Regulations on the Protection of Historical Buildings and Historical and Cultural Neighborhoods in Mianyang City

Chapter I General Provisions Article 1 In order to strengthen the protection and management of historical buildings and historical and cultural neighborhoods, inherit and carry forward the excellent historical culture, and promote the coordinated development of urban and rural construction and historical and cultural, according to the "Chinese People's Republic of China *** and the State Urban and Rural Planning Law," "Regulations on the Protection of Historical and Cultural Cities and Towns and Villages," and other relevant laws and regulations, combined with the actual situation in Mianyang, to formulate the Regulations. Article 2 These regulations shall apply to the protection and management of historical buildings and historical and cultural neighborhoods within the administrative area of the city.

The historic buildings referred to in these regulations, refers to the people's government of the city, county (city) to determine the announcement of a certain value of protection, reflecting the historical features and local characteristics, not announced as a unit of cultural relics protection, nor registered as immovable cultural relics of the buildings (structures).

The historic and cultural district referred to in these regulations, refers to the provincial people's government approved by the announcement of the preservation of cultural relics is particularly rich in historical buildings are concentrated in pieces, can be more complete and true reflection of the traditional pattern and historical features, and has a certain scale of the area. Article 3 The protection and management of historical buildings and historical and cultural neighborhoods shall follow the principles of scientific planning, strict protection, standardized management and rational use, maintain the authenticity and integrity of historical buildings and historical and cultural neighborhoods, correctly deal with the relationship between economic and social development and the protection of historical and cultural heritage, and safeguard the lawful rights and interests of the owners of historical buildings. Article 4 The people's governments of cities and counties (cities and districts) shall strengthen the protection and management of historical buildings and historical and cultural neighborhoods within their administrative regions, and establish a joint working mechanism for the protection of historical buildings and historical and cultural neighborhoods.

Township (township) people's governments and street offices are responsible for daily inspections of historical buildings and historical and cultural neighborhoods and assisting in on-site protection.

People's governments at all levels shall incorporate the protection of historical buildings and historical and cultural neighborhoods into national land space planning. Article 5 The departments in charge of housing and urban-rural construction are responsible for the protection and supervision and management of historic buildings and historic and cultural neighborhoods.

The competent department of urban and rural planning is responsible for the planning and management of historic buildings and historic and cultural neighborhoods.

The competent authorities in charge of cultural relics are responsible for organizing the historical data and information of the objects under protection, excavating and evaluating their historical value, and assisting the relevant departments in the protection and management of historical buildings and historical and cultural districts.

Finance, tourism, business, public security, urban management, education and sports, emergency management, fire rescue, transportation, market supervision, forestry, archives, ethnic religion, human defense and other relevant departments, should be in accordance with their respective responsibilities **** with the protection and management work. The composition and working rules of the expert advisory committee shall be formulated by the people's governments of the cities, counties (cities). Article 7 The people's governments of cities and counties (cities and districts) shall provide financial guarantee for the protection of historical buildings and historical and cultural neighborhoods, and include the protection funds in the budget at the same level, which shall be specially used for protection and management.

The municipal people's government shall give appropriate subsidies to counties (cities and districts) for the protection of historical buildings and historical and cultural neighborhoods.

Encourage units, individuals and other organizations through donations, funding, investment, and the provision of technical services, etc., in accordance with the law to participate in the protection of historic buildings and historic and cultural districts. Article 8 Any unit or individual has the right to put forward opinions and suggestions on the protection of historical buildings and historical and cultural neighborhoods, and has the right to discourage, complain or report illegal acts that damage historical buildings and historical and cultural neighborhoods.

Chapter II: Determination of Historical Buildings and Historical and Cultural Neighborhoods Article 10: Buildings (structures) that have been built for more than fifty years and meet one of the following conditions may be determined by the people's governments of the cities and counties (municipalities) to be historical buildings:

(1) those reflecting the excellent historical cultures of Rayon culture, Dayu culture, the Three Kingdoms and Shuhan culture, Li Bai culture, Wenchang culture, etc.

(2) those reflecting the cultural characteristics of the Qiang, Baima, Tibetan and other nationalities;

(d) architectural style, structure, materials, construction technology or engineering technology, reflecting the historical and cultural characteristics of regional architecture, artistic features or scientific research value;

(e) related to important historical events, revolutionary activities, famous figures and important organizations, with commemorative significance;

(f) reflecting the cultural characteristics of the Qiang, Baima and Tibetan peoples, and so on. Important organizations and institutions related to commemorative significance;

(F) other important historical and cultural, architectural art, science and technology value.

Built more than thirty years less than fifty years, but meets one of the conditions set out in the preceding paragraph, outstandingly reflecting the local characteristics of the times of the building (structure), the city, county (city) people's government can also be identified as historical buildings.
