Contents of Retail Pharmacy in the New Drug Administration Law

Legal analysis: The new version of the Drug Administration Law was officially implemented, and the new drug administrative penalty discretion benchmark was introduced, and retail pharmacies also ushered in the most severe punishment in history. Moreover, the announcement also requires that drug regulatory authorities at all levels should resolutely implement the "four strictest" requirements for drug safety, strengthen the publicity and implementation of the newly revised Drug Administration Law, further strengthen supervision and inspection, urge enterprises to continue to comply with production and operation, severely investigate and deal with all kinds of violations of laws and regulations according to law, and effectively safeguard the drug safety of the broad masses of the people. According to the above requirements, this also means that from today, once retail pharmacies violate the law, they can be investigated and dealt with according to the new version of the Drug Administration Law.

Article 34 The holder of the drug marketing license may sell the drugs that have obtained the Drug Registration Certificate by himself or entrust a drug trading enterprise to sell them. The holder of the Drug Marketing License shall obtain the Drug Business License when engaging in drug retail activities.

The holder of the drug marketing license who sells drugs on his own shall meet the conditions stipulated in Article 52 of this Law; If sales are entrusted, it shall be entrusted to a qualified pharmaceutical trading enterprise for sales. The holder of the drug marketing license and the entrusted enterprise shall sign an entrustment agreement and strictly fulfill the obligations stipulated in the agreement.

Article 51 Anyone who engages in pharmaceutical wholesale activities shall obtain the Pharmaceutical Trade License with the approval of the pharmaceutical supervisory and administrative departments of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government. To engage in pharmaceutical retail activities, it shall be approved by the pharmaceutical supervisory and administrative department of the local people's government at or above the county level and obtain the Pharmaceutical Business License. Without a Drug Business License, no drug business is allowed.

The Drug Business License shall indicate the validity period and business scope, and shall be re-examined and issued upon expiration.

The pharmaceutical supervisory and administrative department shall, in implementing the drug business license, not only meet the conditions stipulated in Article 52 of this Law, but also follow the principle of facilitating the people to buy drugs.

Article 58 A pharmaceutical trading enterprise shall accurately retail drugs, and correctly explain the usage, dosage and precautions; The prescription shall be checked, and the drugs listed in the prescription shall not be changed or replaced without authorization. Prescriptions with incompatibility or overdose should be refused to be prepared; When necessary, it can be prepared only after being corrected or re-signed by the prescriber.

When selling Chinese herbal medicines, pharmaceutical trading enterprises shall indicate the place of origin.

Pharmacists or other qualified pharmaceutical technicians are responsible for drug management, prescription review and allocation, and rational drug use guidance of the enterprise.
