Regulations of Jincheng Municipality on Village Planning and Construction

Chapter I General Provisions Article 1 These Regulations are formulated in accordance with the Land Administration Law of the People's Republic of China, the Urban and Rural Planning Law of People's Republic of China (PRC), the Regulations on Comprehensive Management of Urban and Rural Environment of Shanxi Province and other laws and regulations in order to standardize the planning and construction of villages in our city, improve the quality of rural living environment, promote the integrated development of urban and rural areas and promote the overall revitalization of rural areas. Article 2 These Regulations shall apply to activities such as village planning and construction outside the urban development boundary within the administrative area of this Municipality.

Where laws, administrative regulations and local regulations formulated by the people's Congress of this province and its Standing Committee have other provisions on scenic spots, villages in nature reserves and famous historical and cultural villages, those provisions shall prevail. Article 3 Village planning and construction shall respect the diversity and difference of village development, adhere to the principles of ecological priority, urban and rural planning, intensive utilization, safe layout, local conditions and historical inheritance, reasonably define the types of agglomeration and upgrading, suburban integration, characteristic protection, relocation and merger, and promote them in an orderly manner. Article 4 County (city, district) people's governments shall organize and lead village planning and construction, and study and solve contradictions and problems in village planning and construction.

City, county (city, district) people's government is responsible for coordinating agriculture and rural areas to promote village planning; The competent department of urban and rural planning shall supervise and guide the village planning within their respective administrative areas; The competent department of construction shall supervise and guide the construction of villages within their respective administrative areas.

The administrative examination and approval, development and reform, finance, public security, transportation, culture and tourism, water affairs, ecological environment, health, human resources and social security, education and other departments of the people's government shall, according to their respective responsibilities, do a good job in village planning and construction.

Township (town) people's governments (street offices) are responsible for the planning and construction of villages within their respective administrative areas.

Villagers' committees carry out village planning and construction under the guidance of township (town) people's governments (street offices). Article 5 County (city, district) people's governments shall organically link village planning, overall land use planning, main functional area planning and overall rural revitalization strategy planning, coordinate urban and rural infrastructure construction, carry forward traditional culture, tap natural resource endowments, protect rural historical features, develop characteristic industries, and build a civilized, livable and wealthy beautiful countryside. Article 6 The people's governments of cities and counties (cities, districts) shall include the funds for village planning in the financial budget.

City, county (city, district) people's governments should give full play to the guiding role of public finance funds, take measures such as incentives, subsidies and the introduction of social capital, support the construction, operation and maintenance of village infrastructure and public service facilities, and promote industrial development. Seventh any unit or individual has the right to report violations of laws and regulations in village planning and construction activities. Chapter II Village Planning Article 8 Villages within the scope of application of these Regulations shall prepare village plans. The scope of village planning is the whole national space of the village, which can be compiled by one or more administrative villages.

Before the entry into force of these regulations, the village planning approved according to law continues to be effective, and if it needs to be revised, it shall be handled in accordance with the provisions of these regulations. Ninth township (town) people's government (street offices) is responsible for the preparation of village planning within their respective administrative areas, and entrusted with the preparation of units with corresponding qualifications.

County (city, district) people's government shall, in combination with the actual situation of the village, organize the compilation of a general atlas of rural residents' housing that reflects the characteristics of local houses and meets the requirements of seismic fortification, and provide it to the villagers free of charge and promote its use.

People's governments at all levels and villagers' committees shall strengthen the publicity of village planning and guide villagers to participate in the preparation and construction of village planning. Tenth village planning planning period is generally fifteen years, counting from the date of planning approval. Eleventh village planning includes village planning and residential construction planning.

Village planning should define the development orientation, goal and scale, determine the village population scale and construction land scale according to the current situation of village development, make overall arrangements for various spaces such as ecology, production and life in the village, guide the agglomeration and transfer of rural industries, and promote the organic integration of mountains, water, forests, fields, lakes, grasses and villages.

Residential construction planning should be based on village planning, guide rural housing construction, reasonably arrange infrastructure such as roads, water supply, power supply, heat supply, gas supply, communication, greening, public lighting, domestic garbage, sewage treatment, and rural community public service facilities such as education, culture, sports, medical and health care, postal services, commercial outlets, and guide villagers to concentrate in the central village.

For characteristic ancient villages, traditional castle villages, characteristic landscape tourist villages and other characteristic villages, we should increase the protection, inheritance and utilization of the features of characteristic villages according to actual needs. Twelfth after the completion of the draft village planning, the township (town) people's government (street offices) shall make an announcement in the village public places, and the announcement time shall not be less than thirty days.

After the draft village plan is discussed and passed by the villagers' meeting or the villagers' representative meeting, it shall be submitted to the county (city, district) people's government for approval by the township (town) people's government (street office). Thirteenth approved village planning should be published in the village public places. The contents to be announced shall include: village construction planning, list of construction projects of the overall action plan for improving the living environment in villages, key points of village construction, and control rules for the implementation of village planning.
