How much do college students know about legal education?
Research shows that since the reform and opening up, the phenomenon of college students' illegal crimes has increased obviously, and the proportion of social criminal crimes has continued to rise. Kang Shuhua, president of China Criminology Research Association and professor of law in Peking University, once presided over an investigation. 1965, juvenile crimes accounted for about 33% of the total social criminal crimes, among which college students accounted for about 1%. During the "Cultural Revolution", juvenile delinquency began to increase, accounting for 60% of all criminal offences, of which college students committed 2.5%. In recent years, juvenile crimes account for 70% to 80% of social criminal crimes, among which the crime committed by college students is about 17%, and the types of crimes are becoming increasingly intelligent and diversified. Compared with social crimes, there is no qualitative difference in the scope, nature and harm involved. The data shows that the "ivory tower" is not calm, and the legal literacy of college students, including legal awareness, is worrying.
1.2007 Investigation on College Students' Legal Awareness in Wenzhou Higher Education Park.
In 2007, the author conducted a random sampling survey on the legal knowledge of more than 580 college students in grades 04, 05 and 06 in three universities in Wenzhou Higher Education Park. The results show that:
(1) Sources of legal knowledge and the importance of understanding legal knowledge
34.23% students' legal knowledge mainly comes from school education, 45.34% students' legal knowledge comes from TV and newspapers, and 20.43% students are influenced by family and other sources. 22.5% students think that they have mastered the necessary legal knowledge and can use it flexibly to solve practical problems, while 77.5% students think that their legal knowledge is insufficient or cannot be used flexibly. 78.6% students think it is necessary to study or study legal knowledge in depth, 13.8% students think it is enough to know about it, and 9.6% students think it is completely unnecessary. About13 of the students think that the reason of weak legal consciousness is the limitation of legal education activities, and12 of the students think that bad social atmosphere and disparity between the rich and the poor are the main reasons. This shows that most students lack legal knowledge, and the legal knowledge education in the school system is not enough to meet the needs of most students.
(2) the ability to actively use legal knowledge
In real life, the proportion of students who consciously and actively use legal knowledge is still not high. For example, when taking part in work-study programs, 62% people are interested in signing contracts with employers, while 38% people are not interested. When cheated, stolen or robbed, 87% chose to report to the public security organ or the school security office, 13% did not report the case; 15.2% people think that it is useless to report a case or that the judicial organs cannot provide effective protection. When encountering illegal acts, the proportion of boys who choose to be indifferent is about 10%, and the proportion of girls is 6%.
(3) the degree of trust in the law and the degree of satisfaction with the current overall situation of the rule of law.
35% students believe in law, 3 1.2% students think that law will be more and more perfect, and 33.8% students think that law has no right to be useful, and that law is becoming a tool for the rich and powerful. 26.4% people are confident that the court will make a fair judgment, and 69.8% people are dissatisfied with the current overall rule of law environment. On the one hand, it shows that the democratic legislation and its procedures as the premise of the rule of law are still far from perfect, and judicial injustice and even judicial corruption are still unimpeded; On the other hand, this negative legal consciousness will seriously affect the establishment of citizens' legal beliefs and the ultimate establishment of ideals and beliefs of the rule of law, which shows the lack of legal beliefs of college students to a certain extent, and also reflects the legal environment and atmosphere that is not conducive to the cultivation of college students' legal awareness.
2. Analysis of survey results.
Because college students' legal consciousness is a multi-factor and multi-level complex system, it is not easy to accurately and comprehensively summarize the current situation of college students' legal consciousness, so this paper can only make a superficial summary of the problems existing in college students' legal consciousness in combination with the survey results:
(1) College students lack the basic spirit of accurately understanding and grasping the modern rule of law as a whole.
Modern rule of law is based on democracy and centered on the protection of human rights, which is essentially different from the traditional legal system. It believes that law is the unity of tools and purposes, and emphasizes the purpose value of law. However, in the investigation, we found that college students have no clear understanding of the democratic basis of law, and there is still a legal view that takes law as a ruling tool in the traditional sense. For example, they also admit that "rule of law" opposes "rule of man", but influenced by the traditional concept of rule of man and some phenomena of "power is greater than law" in reality, they often think that law has only instrumental value but no objective value; They also admit that democracy opposes autocracy, but because of the actual national conditions in China, they often think that the legal system only exists in the democratic system, and there is no legal system under the authoritarian system. They don't realize that the legal system can be combined with autocracy and democracy, and only the legal model based on democracy can be called the real rule of law.
(2) Have perceptual legal consciousness, but lack rational legal consciousness.
Law itself is a highly rational subject. Without a certain basic theory of law, it is difficult to solve practical legal problems with theory. Most college students' understanding of law is still in the primary perceptual stage. It is precisely because of the lack of systematic study of legal theory that college students' legal consciousness is still in the enlightenment state of understanding the nature of law. For example, most students know that the constitution is the fundamental law of the country, but they know little about the basic spirit and content of the constitution. Modern countries ruled by law are generally constitutional countries. If we can't raise the constitution to the level of constitutionalism, we can't immediately think about the rights of citizens and the relationship between civil rights and state power when discussing the contents of the constitution, which is a manifestation of the lack of modern awareness of the rule of law and constitutionalism.
