Regulations of Nanyang Municipality on the Protection of Cultural Relics

Chapter I General Provisions Article 1 In order to strengthen the protection of cultural relics, inherit the excellent historical and cultural heritage and promote the excellent Chinese traditional culture, these Regulations are formulated in accordance with the Law of People's Republic of China (PRC) on the Protection of Cultural Relics and in light of the actual situation of this Municipality. Article 2 These Regulations shall apply to the protection of cultural relics and related activities within the administrative area of this Municipality. Article 3 The work of cultural relics shall adhere to the principles of giving priority to protection, giving priority to rescue, rational utilization and strengthening management, and follow the principles of territorial management and graded responsibility. Article 4 The people's governments at all levels in this Municipality shall be responsible for the protection of cultural relics within their respective administrative areas.

The administrative departments of cultural relics of the people's governments of cities and counties (cities, districts) shall supervise and manage the protection of cultural relics within their respective administrative areas.

Other relevant administrative departments of the people's governments of cities and counties (cities, districts) shall do a good job in the protection of cultural relics in accordance with their respective duties. Article 5 The people's governments of cities and counties (cities, districts) shall establish a linkage working mechanism composed of administrative departments such as cultural relics, public security, emergency management, market supervision and customs, and strengthen the protection of cultural relics.

City, county (city, district) cultural relics protection management committee is composed of cultural relics, public security, natural resources and planning, development and reform, ethnic and religious administrative departments, responsible for coordinating and solving major problems in cultural relics protection.

The Municipal Cultural Relics Protection Management Committee has established a cultural relics protection expert database. The expert database is composed of professionals in cultural relics, history, culture, art, science, education, planning, architecture and law, and provides decision-making consultation for the protection of cultural relics in this city. Article 6 The people's governments of cities and counties (cities, districts) shall incorporate the cause of cultural relics protection into the national economic and social development plan, and include the required funds in the fiscal budget at the corresponding level, and gradually increase the funds for cultural relics protection according to the needs of development.

Cultural relics protection funds are used for the following expenditures:

(a) archaeological investigation, exploration and excavation of cultural relics funded by the people's government;

(two) the repair and maintenance of state-owned immovable cultural relics;

(three) non-state-owned immovable cultural relics maintenance subsidies;

(4) Open museums free of charge and provide subsidies for maintaining their collections;

(five) cultural relics research and publicity and education;

(six) reward units or individuals that have made remarkable achievements and contributions in the protection of cultural relics;

(seven) other expenses for the protection of cultural relics. Article 7 The people's governments of cities and counties (cities, districts) shall establish an information sharing mechanism for cultural relics protection.

The administrative department of cultural relics shall establish a database of cultural relics information and update it in time. Eighth cultural relics administrative departments to implement supervision and inspection can take the following measures, the relevant units and individuals shall cooperate:

(1) Entering the site;

(two) shall be ordered to stop the illegal act;

(3) consulting and copying relevant documents and materials;

(four) ask the main person in charge of the inspected unit and the relevant personnel;

(5) Other measures stipulated by laws and regulations. Chapter II Immovable Cultural Relics Article 9 The municipal and county (city, district) cultural relics administrative departments, natural resources and planning departments, and housing and urban-rural construction departments shall include immovable cultural relics within their respective administrative areas, as well as agricultural heritage, industrial heritage, time-honored commercial brands, traditional villages, revolutionary cultural relics, historical and cultural blocks, villages and towns, etc. It has high historical and cultural value and distinctive regional characteristics, and protective measures are formulated. Tenth city and county (city, district) people's governments shall focus on the protection of the following immovable cultural relics, and the specific protection measures shall be formulated and promulgated by the administrative department of cultural relics:

(1) Large cultural sites such as Xinghua Mountain, Xiaokongshan Site, Huangshan Site, Baliqiao Site, Baligang Site, Taizigang Site, Wafangzhuang Smelting Site and Dengyao Site;

(2) Wuhou Temple, Nanyang Zhifu Yamen, neixiang county Ya, Sheqi Shanshan Guild Hall and ancient buildings such as Porcelain Street, Jingziguan, Ivory Temple, Bordet Ji, Temple, Sizhou Temple Tower and Temple Tower;

(3) Ancient tombs of historical and cultural celebrities such as Zhang Heng's Tomb, Zhang Zhongjing's Tomb and Zhang Shizhi's Tomb;

(4) Rock paintings in Nanyang area, such as Fangcheng County, tanghe county, Yahe Industrial Zone, and Buddha Gully Cliff Statues in Fangcheng County;

(5) Revolutionary cultural relics of great significance, such as the former site of the Central Hubei-Henan-Anhui Border Region Provincial Party Committee, the memorial site of the Battle of the Red 25th Army, the birthplace of the July 7th Working Group, the former residence of Peng Xuefeng, and the former site of the meeting of senior cadres of the Central Plains Field Army;

(6) Other immovable cultural relics that need special protection.

The people's governments of neixiang county, Xixia and Xichuan counties and their constituent departments shall strengthen the protection of unearthed dinosaur eggs and their burial areas. Eleventh relevant departments to perform the following duties, involving immovable cultural relics, shall solicit the opinions of the administrative department of cultural relics at the same level:

(1) Organizing the formulation of national spatial planning;

(two) to determine the scope of the transformation of the old city and shanty towns;

(3) Expropriation and removal of houses and other facilities;

(4) Land reserve and transfer;

(5) Other circumstances stipulated by laws and regulations. Twelfth persons responsible for the protection and management of immovable cultural relics shall be determined in accordance with the following provisions:

(a) the immovable cultural relics are owned by the state, and the users are responsible for the protection and management;

(two) the immovable cultural relics do not belong to the state, and the owner is the person responsible for the protection and management;

(3) State-owned immovable cultural relics without users and non-state-owned immovable cultural relics with unknown owners shall be determined by the local county (city, district) people's government.

The person responsible for the protection and management of state-owned immovable cultural relics shall sign a responsibility book for cultural relics protection with the cultural relics administrative department of the city or county (city or district). If the person responsible for protection and management changes, it shall report to the administrative department of cultural relics in writing within 30 days from the date of change, and re-sign the protection responsibility letter.
