Article 64? In violation of the provisions of this Law, if any of the following acts constitutes a crime, criminal responsibility shall be investigated according to law:

(1) stealing and excavating ancient cultural sites and ancient tombs;

(2) damaging or destroying precious cultural relics under the protection of the state intentionally or by negligence;

(3) unauthorized sale of cultural relics from the state-owned collection or giving them to a non-state-owned unit or an individual in private;

(4) Will be prohibited by the state out of the precious cultural relics privately sold or given to foreigners;

(e) profit-making purpose of selling cultural relics prohibited by the state;

(f) smuggling of cultural relics;

(g) theft, looting, private or illegal appropriation of state-owned cultural relics;

(h) should be held criminally liable for other acts of obstruction of cultural relics management.

Article 65? Violation of the provisions of this Law, resulting in the loss or destruction of cultural relics, shall bear civil liability in accordance with the law.

Violation of the provisions of this Law, constitutes a violation of public security management, the public security organs shall be given public security management punishment according to law.

Violation of the provisions of this Law, constitutes smuggling behavior, does not constitute a crime, by the Customs in accordance with relevant laws and administrative regulations shall be punished.
