Measures of Shanxi Province for the Administration of Provincial Grain Reserves

Chapter I General Provisions Article 1 In order to strengthen the management of provincial grain reserves, give play to the macro-control role of provincial grain reserves, and maintain the stability of the grain market, these measures are formulated in accordance with the Regulations on the Administration of Grain Circulation and other relevant laws and regulations, combined with the actual situation of this province. Article 2 These Measures shall apply to the planning, storage, utilization, supervision and management of provincial grain reserves within the administrative area of this province.

The term "provincial grain reserves" as mentioned in these Measures refers to the grain (including edible oil) reserved by the provincial people's government for regulating the province's grain supply and demand, stabilizing the grain market, and responding to major natural disasters, major public health incidents or other emergencies. Article 3 The management of provincial grain reserves shall adhere to the principles of government leading, graded responsibility, smooth supervision, safety and effectiveness. Article 4 The provincial people's government shall establish and improve the responsibility system for food security, strengthen the management of provincial grain reserves, improve the working mechanism of provincial grain reserves, determine the scale of provincial grain reserves according to the total grain reserve plan or dynamic adjustment requirements issued by the state, and formulate and issue provincial grain reserve plans.

The people's governments of cities and counties (cities, districts) that undertake the task of provincial grain reserves are responsible for the storage safety of provincial grain reserves, and fulfill the responsibility of food safety and production safety management of provincial grain reserves according to law. Article 5 Provincial grain administrative departments shall be responsible for the administrative management of provincial grain reserves, organize the implementation of provincial grain reserve plans, establish a provincial grain reserve business management system, strengthen the information construction of grain reserves, and supervise and inspect the variety, quantity, quality and storage safety of provincial grain reserves.

The Provincial Department of Finance is responsible for financial subsidies such as loan interest, storage fees, rotation fees (hereinafter referred to as management fees) of provincial grain reserves, establishing provincial grain reserve funds, ensuring timely and full disbursement, and supervising and inspecting the financial implementation of provincial grain reserves.

Other relevant departments of the provincial people's government shall, in accordance with their respective responsibilities, do a good job in the relevant work of provincial grain reserves.

The Agricultural Development Bank shall, in accordance with the relevant provisions of the state, ensure the need for credit funds for provincial grain reserves. Article 6 Units undertaking the storage of provincial grain reserves (hereinafter referred to as storage units) shall be responsible for the daily operation and management of provincial grain reserves, and shall be responsible for the variety, quantity, quality and storage safety of provincial grain reserves.

The storage unit shall open a basic account in the Agricultural Development Bank and accept credit supervision. Seventh without the approval of the provincial people's government, no unit or individual may use the provincial grain reserves. Chapter II Planning Article 8 The grain administrative department of the province shall, jointly with the provincial development and reform department and the provincial finance department, put forward a provincial grain reserve plan (in which the ration ratio is not less than 70%) according to the total grain reserve plan issued by the state, the macro-control needs of the province and the financial affordability, and submit it to the provincial people's government for approval before implementation. Ninth provincial grain and reserve administrative departments shall, according to the provincial grain reserve plan, jointly with the provincial finance department and the Agricultural Development Bank, formulate and issue the provincial grain reserve purchase and sale plan.

The storage unit shall organize the purchase and sale of provincial grain reserves according to the purchase and sale plan of provincial grain reserves. Tenth provincial grain reserves in accordance with the provisions of the implementation of balanced rotation.

The storage unit shall, in combination with the storage quality and storage life of provincial grain reserves, put forward an application for rotation plan step by step, which shall be implemented after the approval of the provincial grain administrative department, the provincial finance department and the Agricultural Development Bank. Eleventh storage units shall, in accordance with the provisions, report to the provincial grain administrative department, the provincial finance department and the Agricultural Development Bank on the implementation of the provincial grain reserve purchase and sale and rotation plan. Chapter III Storage Article 12 The provincial grain reserve management department shall determine the storage units according to the principles of rational distribution, cost saving and easy supervision. A storage unit shall meet the following conditions:

(a) the storage capacity of the warehouse (tank) has reached the safe storage scale of provincial grain reserves, and the storage conditions meet the national standards and technical specifications;

(2) Storage equipment suitable for grain storage function, warehouse (tank) type, access mode, variety and cycle;

(3) Having intelligent storage facilities and information management technology to meet the needs of grain storage safety;

(4) Having instruments and places that meet the national standards for the inspection of the regular quality, storage quality and food safety indicators of grain;

(5) Having professionally trained grain and oil storekeepers, grain and oil quality inspectors, special operators and other management and technical personnel;

(six) good business management and reputation, no illegal business records;

(seven) other conditions stipulated by laws, regulations and rules. Thirteenth storage units shall comply with the following provisions:

(a) the implementation of laws, regulations and rules relating to the management of grain reserves, and compliance with national standards, technical specifications and various systems for the management of provincial grain reserves;

(two) to ensure that the provincial grain reserves in storage reach the quality level stipulated in the purchase and rotation plan, and meet the conventional quality, storage quality and food safety indicators stipulated by the state;

(three) the implementation of special storage, special custody, special account records, to ensure that the provincial grain reserves are consistent, consistent, true in quantity, good in quality and safe in storage;

(four) the establishment of grain reserve safety and production safety management system, equipped with the necessary personal defense, physical defense, technical defense and other safety protection facilities;

(five) according to the provisions of the inspection of warehouse management, found problems in a timely manner;

(six) other provisions of laws, regulations and rules.
