Measures for the Protection of Historic Buildings in Chengdu

Article I (Purpose and Basis)

In order to strengthen the protection of historical buildings, inheritance and carry forward the excellent historical culture, and promote the coordinated development of urban and rural construction and social and cultural development, in accordance with the State Council's "Regulations on the Protection of Historical and Cultural Cities and Towns and Villages," and other laws and regulations, in conjunction with the actual situation of Chengdu, the formulation of these measures. Article 2 (Scope of application)

The protection of historical buildings within the administrative area of the city shall be governed by these Measures.

Historical buildings are announced as units of cultural relics protection or registered as immovable cultural relics, in accordance with the relevant laws, regulations and rules for the protection of cultural relics. Article 3 (Interpretation of Terms)

The historic buildings referred to in these measures refers to the buildings and structures which are recognized and announced by the municipal government as having a certain protection value, reflecting the historical features and local characteristics, and which have not been announced as units of cultural relics protection according to the law, or registered as immovable cultural relics. Article 4 (Supervisory Responsibilities)

The municipal and district (city) and county governments shall strengthen the leadership of the protection of historical buildings, and incorporate them into the national economic and social development planning and urban and rural master planning.

The municipal real estate administrative department is responsible for the organization, coordination, guidance, supervision and management of the protection of historic buildings in the city. The administrative departments of real estate in districts (cities) and counties are responsible for the daily protection and supervision and management of historical buildings in their respective jurisdictions.

Planning, construction, culture, finance, land, public security, industry and commerce, urban management, forestry and gardening, tourism, civil affairs and other relevant departments shall do a good job in their respective areas of responsibility for the protection of historic buildings. Article V (protection of funds)

City and district (city) and county governments should increase funding for the protection of historic buildings, according to the actual situation in the local arrangements for the protection of funds, and included in the financial budget at this level. Article 6 (government recognition)

The municipal and district (city) county governments and their relevant departments shall give recognition and rewards to units and individuals who have made outstanding contributions to the protection of historic buildings. Article 7 (Social Responsibility)

Any unit or individual has the obligation to protect historic buildings in accordance with the law, and has the right to discourage and report on acts of destruction or damage to historic buildings.

Encourage social forces to participate in the protection and utilization of historic buildings through donations, funding, services or investment. Article VIII (review system)

Historic building protection to implement expert review system.

The municipal government set up an expert committee for the protection of historic buildings (hereinafter referred to as the expert committee). The expert committee consists of planning, real estate, construction, land and other professionals and history, culture, economy and other experts, is responsible for the recognition of historical buildings, adjustments, withdrawals, as well as planning, protection and other matters related to the evaluation, for the municipal government and its relevant departments to provide decision-making advice. Built more than fifty years ago, buildings and structures with one of the following conditions can be recognized as historical buildings:

(1) those related to major historical events, revolutionary movements, famous figures or important organizations;

(2) those reflecting excellent history and culture, and embodying the traditional urban and rural landscape, characteristics of the times and local features;

Buildings and structures that meet the requirements of the preceding paragraph but have been lost, restored and rebuilt in their original form or relocated off-site, can be recognized as historical buildings.

Built more than thirty years less than fifty years, but has a special historical, scientific and artistic value, or has a special commemorative significance and educational significance of the buildings, structures, can be recognized as historical buildings.
