New policy of rural construction land
Land use involves the fundamental interests of the whole nation and must be subject to the unified management of the state. China is sparsely populated. In order to ensure the sustainable development of economy and society, the strictest land management system must be implemented. Land use control system is the core of the strictest land management system. However, in some places, the land use control system has not been strictly implemented and agricultural land has been converted into construction land without legal approval. The Land and Land Management Law of People's Republic of China (PRC) stipulates that "the state implements a land use control system" and that "units and individuals who use land must use land in strict accordance with the purposes determined in the overall land use planning". It is illegal to violate the overall land use planning and change the land use without approval according to law. Any experiment and exploration involving the land management system shall not violate the national land use control system. Local people's governments at all levels should not only strengthen the management of land expropriation or requisition, but also focus on strengthening the control of land use.
Two, strictly regulate the use of land collectively owned by farmers for construction.
At present, in some places, in the process of using land collectively owned by farmers for construction, the problem of expanding the use scope of land collectively owned by farmers without authorization and providing construction land illegally is more serious. People's Republic of China (PRC) Land and Land Management Law stipulates that land collectively owned by farmers can be used for township enterprises, township (town) village facilities and public welfare undertakings, and rural villagers' housing construction.
The newly-increased cultivated land area in land consolidation can only be used for compensation of cultivated land occupied by construction, and cannot be used as an index to expand the scale of construction land. The pilot project of linking the increase and decrease of urban and rural construction land must be strictly controlled within the scope of the pilot approved by the state.
