Regulations of Yunnan Province on the Protection of Ethnic and Folk Traditional Cultures

Chapter I General Provisions Article 1 These Regulations are formulated in accordance with the Constitution and relevant laws and regulations, and in light of the actual situation of this province, in order to strengthen the protection of traditional ethnic and folk cultures and to inherit and carry forward excellent ethnic and cultural traditions. Article 2 The national and folk traditional culture protected by these Regulations refers to:

(1) the spoken and written languages of ethnic minorities;

(two) representative folk literature, poetry, drama, folk art, music, dance, painting, sculpture, etc. ;

(3) Festival celebrations with ethnic and folk characteristics, traditional culture and art, ethnic sports and folk entertainment activities, and civilized and healthy folk activities with research value;

(4) residence, clothing, utensils, appliances, etc. Reflecting the customs of production and life of all ethnic groups;

(five) representative buildings, facilities, signs and specific natural places with national and folk traditional cultural characteristics;

(6) Manuscripts, scrolls, classics, documents, genealogy, inscriptions, couplets and oral culture of academic, historical and artistic value;

(seven) the inheritors of folk traditional culture and their knowledge and skills;

(eight) traditional folk craft production technology and arts and crafts treasures;

(nine) other traditional ethnic and folk cultures that need to be protected. Article 3 The national and folk traditional cultural materials and objects identified as cultural relics listed in these Regulations shall be protected by the Cultural Relics Law of People's Republic of China (PRC). Article 4 The protection of ethnic and folk traditional culture shall follow the principle of "protection first, rescue first, government leading and social participation". Article 5 People's governments at all levels shall strengthen their leadership over the protection of ethnic and folk traditional cultures within their respective administrative areas, and incorporate them into the long-term and annual plans for national economic and social development in the region. Article 6 The cultural administrative department of the people's government at or above the county level shall be in charge of the protection of ethnic and folk traditional culture within its administrative area, and its duties are:

(a) to publicize and implement the laws, regulations, principles and policies of the state on the protection of ethnic and folk traditional culture;

(two) in conjunction with the relevant departments to formulate the work plan for the protection of national and folk traditional culture within their respective administrative areas, and organize their implementation;

(three) to guide and supervise the protection of national and folk traditional culture;

(four) the management of national folk traditional culture protection funds;

(five) to punish acts in violation of these regulations.

Ethnic affairs, education, tourism, planning, construction, news and other relevant departments shall, within the scope of their respective duties, assist the cultural administrative departments to do a good job in the protection of ethnic and folk traditional culture. Seventh organs, organizations, enterprises, institutions and citizens within the administrative area of this province have the responsibility and obligation to protect traditional folk culture. Eighth to encourage and support citizens of all ethnic groups to carry out healthy and beneficial traditional folk cultural activities.

To carry out ethnic and folk traditional cultural activities, we must abide by national laws and must not disturb public order, infringe upon citizens' legitimate rights and interests, or damage citizens' physical and mental health. Chapter II Protection and Rescue Article 9 The cultural administrative department of the people's government at or above the county level shall, jointly with the ethnic affairs department, organize a general survey, collection, collation and research of the ethnic and folk traditional culture in this area.

Encourage national cultural and artistic research institutions, other academic organizations, units and individuals to engage in the investigation, collection and research of national folk traditional culture. Protect research results and advocate resource sharing. Encourage exchanges and cooperation between ethnic and folk traditional cultures. Tenth people's governments at or above the county level and other relevant departments of cultural administration shall promptly organize the rescue of the disappearing ethnic and folk traditional culture with important value.

Engaged in the investigation and study of national folk traditional culture, we should pay attention to the protection and rescue of the original national folk traditional culture projects, so as to be accurate and scientific. Eleventh people's governments at all levels should pay attention to the cultivation of talents for the study of ethnic and folk traditional culture, and give full play to the role of cultural and art museums at all levels in collecting, collecting, researching and displaying ethnic and folk traditional culture in the region. Article 12 The relevant units shall sort out and file the collected important national and folk traditional cultural materials, and select and publish them as needed. Using advanced technologies such as electronic audio and video to preserve important national and folk traditional cultural materials and objects for a long time.

To collate and publish traditional folk cultural materials, we should respect national customs and maintain their original features. Thirteenth private and collective collections of national and folk traditional cultural materials, objects, etc., their ownership is protected by law.

When collecting materials and objects of national and folk traditional culture owned by individuals or collectives, they shall be reasonably priced according to the principle of voluntariness, and the collection department shall issue a certificate.

Encourage units and individuals with national and folk traditional cultural materials and objects to donate them to national collection and research institutions, and the recipients will be rewarded and awarded certificates according to the specific circumstances. Article 14 Overseas organizations and citizens who conduct academic investigation and research on ethnic and folk traditional culture within the administrative area of this province must be submitted to the provincial cultural administration or ethnic affairs and other relevant business departments for approval.

Without the approval of the cultural administrative department of the people's government at or above the county level and the consent of the owner of the materials and objects, photography, audio recording and video recording are not allowed.
