Attachment: Interim Measures for the Declaration and Evaluation of Masterpieces of National Intangible Cultural Heritage

Article 1 In order to strengthen the protection of intangible cultural heritage, standardize the declaration and evaluation of masterpieces of national intangible cultural heritage, according to the Constitution of the Chinese People's Republic of China, Article 22, "The State protects the monuments and sites of interest, precious cultural relics, and other important historical and cultural heritage" and relevant laws and regulations. Article 3 The intangible cultural heritage may be divided into two categories: (1) traditional cultural expressions, such as folklore activities, performing arts, traditional knowledge and skills; and (2) cultural spaces, i.e. places where traditional cultural activities are held on a regular basis or where traditional cultural expressions are manifested in a concentrated manner, both spatially and temporally.

The scope of intangible cultural heritage includes:

(i) oral traditions, including language as a vehicle of culture;

(ii) traditional performing arts;

(iii) folklore activities, rituals and festivals;

(iv) traditional folklore knowledge and practices relating to nature and the universe;

(v) traditional craftsmanship;

(vi) cultural spaces associated with the above expressions. (f) cultural spaces related to the above expressions.

Article 4: The purpose of establishing a national list of masterpieces of the intangible cultural heritage is to:

(1) promote the rescue, safeguarding and transmission of China's intangible cultural heritage;

(2) strengthen the cultural self-consciousness and cultural identity of the Chinese nation, and to enhance the understanding of the wholeness of the Chinese culture and its historical continuity;

(3) respect and recognize the contribution of the communities, groups and individuals concerned to Chinese culture, and showcase China's humanistic traditions and traditions. Article 5 The declaration and evaluation of masterpieces of intangible cultural heritage at the national level shall be carried out by the Office of the Inter-ministerial Joint Conference for the Safeguarding of Intangible Cultural Heritage (hereinafter referred to as the Inter-ministerial Joint Conference). The Office of the Inter-ministerial Joint Conference shall cooperate and coordinate its work with all relevant departments, units and social organizations.

Article 6 The items declared as masterpieces of intangible cultural heritage at the national level shall be folk traditional cultural expressions or cultural spaces of outstanding value; or of typical significance in intangible cultural heritage; or of significant value in history, art, ethnography, folklore, sociology, anthropology, linguistics and literature.

The specific evaluation criteria are as follows:

(1) Outstanding value in demonstrating the cultural creativity of the Chinese nation;

(2) Rooted in the cultural traditions of the community concerned, passed down from generation to generation, with distinctive local characteristics;

(3) Promoting the cultural identity of the Chinese nation, enhancing social cohesion, national unity and social stability, and serving as an important link for cultural exchanges;

(4) Being of significant value in terms of history, art, ethnology, folklore, sociology, anthropology, linguistics and literature. p> (4) outstanding use of traditional crafts and skills, reflecting a high level of excellence;

(5) have the unique value of witnessing the living cultural traditions of the Chinese nation;

Article 8 Citizens, enterprises, institutions, social organizations, etc., can be located in the administrative region of the cultural administrative department to put forward the application of masterpieces of intangible cultural heritage projects, by the acceptance of the administrative department of culture reported at all levels. Article 11 The same kind of projects inherited in different regions and enjoyed by different communities and groups can be jointly declared; the parties to the joint declaration must submit a letter of agreement agreeing to the joint declaration.

Article 12 The Office of the Inter-ministerial Joint Conference shall, in accordance with the provisions of Article 10 of these Measures, examine and approve the declaration materials, and submit the qualified declaration materials to the Jury.

Article 13 The Jury shall be composed of relevant responsible comrades of the State cultural administration departments and experts in relevant fields, and shall be responsible for the evaluation of masterpieces of intangible cultural heritage at the national level and for professional consultation. The term of office of the Jury shall be four years. The Jury shall be composed of a director and a number of deputy directors, with the director being the relevant responsible comrade of the state cultural administrative department.

Article 14 The evaluation shall adhere to the principles of science, democracy and impartiality.

Article 15 The evaluation committee shall conduct the evaluation in accordance with the provisions of Article 6 and Article 7 of these Measures, and put forward the recommended items of representative works of intangible cultural heritage at the national level for submission to the Office of the Inter-ministerial Joint Conference.

Article 20 The Office of the Inter-ministerial Joint Conference organizes experts to evaluate, inspect and supervise the projects listed in the Representative List of Intangible Cultural Heritage at the national level, and give warnings, serious warnings and de-listing treatment to those who fail to fulfill their commitments to safeguarding and problems, depending on the degree of severity.

Article 21 The Interim Measures shall be interpreted by the Office of the Inter-ministerial Joint Conference.
