Measures of Fuzhou Municipality on the Protection and Management of Cultural Heritage in Shanghang Historical and Cultural Blocks

Article 1 In order to strengthen the protection and management of cultural heritage in Shanghang historical and cultural blocks, these measures are formulated in accordance with the People's Republic of China (PRC) Urban and Rural Planning Law, the People's Republic of China (PRC) Cultural Relics Protection Law, the the State Council Regulations on the Protection of Famous Historical and Cultural Towns and Villages, and the Fuzhou Regulations on the Protection of Famous Historical and Cultural Cities, combined with the actual situation of this Municipality. Article 2 The planned protection scope of Shanghang historical and cultural blocks (hereinafter referred to as blocks) includes the core protection scope and the construction control zone. The four specific areas are: Baima Road in the west, Cangxia New City, Hechun Lane, Sanjiehe and Zhong Ping Road in the south, Santong Road in the east and Xue Jun Road in the north, with an area of 3 1.73 hectares.

The core protection scope covers 23.54 hectares from Fuzhou No.4 Middle School and Tiansheng Garden in the north, Zhong Ping Garden and Zhoubian Primary School in the south, Baima Road and Long Ping Road in the west and Gaoding Road and Santong Road in the east.

The construction control zone covers an area of 8. 19 hectares, starting from Yanping Road and Xue Jun Road in the north, reaching Santong Road west of Zhong Ting Street in the east, Zhong Ping Garden in the north, Zhong Ping Road in the south and Long Ping Road and Baima South Road in the west. Article 3 The protection and management of historical and cultural blocks shall follow the principles of scientific planning and strict protection, maintain the authenticity and integrity of historical and cultural heritage, and realize the coordinated development of social, environmental and economic benefits of blocks. Fourth city historical and cultural city block protection management committee (hereinafter referred to as the city block management committee) is responsible for the overall coordination, guidance and supervision of block protection management.

Urban and rural planning, construction, cultural relics, public security and other administrative departments. The Taijiang District People's Government where the block is located shall, in accordance with their respective responsibilities, coordinate in the relevant management and supervision. Article 5 The municipal administrative department of urban and rural planning shall, jointly with the municipal administrative department of cultural relics and the administrative committee of famous city blocks, prepare a block protection plan, which shall be implemented after being approved in accordance with legal procedures. Article 6 The following historical objects with historical, artistic and scientific value in the block belong to the scope of material and cultural heritage, and no unit or individual may damage or move, dismantle, rebuild (expand) or change the nature of use without authorization:

(a) the traditional spatial pattern and street structure in the block;

(2) Historical physical remains of celebrities' former residences, ancient dwellings, traditional shops, meeting halls and religious buildings with historical, artistic and scientific values, including various decorative components of buildings, such as doors, windows, fans, wood carvings, lamp posts, plaques, couplets, sparrows, hanging bells and other wooden components, inscriptions, wells, etc.

(3) Ancient rivers and lakes, ancient bridges, ancient wells, ancient inscriptions and ancient and famous trees;

(4) Other material and cultural heritages that need to be protected. Article 7 The administrative department of cultural relics shall be responsible for the collection, arrangement, publication, exhibition and publicity of the intangible cultural heritage in the block, and rescue and protect the traditional commercial customs and beliefs, traditional arts and crafts, folk dances and folk songs with folk customs, ceremonies, festivals and other traditional folk cultures that reflect the history of Fuzhou. Article 8 Encourage social forces to excavate and sort out traditional culture and art scattered among the people, and support educational research institutions to train relevant professionals and famous old artists to preach and teach. Support the collation and research of folk traditional crafts and folk handicrafts with local characteristics, and protect, utilize and develop traditional crafts. Ninth residents are encouraged to donate or give priority to the sale of ancient furniture and movable cultural relics such as celebrity calligraphy and painting, books and so on in the block to the cultural relics department. Tenth construction projects within the block should meet the requirements of the block protection planning and be in harmony with the surrounding landscape and environment. The decoration of the building facade should be coordinated with the historical features.

The municipal administrative department of urban and rural planning shall solicit the opinions of the administrative committee of the famous city block on the planning and design scheme of the construction project. Eleventh cultural relics protection units announced by the people's governments at or above the district level and the former residences of celebrities listed as protected objects shall be protected and managed in accordance with the laws and regulations on cultural relics protection. If it is necessary to carry out engineering construction within its protection scope due to special circumstances, it shall go through the approval procedures according to law. Article 12 The historical buildings in the block (see Annex for the list) shall be protected and managed in accordance with the Regulations on the Protection of Famous Historical and Cultural Cities, Towns and Villages and the Regulations on the Protection of Famous Historical and Cultural Cities in Fuzhou. Thirteenth illegal construction in historical buildings is prohibited. Before the promulgation of these measures, buildings and structures that are not in harmony with historical buildings will be demolished without authorization, and the Taijiang District People's Government will rectify and dismantle them within a time limit. Article 14 The administrative committee of a famous city block shall, jointly with the Taijiang District People's Government, the administrative department of cultural relics and urban and rural planning, register, survey, photograph and video the cultural protection units, historical buildings and their building components and building materials in the block, and complete the archiving and preservation work, and the building owners and users shall cooperate. Article 15 In the process of block protective restoration, when it is necessary to expropriate households' houses in the block, the Administrative Committee of the famous city block and the Taijiang District People's Government shall check the archives of cultural protection units, historical buildings and their building components and building materials; After the collection is completed, the cultural and historical buildings will be delivered to the protection and restoration unit according to the registration.
