Measures of Ningxia Hui Autonomous Region for the control of overloading of freight vehicles

Chapter I General Provisions Article 1 In order to strengthen the control of overloading of road transport freight vehicles, protect the safety of state property and people's lives, maintain the order of road freight transport market and ensure smooth roads, in accordance with the provisions of the Highway Law of People's Republic of China (PRC), the Law of the People's Republic of China on Road Traffic Safety, the Regulations of the People's Republic of China on Road Transport and other relevant laws and regulations, and in combination with the actual situation of the autonomous region, Article 2 controls the overloading of vehicles in expressway, ordinary trunk roads, rural roads and cargo transport sources within the administrative area of this autonomous region. Article 3 The term "overloading of freight vehicles" as mentioned in these Measures refers to the illegal transportation of freight vehicles exceeding the national road vehicle traffic limit or exceeding the approved load quality. Fourth overload control work follows the principle of unified leadership of the whole region, responsibility of governments at all levels, guidance and coordination of departments, and joint action of all parties. Article 5 The people's governments at or above the county level shall be responsible for organizing and leading the overload control work within their respective administrative areas, establishing and improving the target responsibility system and accountability system for overload control work, improving the overload control working mechanism, implementing overload control personnel, and incorporating the overload control work funds into the fiscal budget at the corresponding level.

Transportation, public security, development and reform, economy and informatization, quality supervision, safety supervision, industry and commerce and other relevant departments shall, in accordance with the division of responsibilities, perform their respective duties in the overload control work. Chapter II Duties Article 6 The transportation department shall perform the following duties in overload control:

(a) the organization of traffic administrative law enforcement personnel to carry out road enforcement, investigate and deal with illegal overloading vehicles;

(2) Organizing the law enforcement officers of the road transport management institution (hereinafter referred to as the transport management institution) to supervise the transport loading behavior at the cargo loading site and the distribution center, so as to prevent the vehicles from exceeding the limit and overloading;

(three) responsible for the overload detection site and overload information management system construction and operation management;

(four) the establishment of freight enterprises and employees information system and credit files, registration, copying information such as overloaded vehicles and enterprises, establish and improve the quality credit evaluation system of road transport enterprises;

(five) to guide the adjustment of transportation capacity structure, take measures to encourage the intensive and networked operation of road freight transportation, and encourage the use of containers, closed box trucks and multi-axle heavy vehicles;

(six) to inform the relevant departments of the illegal acts of illegally modifying and assembling vehicles found in law enforcement, and cooperate with the relevant departments to investigate and deal with them. Article 7 The public security department is responsible for the management of vehicle registration, maintaining the traffic and public order at the overload station, and organizing to investigate and deal with traffic violations such as overloading and obstructing the execution of official duties and other illegal and criminal acts according to law. Article 8 The departments of development and reform (including the price department), economy and information technology are responsible for the announcement management of vehicle manufacturers and products, the supervision and inspection of automobile manufacturers and products, the investigation and punishment of illegal automobile manufacturers and products, the guidance and supervision of the implementation of relevant charging policies to control overloading, and the formulation of charging standards such as unloading of overloaded vehicles, storage and parking management. Article 9 The quality supervision department is responsible for measuring and verifying the testing equipment required for overload control according to law, regularly publishing the list of units that have passed the rectification and acceptance, implementing the defective automobile recall system, checking the production sites and standards implementation of enterprises engaged in automobile assembly and modification, putting an end to irregular production behaviors, and investigating and handling automobile production enterprises and products that do not meet the product certification requirements. Article 10 The industrial and commercial departments shall be responsible for investigating and handling the illegal assembly and modification of automobiles, and banning enterprises that illegally assemble and modify automobiles according to law. Article 11 The safety supervision department is responsible for the implementation of safety supervision on dangerous chemicals filling units, and jointly with relevant departments, investigate and deal with particularly heavy casualties caused by overloading, and investigate the responsibilities of relevant units and personnel according to law. Chapter III Source Governance Article 12 The people's governments at or above the county level shall announce the licensed registered freight source units to the public, and establish a joint meeting system for freight source governance and a linkage system for administrative law enforcement.

The unit of origin of freight mentioned in the preceding paragraph refers to the operator who has obtained administrative license or registration according to law and is engaged in road freight transportation and loading places such as mineral products, building materials, machinery, agricultural and sideline products and other production and processing enterprises and logistics stations. Thirteenth transportation management agencies should be stationed in or check the source of freight, etc., to implement overload control at the source of freight. Article 14 The production and business license organ or competent department of the freight source unit shall establish the credit evaluation file of the freight source unit, include the overloading behavior of the freight source unit in the credit evaluation scope, and make it known to the public regularly. The cases transferred by the transportation management institution shall be investigated and handled in time, and the results shall be fed back to the transportation management institution.

The transportation management institution shall report the illegal cases handed over to the relevant departments to the local people's government and the transportation management institution at a higher level every month. Fifteenth freight source units shall perform the following obligations:

(a) clear staff responsibilities, establish a system of accountability;

(2) Training related personnel such as cargo loading, invoicing and weighing;

(three) the road transport certificate and qualification certificate produced by the driver of the registered freight vehicle;

(4) Equipped with corresponding weighing and measuring equipment for goods;

(five) to establish and improve the registration, statistical system and files of freight source overload control, and submit relevant information to the transportation management agency in accordance with the provisions;

(six) accept the supervision and inspection carried out by the law enforcement personnel of the overload control at the source of freight, and truthfully provide relevant information and materials.
