How do mainlanders inherit the heritage of relatives in Taiwan Province Province?

The practice of mainlanders inheriting Taiwan Province's heritage in Taiwan Province Province;

1、? Mainland people who want to inherit the heritage of Taiwan Province Province must first collect or handle the following matters:

(1) The household registration certificate when the decedent died and the household registration transfer certificate when the decedent died.

(2) Notarization and identification of kinship between mainland heirs and decedents. (Verified by SEF of Taiwan Province Province)

(3) Prepare the table of inheritance system.

(4) Providing heritage certificates and compiling heritage catalogues. (With the decedent's death certificate, notarized kinship and notarized identity certificate, check the property ownership information of the decedent with the tax authorities of Taiwan Province Province).

2. If a mainlander wants to inherit the inheritance of Taiwan Province people, he must declare in writing to the court where the decedent lives within three years from the date of inheritance. If he fails to do so, he will be deemed to have given up the inheritance right.

3. If the succession begins before the implementation of the Regulations on Cross-Strait Relations, the period mentioned in the preceding paragraph shall be counted from the date of implementation of the Regulations on Cross-Strait Relations. (1992 September 18 effective) Before the implementation of the Regulations on Cross-Strait Relations, if there is no heir in Taiwan Province Province after being handled by the competent authorities, the inheritance period is four years.

4. When mainland heirs apply for inheritance to the court where the estate is located, they should refer to the provisions of the Non-Litigation Event Law and submit an application for inheritance to the court, which should record the following items.

(1) Name, gender, age, native place, occupation and address of the applicant, and name, address and telephone number of the service agent in Taiwan Province Province.

(2) Reasons for inheritance, factual reasons and the expression of intention to apply for inheritance.

(3) Explain the identity of the mainland heirs and their kinship with the decedent.

(4) Attach supporting documents. (the household registration certificate of the decedent at the time of his death, the identity certificate of the mainland heir, the relationship with the decedent, the list of inheritance system, the list of inheritance, etc. )

(5) The competent court.

(6) Year, month and day.

(7) Signature and seal of the applicant.

The above-mentioned documents concerning the mainland can only take effect after being verified by the Taiwan Province Cross-Strait Foundation.

5. Mainland heirs express their willingness to inherit the estate to the Taiwan Province Provincial Court. After being approved by the competent court for future reference, they can hold official documents for future reference and obtain the estate or divide the estate according to the general inheritance procedure. If there are no other heirs in Taiwan Province Province, the mainland heirs can apply to the domestic bureau of Taiwan Province Province and other departments for inheritance transfer for future reference with the official documents approved by the competent court and the above-mentioned supporting materials.

6. Because the two sides of the Taiwan Strait have been separated for a long time, and the laws and regulations are different, especially it is not easy for mainlanders to inherit in Taiwan Province Province, so there are countless cases in which mainland heirs fail to express their inheritance in writing to the court of the decedent's domicile within three years from the date of inheritance.
