Regulations of Sichuan Province on the Protection of Ancient and Famous Trees

Chapter I General Provisions Article 1 In order to protect ancient and famous trees, make rational use of ancient and famous tree resources, inherit history and culture, and promote the construction of ecological civilization and the coordinated development of economy and society, these Regulations are formulated in accordance with the Forest Law of People's Republic of China (PRC), the Regulations on Urban Greening and other laws and regulations, combined with the actual situation in Sichuan Province. Article 2 These Regulations shall apply to the protection and management activities of ancient and famous trees distributed outside the virgin forests within the administrative area of Sichuan Province, which have been legally recognized and published.

The ancient trees mentioned in the preceding paragraph refer to trees that are more than 100 years old. The famous trees mentioned in the preceding paragraph refer to trees with important historical, cultural, ornamental and scientific research value or important commemorative significance. Article 3 The protection of ancient and famous trees adheres to the principles of government leading, social participation, territorial management, in-situ protection and scientific management and protection. Article 4 The local people's governments at or above the county level shall strengthen their leadership over the protection and management of ancient and famous trees within their administrative areas, incorporate the protection of ancient and famous trees into the national spatial planning, and include the funds for investigation, identification, rescue, conservation, publicity and scientific research of ancient and famous trees in the fiscal budget at the corresponding level. Fifth local greening committees at or above the county level shall organize and coordinate the protection and management of ancient and famous trees within their respective administrative areas.

The competent departments of forestry, grass and urban landscaping of local people's governments at or above the county level (hereinafter referred to as the competent departments of ancient and famous trees) shall be responsible for the protection and management of ancient and famous trees within their respective administrative areas in accordance with the division of responsibilities.

Relevant departments of local people's governments at or above the county level, such as public security, finance, natural resources, ecological environment, agriculture and rural areas, water conservancy, transportation, cultural tourism, cultural relics, ethnic minorities and religions, shall do a good job in the protection and management of ancient and famous trees within the scope of their duties.

Township (town) people's governments and sub-district offices shall assist the departments in charge of ancient and famous trees to do a good job in the protection and management of ancient and famous trees within their respective administrative areas. Article 6 The local people's governments at or above the county level and their relevant departments shall strengthen publicity and education on the protection of ancient and famous trees, make use of local folk customs and traditional festivals, organize activities that are convenient for the public to participate widely, and enhance the awareness of the whole society on the protection of ancient and famous trees. Seventh local people's governments at or above the county level and their relevant departments shall support the scientific protection of ancient and famous trees, strengthen the protection of genetic resources of ancient and famous trees, popularize and apply scientific research results, and improve the level of protection and management. Eighth units and individuals are encouraged to participate in the protection of ancient and famous trees in the form of donation and adoption. Units and individuals who donate and adopt ancient and famous trees can enjoy the rights of signing contracts for a certain period of time, voluntary tree planting due diligence certification and so on.

Local people's governments at or above the county level may, in accordance with the relevant provisions of the state, commend units and individuals that have made remarkable achievements in the protection of ancient and famous trees. Ninth units and individuals have the obligation to protect ancient and famous trees, and shall not damage and dispose of ancient and famous trees at will, and have the right to stop and report the damage to ancient and famous trees. Chapter II Identification of Ancient and Famous Trees Article 10 The people's governments of counties (cities, districts) shall organize a general survey of ancient and famous trees within their respective administrative areas at least once every ten years, so as to fully grasp their species, quantity, distribution, living environment and protection status. Eleventh ancient and famous trees should be protected at different levels:

(a) trees over 500 years old are first-class ancient trees, which are under first-class protection;

(2) Trees that are more than 300 years old but less than 500 years old are second-class ancient trees, which are subject to second-class protection;

(three) the age of trees 100 years old and less than 300 years old are three-level ancient trees, and three-level protection is implemented. Twelfth old and famous trees are not limited by age, and the first-class protection is implemented. Trees that meet one of the following conditions can be included in the category of ancient and famous trees:

(1) Trees planted by state leaders, famous politicians at home and abroad and historical and cultural celebrities;

(two) trees distributed in places of interest, historical gardens, religious sites, former residences of celebrities and other places. , and related to historical and cultural celebrities or major historical events;

(3) landmark trees listed in the protection connotation of world natural heritage or world cultural heritage;

(four) trees with important scientific value as the source of model specimens in tree classification;

(five) other trees with important historical, cultural, ornamental, scientific value or important commemorative significance. Thirteenth county (city, district) people's government departments in charge of ancient and famous trees should be in accordance with national standards for the identification of ancient and famous trees.

The ancient and famous trees under protection shall be identified and published in accordance with the following provisions:

(a) the first-class ancient and famous trees recognized and published by the provincial people's government;

(two) two ancient trees by the city (state) people's government identified and announced;

(three) three ancient trees by the county (city, district) people's government identified and announced. Article 14 The departments in charge of ancient and famous trees of the local people's governments at or above the county level shall, in accordance with the requirements of "one tree for one file", establish the graphic file information of ancient and famous trees, and dynamically manage the information such as the location, characteristics, age, growth environment, growth status and protection status of ancient and famous trees.

The Provincial Greening Committee shall formulate the appraisal standards for ancient and famous trees, organize the establishment of the database and expert database of ancient and famous trees in the province, and uniformly publish the list of ancient and famous trees to the society. Fifteenth local people's governments at or above the county level shall organize experts to participate in the identification, rescue and rejuvenation, conservation management, protection plan review, safety assessment and other related work of ancient and famous trees within their respective administrative areas.
