Chapter II Operation Approval Article 6 The establishment of waterway transportation enterprises and waterway transportation service enterprises must have the conditions stipulated in Article 9 of the Rules. Article 7 The units and individuals applying for the establishment of waterway transport enterprises and requesting for waterway business transportation shall go through the formalities in accordance with the following provisions:

(1) An application for the establishment of a waterway transport enterprise or ordering or purchasing of a ship to engage in business transportation shall be made to the competent department of transportation in the place where it is situated or to its authorized department of navigation (shipping) (hereinafter collectively referred to as the competent department of transportation), filling in the Application Form for Establishment of a Waterway Transport Enterprise (Ship) (hereinafter collectively referred to as the competent department of transportation). (C) fishing vessels need to engage in social transportation, carrying other sectors of the goods, should be in accordance with the provisions of paragraph (b) of this article for the opening of the application procedures.

(d) individual, joint ships engaged in commercial transportation, with the township (town) above the people's government, apply to the local traffic department, fill out the "waterway transport enterprises (ships) business application", after reviewing and signing the comments at each level, reported to the prescribed approval authority for approval.

(E) military (armed police) ships engaged in commercial passenger and cargo transportation or the use of back to the empty ship to participate in commercial transportation, should hold a military unit above the certificate, according to the provisions of paragraph (b) of this article for the opening of the application procedures.

(F) "three-funded enterprises" need to operate in the waters of the province of waterway transportation, should be submitted to the Provincial Department of Transportation "" three-funded enterprises "operating domestic waterway transport application "(Attachment III) by the Provincial Department of Transportation for approval by the Ministry of Transportation. Foreign vessels in the province (including from the port within the province to Hong Kong and Macao), must be approved by the Provincial Department of Transportation and its authorization of the Shipping Administration. Article 9 The competent departments of transportation at all levels shall approve the scope of operation of the applicant enterprises, units and individuals in accordance with their management level, transportation capacity, conditions of passenger and cargo sources, as well as the balance of the total local capacity and the total volume of transportation.

The approval authority shall give approval within thirty days from the next day after receiving the Application for Preparation of Waterway Transportation Enterprises (Vessels); within fifteen days from the next day after receiving the Application for Opening of Waterway Transportation Enterprises (Vessels), give approval to those who meet the conditions, and issue a Waterway Transportation License (Exhibit IV); and give no approval to those who do not meet the conditions and give a reply.
