quota commodities imported by foreign-funded enterprises, Chinese-foreign joint ventures and Chinese-foreign cooperative enterprises are still under centralized management according to the existing management channels, and specific management measures are formulated by the competent department. Article 2 Procedures for compiling import quota commodity plans

1. According to the requirements of the State Planning Commission on compiling the annual self-owned foreign exchange import plan, the Ministry (hosting the International Cooperation Department and the Comprehensive Planning Department, the same below) sends letters to its subordinates and centralized management units, and each unit prepares the plan and reports it according to the specified date;

2. The plans of various units summarized by the Ministry shall be incorporated into the annual self-owned foreign exchange import plan of the Ministry of Energy after examination, and submitted to the State Planning Commission (the import plan of mechanical and electrical products restricted by the state, with a copy to the the State Council mechanical and electrical equipment import review office);

3. In order to arrange the import work of all units, the State Planning Commission requires that the next year's own foreign exchange import reserve plan be compiled in the fourth quarter of each year, and all units should compile the reserve plan in time as required;

4. The annual self-owned foreign exchange import plan shall be submitted for approval once a year in principle. If it is really necessary to increase the import index in the implementation, it shall be reported to the State Planning Commission by the Ministry before the end of June each year. In principle, the import control index of mechanical and electrical products restricted by the state will no longer be increased. Article 3 Review and release the import quota commodity plan (annual plan and commodity reserve plan).

1. Mechanical and electrical products restricted by the state: the State Council Mechanical and Electrical Equipment Import Review Office and the State Planning Commission are comprehensively balanced, incorporated into the national annual centralized import approval plan, and jointly issued after approval by the State Council;

2. Commodities subject to quota management and other commodities: issued by the State Planning Commission after comprehensive balance in consultation with relevant competent departments;

3. The quantity and amount of quota commodities that have been incorporated into the import plans of local and departmental governments shall be regarded as the import quota targets of local and departmental governments issued by the state, which shall be strictly implemented according to the plan and shall not be exceeded;

4. After the State Planning Commission issued the plan, the Ministry decomposed the planned indicators issued by the State Planning Commission into various units according to the plans put forward by subordinates and centralized management units, and each unit put forward the implementation plan for the use of quota commodities within one month according to the indicators issued. Failing to apply for use according to the implementation plan, or failing to propose a change plan within the planned period, the indicators shall be arranged by the Ministry in a unified way. Article 4 Measures for the administration of import of quota commodities and procedures for examination and approval.

1. Measures for the Administration of Import of Quota Commodities

The State Planning Commission uniformly engraved the "Special Seal for Commodities with Self-owned Foreign Exchange Import Quota". "Special Seal for Foreign Exchange Import Quota Commodities of the Ministry of Energy" is in the Department of International Cooperation. The order card for import quota commodities belonging to the Ministry and the centralized management unit shall be stamped with the "Special Seal for Quota Commodities" before going through the examination and approval procedures and applying for an import license at the relevant departments.

2. Approval procedure

Application documents submitted by the applicant: order card 1 copy (specifying product name, specification, quantity and amount in detail), summary list 1 copy (warehousing department) and foreign exchange voucher 1 copy (warehousing department).

Review: Whether the application documents are complete and correct; Whether the quota commodity index balance of this unit is sufficient.

Seal: affixed with the "Special Seal for Commodities with Foreign Exchange Import Quota of the Ministry of Energy" after being signed and approved by the leaders of our company.

Registration: after signing the cartoon, register and reduce the quota commodity index.

3. Performance report

Ministry: report the approval of quota commodities in the last quarter to the Economic and Trade Department of the State Planning Commission and the Comprehensive Planning Department of the Ministry of Economic and Trade within 10 days after each quarter;

Applicant: Take this batch of quota commodities as the unit, and report the implementation to the Ministry in writing according to Schedule 2 at the end of each quarter until the users (end users) receive the quota commodities. attached table

Including chassis, various modified vehicles, special vehicles and special vehicles.

The CPU board includes programmable calculators and microcomputers with less than 16 bits; Software and hard disk drives, printers, display terminals, tape drives, computer typewriters, flat plotters. Not including programmers.

Including projection TV, industrial TV, 14 inch and above display.

Including refrigerators and food display cabinets. It does not include refrigerators and freezers with a capacity of more than 340 liters or with a minimum refrigeration temperature below -40℃.

8. washing machine

Does not include washing machines and dry cleaning machines with laundry capacity exceeding 6 kg.

9. Complete video equipment, video recorder and movement.

10. The camera and its body (including casing, shutter and viewfinder) do not include overhead, underwater, board-making and fundus cameras.

Note: If the total price of each set of imported mechanical and electrical products restricted by the above-mentioned countries reaches 60% or more of the CIF price of the same model products, the examination and approval procedures shall be handled in accordance with the provisions of the state on restricting the import of mechanical and electrical products, and an import license shall be applied for.
