Interim Regulations on Road Transportation Management in Shanxi Province

Chapter I General Provisions Article 1 In order to strengthen the management of road transport, the establishment of a unified, open, competitive and orderly road transport market, to protect the legitimate rights and interests of transport operators and their service recipients, and to promote the development of the road transport industry, according to the relevant provisions of the State, combined with the actual situation in the province, to formulate the Regulations. Article 2 All units and individuals engaged in road transport activities in the administrative area of the province shall comply with these regulations.

The road transport activities referred to in these regulations, refers to the commercial road passenger transport, freight transport (hereinafter referred to as passenger transport, freight transport), and road transport related to handling, automobile maintenance, personnel training and transport service activities.

City public **** passenger transportation is not applicable to these regulations. Article 3 The road transportation industry adheres to the principle of coordinated development and unified management of multiple economic components. Protect legitimate competition and prohibit illegal operation. Article 4 The people's governments at all levels shall, in accordance with the needs of the national economy and social development, formulate the development plan for road transport in the administrative region, the road transport market to implement macro-control. Article 5 The administrative department of transportation at or above the county level is responsible for the management of the road transport industry in the administrative area.

The administrative department of transportation may entrust the transportation management agency under it to perform the specific management duties of the road transport industry.

The administrative departments of industry and commerce, construction, public security, finance, taxation, price, agricultural machinery, shall, in accordance with their respective duties, cooperate with the administrative department in charge of transportation to do a good job in the management of road transportation. Article VI road transport operators shall operate in accordance with the law, quality service, and comply with the road transport market order. Foreign-invested enterprises and Hong Kong, Macao and Taiwan business investment enterprises to apply for road transport, in accordance with relevant state regulations.

Non-business road transport units and individuals, engaged in business road transport within three months, shall apply for temporary operation procedures. Article IX road transport operators shall engage in business activities within the scope of approval, change the scope of business or business, closure, merger, separation, relocation, shall be fifteen days before the original approval authority for formalities. Article XII of road transport vehicles must be carried by the administrative department of transportation issued by the road transport license. Changes in operating categories, areas, routes, frequencies and stops shall be approved by the original approval authority. Article 15 Passenger shuttle buses shall enter the stations and yards designated by the administrative department of transportation to carry passengers and depart at the announced time; non-scheduled route buses shall carry passengers in sequence at the departure station; tourist shuttle buses shall travel on the approved routes and stop at the designated departure point or tourist spot.

Passenger transport operators shall abide by the law and drive in a civilized manner, transporting passengers according to the date, number and place indicated in the ticket, and shall not transfer passengers to other carriers or overload the transport in violation of the regulations.

If a passenger transport operator's fault causes a passenger to miss a ride or take a wrong ride, the operator shall refund the ticket or arrange for a change of ride in accordance with the passenger's request; if a passenger's personal injury or baggage loss or damage is caused, the operator shall bear the corresponding legal responsibility. Article 16 Passenger transportation vehicles entering the city shall travel on designated routes.

City public **** passenger transport vehicles across the city, suburban areas to operate passenger transportation in accordance with the provisions of these Regulations.

Tractors and freight vehicles shall not be engaged in passenger transportation. Article 17 Cargo transportation operators shall carry goods according to the model and technical conditions of the vehicle, and shall not overload the transportation.

The parties to the carriage of goods, consignor and consignee, shall conclude a contract of carriage in accordance with the law.

The carrier's responsibility for the loss of or damage to the goods, the carrier shall be compensated. Article XVIII of the national and provincial provisions of the limited, certificated transportation of goods and dangerous goods, the shipper must be in accordance with the relevant provisions of the state and the province for permitted transport procedures. Carrier of dangerous goods operators must obtain qualifications for the transportation of dangerous goods. Article XIX of passenger transport and freight transport operators should be in accordance with the technical specifications issued by the state use, maintenance of transport vehicles, accept the comprehensive performance of the vehicle test, shall not use the technical performance does not meet the national and provincial standards for transport vehicles engaged in road transport.
