Regulations on Road Transportation Administration of Qinghai Province (amended in 2011)
The road transport operations referred to in the preceding paragraph includes road passenger transport operations (hereinafter referred to as passenger transport operations) and road freight transport operations (hereinafter referred to as freight transport operations); road transport-related business including road transport station (field) operations, motor vehicle maintenance operations, motor vehicle driver training. Article 3 The provincial people's government traffic management department in charge of the province's road transport management, the people's governments above the county level traffic management department is responsible for organizing and leading the management of road transport in the administrative area.
The people's governments above the county level road transport management agencies (hereinafter referred to as transport management agencies) is responsible for the specific implementation of road transport management.
Public security, industrial and commercial administration, taxation, construction, price, quality and technical supervision, safety supervision and other relevant management departments in accordance with their respective responsibilities, to do a good job in road transportation management. Article IV road transport management shall follow the principles of fairness, justice, openness and convenience, to maintain a unified and open, fair competition, standardized and orderly road transport market order. Article 5 engaged in road transport and road transport-related business, should be operated in accordance with the law, honesty and trustworthiness, fair competition, to provide safe, convenient and high-quality services. Article 6 The traffic management department of the people's government at or above the county level shall, in conjunction with the relevant departments, according to the needs of the national economy and social development, formulate the road transport development plan for the administrative region, and report to the people's government at the current level for approval and implementation. Chapter II Road Transportation Operation Section 1 Passenger Transportation Article 7 The passenger transportation operation referred to in these regulations refers to the transportation of passengers by buses, road passenger transportation activities of a commercial nature, including shuttle buses (overtime buses) passenger transportation, chartered buses passenger transportation, cab passenger transportation and tourist passenger transportation.
It is prohibited for freight cars, tractors, cargo tricycles and other vehicles prohibited from carrying passengers to engage in passenger transportation. Article 8 An application for engaging in passenger transportation shall have the entry conditions stipulated in Article 8 of the Regulations of the People's Republic of China on Road Transportation of the People's Republic of China (hereinafter referred to as the "Road Transportation Regulations") and provide the following materials:
(1) application form for operating road passenger transportation;
(2) identification of the investor and the person in charge of the operation and their photocopies, and identification of the person in charge of the operation and their photocopies and the power of attorney. Enterprises shall submit the text of the articles of association and safety management system;
(3) the commitment letter of the vehicles to be put into operation;
(4) the driver's license and qualification certificate of the driver and its copy;
(5) the certificate of the traffic management department of public security organs that there is no traffic accident of more than a significant nature in the past three years;
(6) other materials stipulated by the laws and regulations. Other materials.
Applications to engage in the operation of passenger transportation, should also be submitted to the route, station program and the quality of transportation services commitment. Article 9 The application for engaging in passenger transportation shall be made in accordance with the following provisions:
(1) engaging in passenger transportation within the county-level administrative area, to the local transportation authority to apply;

(3) engaging in cross-provincial (c) engaged in inter-provincial passenger transportation business, to the provincial transportation management agency to submit an application. Article XI passenger transport operators need to replace or increase passenger vehicles, shall apply to the original licensing authority, the original licensing authority shall, within five days from receipt of the application to make a decision on the review of the vehicle in line with the provisions of the passenger transport management to be issued with a road transport license.
Passenger transport operators need to terminate the passenger transport operation, shall be terminated before the date of operation of thirty days to inform the original licensing authority in writing. Article XII of passenger lines to implement classification management, engaged in passenger transport operations, vehicle technical requirements, vehicle type level should be in line with the national road transport management industry regulations, the number of vehicles should be in line with the following provisions:
(a) the operation of a class, the second class of passenger lines of the operator shall own more than thirty-five operating buses;
(b) the operation of the third class of passenger lines of the operator shall be (b) the operator of the third category of passenger transportation routes shall own more than five operating buses;
(c) the operator of the fourth category of passenger transportation routes shall own more than one operating bus;
(d) the operator of the chartered passenger transportation shall own more than five operating buses. Article 13 The term of operation of passenger lines shall be from four to eight years.
After obtaining the operating permit, the operator of a passenger line shall provide continuous transportation services to the public and shall not suspend, terminate or transfer the line transportation without authorization.
The expiration of the term of operation needs to continue the passenger line operating license, shall be sixty days before the expiration of the term of operation in accordance with the provisions of Article 8 of these Regulations to reapply. Article XIV passenger transport operators apply for a road transport operation license, without justification for more than one hundred and eighty days without putting into operation or operation after more than one hundred and eighty consecutive days out of service, is considered to be automatically terminated by the original licensing authority cancellation of its business qualifications.
