Relevant regulations on legal holidays
● The first category
According to Article 2 of National Statutory Holidays and Remembrances, New Year's Day is 1 day (every year 1 day), Spring Festival lasts for 3 days (the first, second and third days of the first lunar month), Tomb-Sweeping Day is 1 day (Tomb-Sweeping Day in the Lunar New Year), and Labor Day lasts for 65,438 days.
Mid-Autumn Festival, Spring Festival, Tomb-Sweeping Day and Dragon Boat Festival are also called the four traditional festivals in China. Since 2008, Mid-Autumn Festival has been listed as a national statutory holiday. In February 65438+April 2007, the newly revised National Holidays and Remembrance Days officially listed Qingming Festival, Dragon Boat Festival and Mid-Autumn Festival as national statutory holidays. Since 2008, there are seven national holidays, namely New Year's Day, Spring Festival, Qingming Festival, Dragon Boat Festival, Labor Day and Mid-Autumn Festival. Local festivals, traditional festivals of ethnic minorities and festivals of other specific groups are limited to specific groups or local areas.
● The second category
In addition to all citizens' holidays, there is a second kind of holidays and anniversaries for some citizens, including: Women's Day (half a day off for women on March 8th), Youth Day (half a day off for young people over 28 on May 4th) and Children's Day (half a day off for children under June 6th).
● The third category
It is a festival for ethnic minorities, and the local people's governments in areas where ethnic minorities live in concentrated communities should determine the date of the festival according to the habits of ethnic minorities. The employing unit shall also arrange for workers to take vacations on holidays other than the statutory holidays of all citizens.
How to calculate the statutory holiday salary?
Article 44 of the Labor Law stipulates that under any of the following circumstances, the employing unit shall pay wages higher than the wages of workers during normal working hours according to the following standards:
(1) If the laborer is arranged to work longer hours, he shall be paid no less than 150% of the salary;
(2) If workers are arranged to work on rest days but cannot be arranged for compensatory time off, they shall be paid a salary of not less than 200% of their wages;
(3) If workers are arranged to work on legal holidays, they shall be paid no less than 300% of their wages.
Therefore, for workers who implement the standard working hours system, if they work overtime on legal holidays such as May 1st, the overtime pay shall be no less than 3 times of the daily wage base, and if they work overtime on May 2nd and 3rd, they shall be paid 2 times of the overtime pay standard on public holidays.
The calculation method of daily wage base is: monthly wage divided by paid days in a month. The adjusted paid days in China this year are 2 1.75 days.
Take an employee in 500 yuan with an agreed monthly salary of1.as an example, his daily overtime base is 1.500 yuan divided by 2 1.75 days, that is, 69 yuan; If the enterprise arranges for him to work overtime on May 1 day, it shall pay him overtime pay not less than three times that of 69 yuan, that is, 207 yuan.
For overtime work on May 2, the unit must first arrange compensatory time off, otherwise it must pay twice the daily wage base.
In addition, with the approval of the labor and social security department, the employer can independently arrange work and rest hours on the premise of clarifying the workload, and the employer can not pay overtime wages.
★ Overtime payment calculation formula:
Triple daily wage = calculation base of overtime wage ÷2 1.75×300%.
Double daily wage = calculation base of overtime wage ÷2 1.75×200%
Overtime per hour = overtime per day ÷8
Formula description:
1 and 2 1.75 days are the monthly average paid days.
2. The calculation base of overtime pay is the normal attendance monthly salary corresponding to the employee's post, excluding the salary paid under special circumstances such as year-end bonus, commuting allowance, working meal allowance, housing allowance, night shift allowance, summer high temperature allowance and overtime pay.
