The 15th meeting of the Standing Committee of the Seventh NPC passed the People's Republic of China (PRC) Railway Law on September 7th 1990, which was promulgated by Presidential Decree No.32 on the same day and will come into force on May 7th. Article 17 stipulates that railways shall carry out limited compensation and insured transportation.
In China, the railway, civil aviation and water transport industries have relevant regulations on the insured transportation of luggage and goods. "People's Republic of China (PRC) Railway Law" stipulates: "If the shipper applies for insurance transportation voluntarily, it shall compensate according to the actual loss, but the maximum amount shall not exceed the insured amount." Civil aviation law and maritime law adopt different compensation standards for liability compensation for domestic transportation and international transportation, mainly considering the difference between China's national income and other countries. In international transportation, the principles and standards stipulated in international conventions are adopted in most cases, which basically embodies the provisions of international transportation conventions that China has joined. According to the Civil Aviation Law, the limit of liability of international air transport carriers is implemented in accordance with the following provisions: the limit of liability for each passenger is 16600 units of account; However, the passenger may agree with the carrier in writing that the liability limit specified in this item is higher. The limit of liability for checked baggage or goods is per kilogram 17 unit of account. The limit of liability for the articles carried by each passenger is 332 units of account.
