Measures for the administration of waterway transportation in Ningxia Hui Autonomous Region

Chapter I General Provisions Article 1 In order to strengthen the management of waterway transportation, maintain the order of transportation and protect legitimate business operations, these Measures are formulated in accordance with the Regulations of People's Republic of China (PRC) Municipality on Transportation Management and combined with the actual situation of our region. Article 2 All units and individuals engaged in waterway passenger and cargo transportation (including tourism transportation, transit transportation and waterway transportation services) in the Yellow River and other waters in our region shall abide by these measures. Article 3 Waterway passenger and freight transportation (hereinafter referred to as waterway transportation) is divided into business transportation and non-business transportation.

Commercial transportation refers to passenger transportation and cargo transportation that serve the society in various ways.

Non-business transportation refers to transportation that serves the unit or itself and does not occur in various ways. Article 4 The Communications Department of the Autonomous Region is the competent department of waterway transportation in the whole region, the administrative office, city and county transportation (Gongjiao) bureaus (offices) are local waterway management departments, and transportation management stations at all levels are the supervision and inspection institutions of waterway transportation. Article 5 Waterway transportation shall, under the guidance of the state plan, implement diversified operations, protect fair competition and stop illegal operations. Chapter II Management of Business Opening Article 6 Units and individuals applying for waterway transportation must meet the following conditions:

(a) there are transport vessels suitable for its business scope, and they hold the ship inspection certificate issued by the ship inspection department, and the drivers and engineers should hold the valid job certificates issued by the ship inspection department;

(2) Having relatively stable customers and sources of goods within the prescribed business scope;

(III) Engaged in passenger transport, it shall declare the stops along the route, arrange and implement the safety service facilities necessary for ships to dock and passengers to get on and off the ship, and obtain a written certificate from the administrative office, city and county traffic (transportation) bureau (office);

(4) Having its own liquidity suitable for the transportation business;

(5) The transport ship must have a ship insurance certificate. Article 7 Units and individuals applying for engaging in commercial waterway transportation must go through the following examination and approval procedures:

(1) Units applying for engaging in commercial waterway transportation must hold the certificate of the competent department, and individuals applying for engaging in commercial waterway transportation must hold the certificate of the people's government at or above the township (town) where they are located. The local, city and county transportation (Gongjiao) bureaus shall, within 40 days from the day after receiving the application, issue a waterway transportation license to those who meet the requirements after examination, and give a clear answer to those who do not approve;

(two) the units and individuals that have obtained the license for waterway transportation shall apply for registration certificates to the local administrative department for industry and commerce and the tax department respectively, and obtain the business license and tax registration certificate;

(three) to hold the industrial and commercial and tax certificates to the original authority that issued the waterway transportation license, and obtain the single ship business transportation license. Article 8 The municipal and county transportation (Gongjiao) bureaus shall examine and approve the business scope of units and individuals that are allowed to engage in commercial waterway transportation according to their management level, transportation capacity, passenger and cargo supply, social transportation capacity and dynamic balance. Article 9 Units and individuals engaged in commercial waterway transportation that need to increase their transportation capacity or change their business scope shall apply to the original examination and approval authority for increasing their transportation capacity and changing their business scope. After receiving the application, the original examination and approval authority shall, upon examination and approval, replace the ship's business transportation certificate. The applicant units and individuals shall go through the change registration with the local administrative department for industry and commerce on the basis of the newly-issued Ship Business Transport Certificate. Need to change other major registered items, shall be handled in accordance with the provisions of the "Regulations" of People's Republic of China (PRC) Municipality on the administration of enterprise legal person registration. Tenth waterway transport units and individuals need to suspend business, should go through the cancellation procedures with the original examination and approval authority and the industrial and commercial administration and tax authorities. When it is necessary to move, the original head of household should go through the formalities of suspension of business, and the new head of household should go through the formalities of examination and approval and registration again. Chapter III Operation and Management Article 11 Units and individuals engaged in waterway transportation must abide by the Measures for the Administration of Water Traffic Safety in Ningxia Hui Autonomous Region and other relevant regulations. Twelfth units and individuals engaged in the business of passenger transport, must use ships that meet the specifications of passenger ships, and engage in transportation in accordance with the approved tonnage (quota), routes, stops and stops. Without approval, you are not allowed to set up a ferry at will. Overloading and adventure navigation are strictly prohibited. Article 13 Units and individuals engaged in commercial waterway transportation must uniformly use the waterway transport invoice stamped with the invoice producer seal of the tax authorities and the transitional ticket stamped with the special seal for waterway transportation tickets.

Waterway transport invoice and transit tickets are uniformly printed by the administrative office and the Municipal Transportation (Gongjiao) Bureau (Office) in accordance with the format formulated by the Autonomous Region Communications Department, and are uniformly managed and distributed by the county (city) Transportation Bureau and the traffic management station.

Without the approval of the Autonomous Region Communications Department and the Autonomous Region Taxation Bureau, no unit or individual may print or use other bills by itself. Fourteenth units and individuals that have obtained business licenses to engage in waterway transportation, their legitimate rights and interests are protected by state laws. No unit or individual may overcharge or apportion expenses. Article 15 Units and individuals engaged in commercial waterway transportation must collect transportation and miscellaneous fees according to the freight rates and rates set by the transportation department and the price department.

Transit freight rate of passengers, vehicles, goods, etc. By the city and county transportation (Gongjiao) Bureau in conjunction with the local price departments to develop; The long-distance freight rate and loading and unloading fee for waterway passenger and cargo shall be formulated by the Communications Department of the autonomous region jointly with the Price Bureau of the autonomous region.
