Measures for the administration of compensation funds for ecological public welfare forests
Article 1 In order to strengthen the management of special funds for benefit compensation of ecological public welfare forests, embody the principles of fairness, justice and openness, safeguard the legitimate rights and interests of the objects of benefit compensation of ecological public welfare forests, and strengthen the management and protection of ecological public welfare forests, these measures are formulated in accordance with the Forest Law of People's Republic of China (PRC). "Budget Law of the People's Republic of China" and "Measures for Construction Management and Benefit Compensation of Ecological Public Welfare Forests in Guangdong Province", combined with the actual situation of ecological public welfare forest management in our province.
Article 2 The term "ecological public welfare forest benefit compensation funds" as mentioned in these Measures refers to the special funds arranged by governments at all levels for the benefit compensation of provincial ecological public welfare forests.
Chapter II Object of Fund Use
Third ecological public welfare forest benefit compensation funds include:
(1) compensation object. Forest operators or forest owners who are forbidden to cut trees and cause economic losses because they are designated as provincial ecological public welfare forests.
1. Responsibility mountain and contract mountain belong to farmers, and the compensation object is farmers;
2. Non-leased or non-contracted village collective forest land, and the compensation object is the village or villagers' group collective;
3. If a forest land contract or lease contract is signed according to law, the compensation object shall be the contractor or lessee during the contract period;
4 state-owned and collective forest farms are classified as ecological public welfare forests, and the compensation objects are state-owned and collective forest farms or their forest contractors and lessees;
5. If the policy of "who has the right to plant" is implemented but no contract has been signed with the forest land owner, the compensation object shall be the object determined through negotiation (agreement).
(two) the relevant units or individuals to manage or coordinate the provincial ecological public welfare forest.
1. Managers responsible for the management and protection of ecological public welfare forests;
2 provincial, municipal and county forestry administrative departments are responsible for the management of ecological public welfare forests (hereinafter referred to as forestry departments);
3 township governments and village committees are responsible for the coordination of ecological public welfare forest management.
Chapter III Use and Appropriation of Funds
Fourth ecological public welfare forest benefit compensation funds are divided into two parts: loss compensation and management funds.
(1) Loss compensation:
1. 75% of the total compensation funds for ecological public welfare forests are earmarked for loss compensation. The funds shall be paid directly to the compensation object determined in Item (1) of Article 3 of these Measures.
2 Provincial Forestry Bureau to prepare the provincial loss compensation fund arrangement plan (prepared to the county level), sent to the Provincial Department of Finance for review. The Provincial Department of Finance will allocate compensation funds to local financial departments and provincial payment units.
3. The competent forestry authorities of prefecture-level cities and counties (cities, districts) shall, according to the approved area of provincial ecological public welfare forests, jointly with relevant departments (county-level, in conjunction with township governments and village committees, etc.), sign on-site definitions with compensation objects, clarify rights and obligations, establish files and provide copies of information to the financial departments at the same level.
4. The forestry departments of prefecture-level cities and counties (cities, districts) shall prepare detailed plans for the allocation of compensation funds for the benefits of ecological public welfare forests in the region, and send them to the finance department at the same level for review. The number of plans issued by provinces, cities and counties should be listed in the distribution schedule.
5. The financial department of the county (city, district) listed at the prefecture level shall review the fund allocation plan, entrust a qualified bank to open a personal account as the compensation object, and directly pay the loss compensation funds to its personal account.
(2) Management and protection funds. Including management personnel funds, management funds and provincial co-ordination funds.
1. Management expenses:
(1) 18% of the total compensation funds for ecological public welfare forests is earmarked for subsidizing management and protection personnel. The funds for management personnel include the salary of management personnel and the purchase cost of management tools.
(II) The forestry departments of prefecture-level cities and counties (cities, districts) shall implement the management and protection personnel of ecological public welfare forests in accordance with the provisions of the Measures for the Construction and Management of Ecological Public Welfare Forests in Guangdong Province and sign employment contracts with them; According to the actual situation in the region, the standard of management personnel funds is approved.
(3) The forestry department of the province, city and county (city, district) shall prepare the fund arrangement plan for the management and protection personnel at the same level and send it to the finance department at the same level for examination and approval.
2. Managing funds:
(1) 4% of the total compensation funds for ecological public welfare forests are earmarked for the management funds of ecological public welfare forests. Counties, towns and administrative villages are allocated according to the proportion of 1.5%, 1.5% and 1% respectively. County-level funds are mainly used for ecological public welfare forest information system construction, publicity and training, inspection and acceptance and other expenses; The funds of townships and administrative villages are earmarked for the overall management of ecological public welfare forests.
(two) the forestry department at the county level shall prepare the plan for the use of management funds at the same level and send it to the county finance department for examination and approval; The township government should prepare a plan for the use of funds for the management of townships and administrative villages, report it to the county-level forestry department for preliminary examination, and allocate it to townships after being audited by the county-level financial department. The coordination and management of administrative village funds, the implementation of reimbursement system, the village with expenditure vouchers to the township finance department for reimbursement.
(three) the funds for listing management at the prefecture level shall be charged in the forestry fees arranged by the government at the corresponding level, and shall not be arranged from the compensation funds for the benefits of ecological public welfare forests.
3. Provincial overall funds:
(1) 3% of the total compensation funds for the benefits of ecological public welfare forests shall be co-ordinated by the province. It is mainly used for information system construction of ecological public welfare forest, forest ecological environment monitoring, sudden forest disaster relief, research and popularization of forest ecological science and technology, technical training, publicity, inspection and acceptance, and establishment of forestry ecological county.
(2) The Provincial Forestry Bureau prepares a plan for the overall use of funds, sends it to the Provincial Department of Finance for review, and pays it according to the current procedures for the management of financial funds.
Fifth provincial ecological public welfare forest benefit compensation fund annual distribution plan should be issued by the Provincial Forestry Bureau and the Provincial Department of Finance before the end of June each year. The compensation funds for the benefits of ecological public welfare forests arranged by prefecture-level cities and counties (cities, districts) shall be issued step by step by the financial departments of cities and counties (cities, districts) at the same level in accordance with the provisions of Article 4 of these Measures. Loss compensation funds must be allocated to the compensation object account before the end of September this year.
Article 6 Once the annual fund allocation plan is issued, the financial and forestry departments at all levels must strictly implement it according to the plan and shall not adjust it at will. If there are special reasons that really need to be adjusted, it should be reported to the Provincial Department of Finance and the Provincial Forestry Bureau for approval.
Chapter IV Supervision and Management of Funds
Seventh ecological public welfare forest benefit compensation funds must establish a system of application and collection. At the time of payment, the compensation object shall sign for receipt, and the receipt and receipt shall be recorded and filed for future reference. The forestry department of the county (city, district) shall, jointly with the township government, be responsible for posting the allocation of compensation funds for ecological public welfare forests in various administrative villages, setting up complaint telephones and accepting supervision by the masses.
Article 8 People's governments at all levels shall strengthen their leadership in the management of ecological public welfare forests, incorporate the construction of ecological public welfare forests into national economic and social development plans, and implement local compensation funds.
Ninth financial departments at all levels and forestry departments should strengthen the supervision and management of compensation funds for ecological public welfare forests, and timely and fully allocate compensation funds. Regularly track and check the availability and use of funds to ensure earmarking.
Tenth forestry departments at all levels should strengthen the construction and management of ecological public welfare forest information system, and establish detailed basic data and compensation object information of ecological public welfare forest. The information and data provided must be true and reliable. Relevant departments such as forestry should bear relevant responsibilities for disputes caused by inaccurate information and losses caused by compensators.
Eleventh city and county finance and forestry departments shall inspect and accept the implementation of ecological public welfare forest benefit compensation funds every year, and submit the inspection and acceptance to the higher authorities in writing. The Provincial Department of Finance and the Provincial Forestry Bureau organize inspections irregularly.
Twelfth any unit or department shall not occupy, misappropriate, intercept or defraud the ecological public welfare forest benefit compensation funds in any form. Offenders will be dealt with severely according to relevant regulations, and the responsibility of unit leaders and persons directly responsible will be investigated. If it constitutes a crime, the judicial department will investigate the legal responsibility.
Chapter V Supplementary Provisions
Thirteenth approach by the Provincial Department of Finance, the Provincial Forestry Bureau is responsible for the interpretation of.
Article 14 These Measures shall be implemented as of the date of promulgation. Where the current measures for the management of ecological public welfare forest funds are inconsistent with these measures, these measures shall prevail. The Measures for the Administration of the Construction of Ecological Public Welfare Forests and the Use of Benefit Compensation Funds in Guangdong Province jointly issued by the Provincial Department of Finance and the Provincial Forestry Bureau (No.344 [2000] of Guangdong Finance Agriculture) shall be abolished at the same time.
