Regulations on the Protection of Intangible Cultural Heritage in Guizhou Province
(1) traditional oral literature and the language used as its vehicle;
(2) traditional fine arts, calligraphy, music, dance, drama, operatic art and acrobatics;
(3) traditional performing arts, medicine and calendars;
(4) traditional rituals, festivals and other folklore;
(5) traditional sports and amusement games;
(vi) other intangible cultural heritage.
The relevant provisions of the Law of the People's Republic of China on the Protection of Cultural Relics shall apply to objects and places that are part of the intangible cultural heritage and that are cultural relics. Article 4 of the intangible cultural heritage to implement the protection of the main, rescue first, rational utilization, inheritance and development of the policy, adhere to the principle of authenticity and integrity. Article 5 The people's governments at or above the county level shall formulate plans for the protection of the intangible cultural heritage, incorporate the protection of the intangible cultural heritage into the national economic and social development plan, and include the necessary funds for protection in the financial budget at this level. Article 6 The competent department of culture of the people's governments at or above the county level is responsible for the protection and management of intangible cultural heritage in the administrative region.
The relevant departments of the people's governments at or above the county level are responsible for the protection and management of intangible cultural heritage in accordance with their respective duties.
Township people's governments and street offices (communities), in conjunction with the competent departments of culture of the people's governments at the county level, are responsible for the protection of intangible cultural heritage.
Village (neighborhood) people's committees to assist the local people's government to do a good job of protecting intangible cultural heritage, the competent department of culture shall give guidance and support. Article 7 The people's governments at or above the county level and the relevant departments shall support the protection of intangible cultural heritage in ethnic areas in terms of funds and projects. Article 8 units and individuals are encouraged to set up funds for the protection of intangible cultural heritage through donations and other means in accordance with the law, specifically for the protection of intangible cultural heritage.
No unit or individual shall appropriate or misappropriate funds for the safeguarding of intangible cultural heritage. Chapter II Investigation of Intangible Cultural Heritage Article 9 The people's governments at or above the county level are responsible for organizing censuses and investigations of the intangible cultural heritage, and the competent departments in charge of culture shall carry out the specific implementation, and the intangible cultural heritage shall be identified, recorded, and archives and databases shall be established.
Units and individuals shall conduct investigations of intangible cultural heritage under the management of the competent cultural department of the people's government where the investigations are conducted in accordance with law. Article 10 The People's Republic of China *** and organizations or individuals outside the country in the province for the investigation of intangible cultural heritage, shall submit an application to the competent department of culture of the provincial people's government, setting out the content of the investigation, the object, the time, the location, the investigation organization or personnel and other circumstances; the competent department of culture of the provincial people's government shall, from the acceptance of the application, make a written decision on whether or not to approve the application within 15 days; the applicant who has obtained the approval shall send the Approval documents sent to the competent cultural department of the people's government at the county level where the investigation is conducted before the investigation activities.
Organizations outside the People's Republic of China*** and the People's Republic of China conducting investigations of intangible cultural heritage in the Province shall do so in cooperation with academic research institutions of intangible cultural heritage within the territory. Article 11 When conducting investigations, surveys, interviews and collection of objects of intangible cultural heritage, they shall obtain the consent of the subject of investigation, respect national customs, beliefs and habits, respect the authenticity and integrity, shall not be distorted or abused, and shall not unlawfully take possession of or damage the information and objects of intangible cultural heritage, or infringe upon the lawful rights and interests of the subject of investigation. Article 12 For intangible cultural heritage items on the verge of disappearing, the competent departments of culture under the people's governments at the county level shall promptly record and collect the relevant physical objects, and immediately take rescue protection measures.
The competent department of culture of the people's governments at or above the county level for the donation of intangible cultural heritage related materials and physical units and individuals shall be rewarded. Chapter III List of Representative Items of Intangible Cultural Heritage Article 14 The people's governments at or above the county level shall establish a list of representative items of intangible cultural heritage at their respective levels, and include in the list intangible cultural heritage embodying excellent traditional culture and having historical, literary, artistic and scientific values for protection.
The competent departments of culture of the people's governments at or above the county level shall formulate plans for the safeguarding of representative items of intangible cultural heritage in the administrative regions and organize their implementation. Article 15 The competent departments of the people's governments at or above the county level shall establish a representative items of intangible cultural heritage expert review system. Article 16 Units and individuals may apply to the competent department of culture of the people's government of the place where they are located for inclusion in the list of representative items of intangible cultural heritage.
Units and individuals who believe that a particular intangible cultural heritage embodies excellent traditional culture and has historical, literary, artistic or scientific value may submit a proposal for inclusion in the Representative Items List of Intangible Cultural Heritage to the people's governments at or above the county level or to the competent departments of culture.
Units and individuals are encouraged to provide clues of intangible cultural heritage to the competent authorities of the people's governments at or above the county level.
