National Supervision of Internet Advertising

On April 8, 20 14, the state administration for industry and commerce, Publicity Department of the Communist Party of China, the state internet information office, the Ministry of industry and information technology, the state health planning commission, the state administration of press, publication, radio, film and television, the state food and drug administration of the United States and state administration of traditional chinese medicine held a teleconference, and decided to jointly launch a special campaign to rectify advertisements in key areas of the internet from April 10 to August 3 1 0.

According to Gan Lin, deputy director of the State Administration for Industry and Commerce, in recent years, the Internet has increasingly become an important channel for commodity producers and operators to place advertisements. At the same time, the problems of false illegal advertisements and false information on the Internet are constantly emerging, especially in the fields of health food, health products, medicines, medical devices and medical services. Since last year, the special campaign jointly launched by the State Administration for Industry and Commerce and other eight departments to rectify false and illegal medical advertisements has achieved initial results, and the illegal rate of traditional media advertisements has dropped significantly. However, some illegal medical advertisements began to turn to Internet media to seek new living space.

In response to these new situations and problems, the eight departments decided to jointly launch a nationwide special campaign to rectify advertisements in key areas of the Internet, focusing on health food, health products, medicines, medical devices and medical services, as well as websites set up by large portals, search engine websites, video websites, e-commerce websites, medical drug information service websites, pharmaceutical enterprises and medical institutions.

From April 20 14 to August 3/4, 20 14, SAIC, together with Publicity Department of the Communist Party of China, the State Information Office, the Ministry of Industry and Information Technology, the Health and Family Planning Commission, the State Administration of Press, Publication, Radio, Film and Television, the US Food and Drug Administration, the Chinese Medicine Bureau and other departments, organized and carried out a rectification of key areas of the Internet for nearly five months. The national industrial and commercial system inspected Internet websites169,000, monitored Internet advertisements16.5438+0.28 million, investigated and dealt with 5,232 cases of illegal Internet advertisements, fined 5,000 yuan10.57 million yuan, and severely punished the publishing of false and illegal Internet advertisements.

2015 March 15 cmnet advertising standard (hereinafter referred to as the standard) was formally implemented. This standard aims to guide and solve the problems of non-uniform advertising interface, nonstandard terminology, definitions and technical standards of mobile Internet, and promote the healthy and rapid development of mobile Internet advertising industry.

This standard includes three parts: the basic standard of Internet digital advertising, the monitoring standard of mobile Internet advertising and the docking standard of mobile system. It aims to guide and solve the problems of non-uniform interface of mobile Internet advertising and nonstandard terminology, definitions and technical standards, and promote the healthy and rapid development of mobile Internet advertising. And two unfinished chapters: mobile advertising effect evaluation standard and mobile Internet user information protection standard.

On the afternoon of April 24th, 20 15, the 14th meeting of the National People's Congress Standing Committee (NPCSC) voted to pass the third draft of the revised advertising law. Among the 75 new advertising laws, there are "five articles and eight places" that explicitly involve the Internet, including articles 19, 44, 45, 63 and 64. Among them, except for Articles 63 and 64, which are penalties for illegal Internet advertisements, the other three articles are all provisions regulating Internet advertisements. The voting draft adds provisions that those who use the Internet to publish advertisements without clearly indicating the closure sign to ensure one-click closure will be fined between 5,000 yuan and 30,000 yuan.
