Measures for the Administration of Rural Highway Construction and Maintenance in Shaanxi Province

Article 1 In order to meet the needs of rural economic and social development and strengthen the construction, maintenance and management of rural roads, these Measures are formulated in accordance with the National Highway Law of the People's Republic of China and other relevant laws and regulations, combined with the actual situation of this province. Article 2 These Measures shall apply to the construction, maintenance and management of rural roads within the administrative area of this province. Article 3 The rural roads mentioned in these Measures refer to county roads, township roads and village roads.

County road refers to the road connecting the seat of the county-level people's government with the seat of the township-level people's government, the main commodity production distribution center, and the county road that does not belong to the national highway or provincial highway.

Township road refers to the road connecting the seat of the township people's government with the established village, and the road connecting the township with the outside world that does not belong to the county road.

Village roads refer to roads that serve the production and life of rural residents and connect established villages and residential areas, and do not belong to county roads or township roads. Article 4 The construction, maintenance and management of rural roads shall follow the principles of unified leadership, overall planning, graded responsibility, classified guidance, simultaneous construction and maintenance, and smooth coordination. Article 5 People's governments at or above the county level shall strengthen their leadership over rural highway work, take effective measures to raise funds for construction and maintenance, coordinate and solve related problems, and support and promote the development of rural highways.

The transportation departments of the people's governments at or above the county level shall be responsible for guiding and supervising the construction, maintenance and management of rural roads. Article 6 The transportation department of the people's government at the county level shall be responsible for the construction of county roads and guide the construction, maintenance and management of township roads and village roads; The highway management organization to which it belongs is responsible for the maintenance and management of county roads.

Township people's governments are responsible for the construction and maintenance of township roads and guide the construction and maintenance of village roads.

The villagers' committee is responsible for the construction, maintenance and management of village roads. Seventh rural highway planning should be compiled according to the needs of local economic and social development, and coordinated with national and provincial highway planning, combined with local land and resources development and urban construction.

County road planning shall be compiled by the transportation department of the people's government at the county level jointly with the relevant departments at the same level, and shall be submitted to the municipal people's government with districts for approval after being audited by the people's government at the county level, and shall be submitted to the transportation department of the provincial people's government for the record. Township road planning shall be prepared by the transportation department of the people's government at the county level to assist the people's government at the township level, approved by the people's government at the county level, and reported to the transportation department of the municipal people's government with districts for the record. Village roads shall be compiled by the people's governments at the township level and reported to the transportation departments of the people's governments at the county level for the record.

The transportation department of the people's government at a higher level may, according to the highway development plan at the same level and combined with the actual needs, adjust the planning of county roads, township roads and village roads for the record to ensure the connection of highway networks between different regions.

If the approved rural highway planning really needs to be revised, the original compiling organ shall propose a revision plan and report it to the original approving organ for approval. Eighth rural highway construction should be adapted to local conditions, according to our capabilities, saving land, protecting the environment, ensuring quality and paying attention to safety. New construction and reconstruction of county roads shall meet the standards of secondary and tertiary roads; Township roads are standard of Grade III and IV highways; Village roads are Grade IV or lower than Grade IV highway standards.

The construction of county roads and township roads shall be approved in accordance with the basic construction procedures stipulated by the state and relevant regulations.

County road and township road construction projects should implement the project legal person responsibility system, bidding system, contract management system and project supervision system. Article 9 The construction projects of county roads and township roads above Grade III shall be designed in accordance with the Measures for Compilation of Design Documents of Highway Engineering Capital Construction Projects and the Measures for Compilation of Budget Estimates and Budgets of Highway Engineering Capital Construction Projects issued by the Ministry of Transport of the State Council, and other county roads and township roads shall be designed in accordance with the Relevant Provisions on Rural Highway Construction issued by the Ministry of Transport of the State Council.

The engineering design of county roads, independent bridges and medium-long tunnels above the second level shall be examined and approved by the transportation department of the provincial people's government or the highway management institution entrusted by it; Other county roads and township roads shall be examined and approved by the transportation departments of the people's governments of districts and cities; Village roads shall be examined and approved by the transportation department of the people's government at the county level.

Changes in the design of county roads, township roads and village roads shall be reported to the original examination and approval authority for approval. Tenth rural highway construction should make full use of old roads, existing bridges and tunnels, and reduce the demolition of ground buildings, structures and underground pipelines, cables and other facilities. If it is really necessary to newly occupy cultivated land in the construction of county roads and township roads, and dismantle buildings and structures on the ground, underground pipelines, cables and other facilities, the local people's governments at the county or township level shall be responsible for coordinating and solving them according to law. The land needed for the construction of village roads shall be coordinated and solved by the villagers' committee.

Rural highway construction should improve the protection, drainage and safety facilities and signs. Conditional should set up passenger stations and health service facilities. Eleventh rural highway construction projects should set up a technical person in charge, and establish a responsibility system for project quality and safety production.

The quality supervision of rural highway construction projects shall be the responsibility of the transportation department of the people's government at the county level and its subordinate engineering quality supervision institutions. Twelfth rural highway construction projects shall be completed and accepted by the transportation departments of the people's governments at or above the county level in accordance with the relevant provisions of the state. Thirteenth rural highway maintenance management should be based on different technical levels and different pavement requirements, the implementation of professional maintenance and mass maintenance, perennial maintenance and seasonal maintenance, the implementation of maintenance bidding, maintenance contracting, maintenance contracting and other systems.

If the system of maintenance bidding, maintenance contracting and maintenance contract is not implemented, the highway management organization affiliated to the transportation department of the people's government at the county level shall be responsible for the maintenance and management of county roads, and the maintenance and management personnel shall be equipped according to the standards of 10 to 1 5km and1person. Township roads should be maintained and managed by full-time or part-time personnel. Township roads with large traffic volume or rural roads in remote areas shall establish or entrust special maintenance organizations to undertake maintenance management. Village roads are maintained and managed by villagers' committees.
