How to apply for overseas labor dispatch qualification

I. China's labor export is mainly organized in three forms:

1, the national government departments to arrange for the export of labor services in a planned and organized manner in accordance with the agreements signed with foreign governments;

2, the relevant companies, enterprises, etc., in accordance with the labor contract signed with a foreign company or enterprise to send labor exports;

3, individuals with conditions for labor exports through the labor export by individuals who are qualified for labor export through their friends and relatives abroad.

Labor dispatch refers to the signing of a labor contract between a worker and an employer (also known as a labor dispatch unit) while actually working for the employer (also known as a unit that accepts labor in the form of labor dispatch). The purpose is to reduce labor costs, avoid labor risks, and facilitate labor management.

Second, the individual to apply for the way Chinese citizens to apply for the export of labor services should be generally through the following ways:

1, through the domestic enterprises specializing in the export of labor services for the application for registration, training and dispatch;

2, through the location or the unit of the labor and human resources department;

3, through the individual's friends and relatives abroad for the process.

Legal basis: Interim Provisions on Labor Dispatch Article 3 Employing units may only use dispatched workers in temporary, auxiliary or substitute jobs.

Temporary jobs as stipulated in the preceding paragraph refer to those that last for not more than six months; auxiliary jobs refer to non-main business jobs that provide services for the main business jobs; and alternative jobs refer to those jobs that can be replaced by other workers for a certain period of time when the workers of the employing unit are unable to work due to release from work for study, vacation, or other reasons.

When the employing unit decides to use the auxiliary positions of dispatched workers, it shall be discussed by the workers' congress or all the workers, put forward the plan and opinions, and determined through equal consultation with the labor union or the workers' representatives, and publicized in the employing unit.
