The Four Basic Characteristics of Law

Law has six main characteristics:

1. Universality

Valid for all within sovereignty, whereas religious norms are valid only for specific groups of people.

Everyone is equal before the law.

Law does not impose itself, and its content is consistent with the universal requirements of mankind.

2, the national will

Law is the state formulated or recognized by the social norms, including statutory law and customary law, with the national will.

And morality, religion, and custom do not have national volition.

3, the state mandatory and procedural

Law is a social norm backed by state coercion, through the legal process to ensure the realization.

Any norms have coercive force, the special nature of the law is to have state coercive force.

The procedural nature of law is an important feature that distinguishes law from other social norms.

4, rights and obligations

Law is a social norm with the content of rights and obligations.

And morality and religion tend to emphasize only obligations.

Rights and obligations have consistency.

5, normative

Law is a social norm that regulates human behavior.

Adjustment of the relationship between man and man, while technical norms adjust the relationship between man and nature.

Characteristics of norms: repeated application for unspecified subjects (universally binding).

6, justiciable

Law is a justiciable system of norms, with justiciable.

Legal basis

Article 5 of the Constitution of the People's Republic of China*** and the State The People's Republic of China*** and the State practises the rule of law and builds a socialist state governed by the rule of law. The State upholds the unity and dignity of the socialist legal system. All laws, administrative regulations and local regulations shall not contravene the Constitution. All State organs and armed forces, political parties and social groups, and enterprises and organizations must abide by the Constitution and the law. All violations of the Constitution and laws must be prosecuted. No organization or individual may have privileges beyond the Constitution and the law.
