Chapter I General Provisions Article 1 In order to standardize the operation and management of road transport, maintain the market order of road transport, ensure the safety of road transport, protect the legitimate rights and interests of road transport parties and promote the development of road transport, these Regulations are formulated in accordance with the relevant provisions of laws and administrative regulations and in light of the actual situation of this province. Article 2 Those who engage in road transport business, taxi passenger transport business and road transport-related business within the administrative region of this province shall abide by these regulations.

The road transport business mentioned in the preceding paragraph includes road passenger transport business (hereinafter referred to as passenger transport business) and road cargo transport business (hereinafter referred to as freight transport business); Road transport related businesses include station operation, motor vehicle maintenance operation, motor vehicle driver training, motor vehicle comprehensive performance testing, car rental, loading and unloading, road transport agency, freight stowage information service, warehousing and tally, and commercial vehicle delivery. Article 3 The transportation departments of the people's governments at or above the county level shall be responsible for organizing and leading the management of road transportation within their respective administrative areas.

Road transport management institutions at or above the county level (hereinafter referred to as transport management institutions) are responsible for the specific implementation of road transport management.

Public security, market supervision and management, construction, price, emergency management, finance and other departments, according to their respective responsibilities, do a good job in road transport management. Article 4 The people's governments at or above the county level shall, according to the needs of national economic and social development, formulate the road transport development plan in their respective administrative areas, and link it with the relevant urban planning and the road transport development plan at higher levels. Road transport development planning shall be compiled by the transportation department in conjunction with relevant departments and implemented after approval by the people's government at the same level. Fifth people's governments at all levels and their relevant departments should actively create conditions to develop rural road transport, improve the opening rate of passenger buses in towns and administrative villages, and promote the coordinated development of urban and rural road transport.

The transportation, public security, market supervision and management, price, finance, taxation and other departments of the people's governments at or above the county level shall take measures to support and support rural road transportation and ensure the smooth green passage of agricultural and sideline products transportation; The competent department of transportation and its transportation management institution shall give key help to the professional training of rural road transport practitioners. Article 6 Road transport management shall follow the principles of fairness, justice, openness and convenience, break regional blockades and monopolies, establish and improve a unified, open, competitive and orderly road transport market, and meet people's needs in life and production.

Encourage scientific and technological progress in road transport, promote road transport informatization, and guide road transport enterprises to implement large-scale and intensive management.

The people's governments at or above the county level and their public security and transportation departments shall strengthen the publicity and education of road transport safety production, inspect and supervise the implementation of the responsibility system for safety production, and improve the standardization level of road transport safety production. Seventh operators should have the conditions for safe production stipulated by laws, regulations, national standards and industry standards, and implement the safety production management system; Those who do not have the conditions for safe production or the safety production management system is not implemented shall not engage in road transport business activities.

Operators shall regularly maintain the vehicles, machines, facilities and equipment in the station, and conduct regular inspections and inspections to ensure their normal operation.

Operators should operate according to law, be honest and trustworthy, improve service conditions and means, and provide customers with safe, timely and high-quality services. Article 8 Operators engaged in road transport operations and road transport-related businesses (hereinafter referred to as operators) shall engage in business activities in accordance with the approved scope, projects and regions, abide by relevant management regulations and clearly mark their prices.

Where an operator suspends business, goes out of business, merges or divides, or moves its business premises, changes its business scope and projects, or transfers the ownership of operating vehicles, it shall go through relevant formalities at the original licensing or filing authority according to law. Where an operator terminates its business, it shall handle the aftermath in accordance with the law and hand over the relevant license documents to the transportation management agency that made the license decision. Ninth traffic accidents, natural disasters and other emergencies, need to undertake emergency transportation tasks, operators should obey the unified dispatch and command of the people's governments at or above the county level and their transportation, public security and other competent departments. The expenses incurred in undertaking emergency transportation tasks shall be reasonably compensated by the actual user of the vehicle or the corresponding people's government. Chapter II Road Transport Operation and Taxi Passenger Transport Operation Article 10 Whoever engages in passenger transport and freight transport operations shall obtain a road transport business license and a business license according to law. Where a road transport business license is granted, the transport management institution shall issue a road transport license to the vehicles put into transport by the applicant.

After obtaining the road transport business license, the passenger transport operator shall continue to provide transport services to the public, and shall not suspend, terminate or transfer the line transport without authorization.

Urban public transport operators engaged in cross-urban and expressway passenger transport business shall obtain corresponding passenger transport business licenses according to law. Eleventh transportation management agencies can make a decision on the passenger transport business license through the service quality bidding, and shall make a decision through the bidding. Operators who have obtained licenses through service quality bidding shall provide services according to the promised service contents, standards and prices.

Transport management agencies can operate passenger lines in remote areas through joint bidding of trunk lines and feeder lines.

To apply for engaging in rural passenger transport business, the road that passes through meets the safe traffic conditions, and the vehicles and personnel meet the statutory conditions, the transportation management institution shall grant permission.

Engaged in rural passenger transport business, with the consent of the licensing authority, can take regional operation, circular operation and other ways to operate.
