Measures of Jinan Municipality on the Administration of Taxi Freight Transportation

Article 1 In order to strengthen the management of taxi freight, maintain the order of the freight market and protect the legitimate rights and interests of transport operators and shippers, these Measures are formulated in accordance with the provisions of relevant laws and regulations and combined with the actual situation of this Municipality. Article 2 The term "taxi freight" as mentioned in these Measures refers to the transportation business activities in which road freight transport operators use small vans with rental business signs, which are temporarily rented by suppliers, and the freight is charged according to the time, mileage and prescribed rates. Article 3 These Measures shall apply to the units and individuals engaged in taxi transportation and related activities within the administrative area of this Municipality. Article 4 The municipal traffic administrative department is the competent department of taxi freight transportation in this Municipality, and the municipal road transport management institution to which it belongs shall perform specific management duties.

County (city), district traffic administrative departments and transportation management agencies shall be responsible for the taxi freight management within their respective jurisdictions in accordance with the prescribed responsibilities.

Planning, public security, industry and commerce, taxation, price, quality and technical supervision and other relevant government departments shall, in accordance with their respective responsibilities, cooperate with the traffic administrative departments to do a good job in taxi freight management. Article 5 The development of taxi freight should adapt to the market demand and urban traffic conditions. This Municipality implements the policy of correctly guiding, actively supporting, encouraging competition and standardizing management of taxi freight, and implements macro-control on its development scale. The development plan shall be formulated by the municipal traffic administrative department in conjunction with the planning, public security and other departments, approved by the municipal government, and announced to the public regularly every year. Article 6 To apply for the establishment of a taxi freight enterprise, a written application shall be submitted to the municipal road transport management institution, and preparations shall be made in accordance with the conditions stipulated in Article 7. The municipal road transport management institution shall conduct a review within fifteen days from the date of completion of the applicant's preparation, and issue the "People's Republic of China (PRC) Road Transport Business License" if it meets the requirements. Article 7 An enterprise engaged in taxi freight transportation shall meet the following conditions:

(a) have the ability to bear civil liability independently;

(two) there are more than 50 van freight cars, the approved load is less than 1 ton, and the cab is separated from the cargo compartment and meets the requirements of environmental protection;

(3) Having a fixed office space, funds suitable for the business scale and parking space;

(4) Having a vehicle information service network. Eighth approved to engage in taxi freight enterprises, its operating vehicles must meet the following conditions:

(a) the special license issued by the public security department;

(two) the installation of fixed special ceiling lamps supervised by the transportation department;

(3) installing a tax-controlled mileage meter approved by the tax department and verified by the quality and technical supervision department, and posting tariff labels in a prominent position;

(four) the uniform logo color and logo of the spraying enterprise;

(five) indicate the name of the enterprise, car rental telephone number and supervision telephone number;

(six) with the "People's Republic of China (PRC) Road Transport Certificate" issued by the municipal road transport management institution. Article 9 It is forbidden for any unit or individual to forge, forge, lend, transfer or illegally use the special signs and signs for freight taxis. Article 10 Units and individuals may organize vehicles that have been engaged in commercial cargo transportation before the implementation of these Measures, and set up taxi freight enterprises in accordance with the procedures stipulated in Article 6 and the conditions stipulated in Article 7, or they may join taxi freight enterprises with business qualifications after transforming vehicles in accordance with the relevant provisions of Article 7. Eleventh taxi freight enterprises shall charge according to the price and the taxi freight charging items and standards formulated by the traffic administrative department (the specific charging items and standards shall be announced separately by the traffic administrative department). Article 12 A taxi freight enterprise shall, according to the service standards of the industry, provide the shipper with services such as booking car rental, instant car rental, chartered car and other supporting handling services. Thirteenth freight taxi drivers shall meet the following conditions:

(1) Having a permanent residence or temporary residence permit in this Municipality;

(two) a motor vehicle driver's license issued by the public security department and more than one year's driving experience;

(3) Having passed the vocational training examination and obtained the post qualification of freight taxi driver. Fourteenth freight taxi drivers shall abide by the following provisions:

(1) Carrying the People's Republic of China (PRC) Road Transport Certificate and other relevant documents with the vehicle;

(two) according to the mileage meter shows the amount of charge (car charges according to the prescribed standards), and take the initiative to issue special invoices;

(three) according to the reasonable route or the route required by the owner;

(four) shall not engage in passenger business activities;

(five) without the consent of the owner, it is not allowed to solicit other people's goods to be transported together;

(six) the owner shall not take the lost items for himself;

(seven) the vehicle shall not be handed over to the personnel without the driving qualification of freight taxi to engage in freight business;

(eight) for the goods that are not escorted by the owner, the waybill shall be used for registration and handover;

(nine) shall not dominate the market, disorderly pull disorderly transport, disrupt the taxi freight order;

(ten) shall not carry articles and dangerous chemicals prohibited by the state. Fifteenth freight taxi driver in any of the following circumstances, the owner can refuse to pay the freight:

(1) Failing to use the mileage meter according to the regulations or not displaying the amount and charging standard according to the mileage meter;

(two) do not issue a special invoice for taxi freight;

(3) Within the initial mileage, the agreed service cannot be completed due to the driver or the vehicle;

(four) in the course of operation, the operation service is suspended without justifiable reasons.
