Measures of Hefei Municipality on the Administration of Outdoor Advertising

Chapter I General Provisions Article 1 In order to strengthen the supervision and management of outdoor advertising, protect the urban landscape, safeguard the legitimate rights and interests of advertising operators and ensure the personal and property safety of citizens, these Measures are formulated in accordance with the Advertising Law of People's Republic of China (PRC), the Regulations of the State Council on the Administration of City Appearance and Environmental Sanitation and other relevant laws and regulations. Article 2 engage in outdoor advertising activities in the urban areas and development zones of this municipality? The supervision and management of outdoor advertising activities shall abide by these measures.

Outdoor advertising settings as mentioned in these Measures? City construction, city planning, industry and commerce administration, public security and other departments shall, in accordance with the provisions of relevant laws, regulations and these measures, assist in the supervision and management of outdoor advertising. Chapter II General Provisions for the Establishment Article 5 The advertising establishment organ shall, jointly with the municipal planning, urban construction, public security, industrial and commercial administration departments and other departments, work out the outdoor advertising establishment plan for important areas and main roads in this Municipality in accordance with the principle of unified planning and total control, and announce it to the public after being approved by the Municipal People's Government.

The preparation of outdoor advertising planning for important areas and main roads in this city shall conform to the requirements of the overall urban planning, explicitly allow or prohibit the setting of outdoor advertising areas, streets and buildings, adapt to the function of urban regional planning, coordinate with the volume, shape and color of urban landscape, surrounding environment and buildings, and maintain the visual effect of urban streets. Chapter III Application and Approval Article 10 The right to set up outdoor advertisements shall be subject to the system of paid use. Advertising operators shall obtain the right to set up outdoor advertisements by using public places in important areas and main roads of this Municipality and municipal public facilities invested and built by the government.

The right to set up outdoor advertising shall be approved by the municipal administrative department of urban construction and the municipal administrative department of urban planning, and outdoor advertising facilities shall be built in a unified way according to the requirements of outdoor advertising planning, and transferred through public bidding, auction or other open competition. If the number of bidders is less than 3, it can be sold by agreement. Article 12 The competent advertising authority shall, within 15 working days from the date of accepting the application, review the supporting documents that the applicant should submit, review the design scheme and construction drawing of outdoor advertising facilities, and make a decision on approval or disapproval. The establishment of large-scale outdoor advertising and other outdoor advertising facilities shall be approved by the relevant departments. Before making a decision on approval, the advertising establishment authority shall solicit the opinions of the municipal urban planning administrative department and relevant departments. If approved, an outdoor advertising license shall be issued; If it is not approved, it shall notify the applicant in writing and explain the reasons.

The certification documents submitted by the applicant are complete, and the design scheme and construction drawing of outdoor advertising facilities conform to the outdoor advertising setting plan and the appearance technical standards stipulated in these Measures. Unless the Municipal People's Government decides to suspend the acceptance of the application for setting up or disapprove it based on the need of safeguarding public interests, the advertising setting authority shall make a decision of approval.
