Measures for the administration of tourist highways in Shanxi Province

Article 1 In order to strengthen the management of tourist highways, promote the development of cultural tourism and promote rural revitalization, these Measures are formulated in accordance with relevant laws and regulations and combined with the actual situation of this province. Article 2 These Measures shall apply to the planning, construction, maintenance and management of tourist highways and service facilities within the administrative area of this province. Article 3 The term "tourist roads" as mentioned in these Measures refers to county roads, township roads, village roads and their ancillary facilities, which are built in accordance with the technical standards of highway engineering and connect national roads, provincial roads and tourist attractions.

The service facilities mentioned in these Measures include bus stops (kiosks), tourist distribution centers, post stations, camps, observation decks, tourist greenways, signs and information network facilities. Article 4 The planning and construction of tourist roads and service facilities shall adhere to the principle of paying equal attention to characteristics, safety, intelligence and environmental protection, and follow the principle of overall planning, high quality and high efficiency. Article 5 The people's governments at or above the county level shall strengthen the organization and leadership over the work of tourist highways, incorporate the planning, construction, maintenance and management of tourist highways and service facilities into the national economic and social development plan, and incorporate the work funds into the fiscal budget.

The people's governments at the county level are responsible for the planning, construction, maintenance and management of tourist roads and service facilities within their respective administrative areas, and organize and guide the township (town) people's governments, village (neighborhood) committees and relevant departments to do a good job in tourist roads.

People's governments at the county level, township (town) people's governments and village (neighborhood) committees shall establish a system of tourist highway length. Article 6 The transportation departments of the people's governments of provinces and districts shall be responsible for the industry management and guidance of tourist highways within their respective administrative areas.

The transportation department of the people's government at the county level and the township (town) people's government are responsible for the planning, construction, maintenance and management of tourist highways within their respective administrative areas.

The departments of development and reform, industry and informatization, public security, natural resources, ecological environment, housing and urban and rural construction, agriculture and rural areas, culture and tourism, and emergency management of the people's governments at or above the county level shall, in accordance with their duties, do a good job in the work related to tourist roads. Article 7 The construction of tourist roads and service facilities should be integrated with the development of global tourism, key scenic spots, characteristic towns, beautiful countryside, industrial parks, intensive processing of characteristic agricultural products, trade and logistics, so as to promote the two-way flow of people, logistics, information flow and various production factors in urban and rural areas, and promote rural tourism and rural revitalization. Article 8 Any unit or individual has the right to report acts that damage tourist roads and service facilities, illegally occupy land and service facilities of tourist roads, and affect the safety of tourist roads. Ninth tourist roads should be named in accordance with the relevant provisions, highlighting the characteristics of local culture and tourism industry. Tenth tourist highway planning should conform to the national economic and social development planning, land space planning, and industrial layout, tourism development, ecological environment protection and emergency response, and coordinate with other modes of transportation development planning, taking into account the production and living factors of residents along the line. Article 11 The main line of tourist highways shall not be lower than Grade III highways, and the sections restricted by topographical and geological conditions shall not be lower than Grade IV highways; Branch lines and connecting lines shall meet the requirements of relevant highway technical standards formulated by the state, industry and this province.

Service facilities should be set according to the topography, traffic flow and tourists' needs, and have the functions of rest, sightseeing, catering, accommodation, shopping, toilet, parking, distribution, information guidance and emergency assistance. Twelfth new construction, renovation and expansion of tourist roads and service facilities, should adhere to the ecological priority, green development, take preventive measures according to law, protect cultural relics, traditional villages, natural landscapes, water sources, wild animals and plants and other ecological environment, to avoid or reduce the pressure on important mineral resources. Thirteenth service facilities should be designed, constructed and put into use at the same time as the tourist highway construction project.

Encourage the simultaneous construction of power lines, natural gas pipelines, sewage facilities and tourist highways. Fourteenth encourage social capital to invest in the construction and operation management of tourist roads and service facilities. Fifteenth tourist roads should be maintained in accordance with the maintenance standards, and the roadbed, pavement, bridges, tunnels, culverts and their ancillary facilities should be kept in good technical condition. Article 16 People's governments at the county level shall use modern management means such as big data, Internet, Internet of Things and intelligent systems to release relevant information such as traffic conditions, scenic spots, service facilities and meteorology in areas along tourist highways. Article 17 tourist highways shall be equipped with warning signs, indicating signs, guiding signs, tourist area signs, road construction safety signs, auxiliary signs, road traffic signs, prohibition signs, indicating signs, warning signs and other markings in accordance with relevant national and provincial standards, so as to rationally divert people and logistics and give priority to ensuring the demand for tourist passengers.

Prohibition and indication signs should be set up in front of the intersection of the starting section of the tourist highway. Eighteenth off-highway signs set up in accordance with the law within the scope of tourist highway land shall publicize the socialist core values, cultural tourism, characteristic industries and other contents.

The transportation department of the people's government at the county level shall strengthen the management of non-highway signs within the scope of tourist highways. Nineteenth tourist roads and land within the scope of the following acts are prohibited:

(a) illegal card, charge;

(2) Setting up stalls, piling up articles, setting up obstacles, digging ditches to divert water, stocking livestock, quarrying earth, emptying and burning articles;

(three) agricultural activities such as threshing, flooding, planting, burning straw and composting;

(four) throwing dirt, dumping garbage, using roadside ditches to discharge dirt;

(5) Stacking inflammable and explosive articles, working with naked fire and building various facilities in the bridge opening and passages of highway bridges;

(six) iron wheeled vehicles, tracked vehicles and other machinery that may damage the road surface;

(seven) damage, alteration, unauthorized removal of ancillary facilities;

(8) When the transported goods land, the vehicle will run;

(nine) other acts of damaging and polluting tourist roads, which seriously affect the integrity, safety and smoothness of tourist roads.

Agricultural machinery that needs to travel short distances on tourist highways due to operation may not be restricted by Item 6 of the preceding paragraph, but safety protection measures shall be taken. Damaged roads shall be compensated according to the degree of damage.
