Provisions on technical management of road transport vehicles

Article 1 In order to strengthen the technical management of road transport vehicles, keep the vehicles in good technical condition, ensure transport safety, give full play to vehicle efficiency, and promote energy conservation and emission reduction, these Provisions are formulated in accordance with the Law of People's Republic of China (PRC) on Safety in Production, the Law of People's Republic of China (PRC) on Energy Conservation and the Regulations of the People's Republic of China on Road Transport.

Article 2 These Provisions shall apply to the technical management of road transport vehicles.

The road transport vehicles mentioned in these Provisions include road passenger vehicles (hereinafter referred to as passenger cars), road ordinary cargo transport vehicles (hereinafter referred to as trucks) and road dangerous goods transport vehicles (hereinafter referred to as dangerous goods transport vehicles).

The term "technical management of road transport vehicles" as mentioned in these Provisions refers to the technical management of ensuring that road transport vehicles meet the specified technical conditions and carry out maintenance, repair and comprehensive performance testing as required.

Article 3 The technical management of road transport vehicles shall adhere to the principles of classified management, prevention first, safety and efficiency, energy saving and environmental protection.

Article 4 Road transport operators shall be responsible for the technical management of road transport vehicles, the selection, correct use, regular maintenance, timely repair, regular inspection and timely update of road transport vehicles, and ensure that the vehicles put into road transport operations meet the technical requirements.

Article 5 Road transport operators are encouraged to use safe, energy-saving and environmentally-friendly vehicles, promote the popularization and application of standardized vehicles, strengthen the application of science and technology, and constantly improve the level of vehicle management and technology.

Article 6 The Ministry of Transport shall be in charge of the technical management and supervision of road transport vehicles throughout the country.

The transportation departments of local people's governments at or above the county level (hereinafter referred to as the transportation departments) shall be responsible for the technical management and supervision of road transport vehicles within their respective administrative areas.

Chapter II Basic Technical Requirements for Vehicles

Article 7 Vehicles engaged in road transport business shall meet the following technical requirements:

(1) The overall dimensions, axle load and maximum allowable total mass of the vehicle shall meet the requirements of Limits of Overall Dimensions, Axle Load and Mass of Cars, Trailers and Automobile Trains (GB 1589);

(2) The technical performance of the vehicle shall meet the requirements of Technical Inspection Items and Methods for Motor Vehicle Safety (GB 38900);

(3) The fuel consumption limit of vehicle type shall meet the requirements of Fuel Consumption Limit and Measurement Method for Operating Passenger Cars (JT 7 1 1) and Fuel Consumption Limit and Measurement Method for Operating Freight Cars (JT 7 19);

(four) the technical level of the vehicle should reach two or more. Dangerous goods transport vehicles, international road transport vehicles, passenger cars engaged in expressway passenger transport and passenger cars with operating lines of more than 800 kilometers should reach the first class. The technical grade evaluation method shall meet the requirements of the state for the technical grade classification and evaluation of road transport vehicles;

(five) engaged in road passenger transport, chartered passenger transport, international road passenger transport, operating line length of more than 800 kilometers of passenger car types and grades should reach the intermediate level or above. Its classification and grade should meet the requirements of the state for the classification and grade of operating buses;

(6) Vehicles transporting dangerous goods shall meet the requirements of the Rules for the Transport of Dangerous Goods by Automobile (JT 6 17).

Eighth transportation departments should strengthen the management of vehicles engaged in road transport business, and shall not issue road transport permits to vehicles that do not meet these provisions.

When issuing road transport certificates and annual inspections to trailers, it shall be checked whether the trailers have valid driving licenses.

Ninth prohibit the use of scrapped, unauthorized modification, assembly, inspection and other vehicles that do not meet the requirements of the state to engage in road transport business activities.

Chapter III General Requirements of Technical Management

Tenth road transport operators shall abide by the relevant laws, regulations, standards and norms, earnestly fulfill the main responsibility of vehicle technical management, establish and improve the management system, and strengthen vehicle technical management.

Eleventh road transport operators are encouraged to set up corresponding departments to be responsible for vehicle technical management, and equipped with vehicle technical management personnel according to the number of vehicles and business categories to implement effective technical management of vehicles.

Twelfth road transport operators should strengthen business training in vehicle maintenance, use, safety and energy saving, improve the professional quality and skills of employees, and ensure that vehicles are in good technical condition.

Thirteenth road transport operators should be based on the technical management standards of road transport enterprises, combined with the technical status and operation status of vehicles, the correct use of vehicles.

Encourage road transport operators to formulate technical management norms for vehicle use in accordance with relevant standards, scientifically set economic and technical quota indicators for vehicles and conduct regular assessment, so as to improve the technical management level of vehicles.

Fourteenth road transport operators shall establish a vehicle technical file system, and implement one vehicle for one file. The contents of the archives should mainly include: basic information of vehicles, vehicle technical grade evaluation, bus type grade evaluation or annual type grade evaluation review, vehicle maintenance (including Vehicle Maintenance Completion and Ex-factory Certificate), vehicle main parts replacement, vehicle change, driving mileage, traffic accidents causing vehicle damage and other records. The contents of the file should be accurate and detailed.

When the ownership of the vehicle is transferred or transferred, the technical files of the vehicle shall be handed over with the vehicle.

Road transport operators should use information technology to do a good job in the management of technical archives of road transport vehicles.

Chapter IV Automobile Maintenance

Fifteenth road transport operators should establish a vehicle maintenance system.

Vehicle maintenance is divided into daily maintenance, primary maintenance and secondary maintenance. Daily maintenance is carried out by drivers, and the first-level maintenance and second-level maintenance are organized and implemented by road transport operators, and records are kept.

Sixteenth road transport operators shall, in accordance with the relevant national standards, vehicle maintenance manuals, operating procedures, etc., and combined with vehicle categories, vehicle operating conditions, mileage, road conditions, service life and other factors. , to determine the vehicle maintenance cycle, to ensure the normal maintenance of vehicles.

Automobile maintenance projects shall be determined in accordance with the requirements of the national technical specifications for automobile maintenance.

Road transport operators can carry out secondary maintenance operations on their own vehicles to ensure that the vehicles put into operation meet the technical management requirements, and there is no need to carry out secondary maintenance completion quality inspection.

Road transport operators do not have the ability of two-level maintenance operations, and can entrust two or more motor vehicle maintenance operators to carry out two-level maintenance operations. Motor vehicle maintenance operators shall, after completing the two-level maintenance operation, issue the two-level maintenance factory certificate to the entrusting party.

Seventeenth road transport operators should follow the principle of repairing according to the situation and repair vehicles in time according to the actual situation.

Eighteenth road transport operators to transport highly toxic chemicals, explosives, special vehicles (including tank trailers), shall be filed with enterprises with road transport of dangerous goods vehicle maintenance conditions.

Tractors of special vehicles and other vehicles transporting dangerous goods specified in the preceding paragraph may be maintained by enterprises with general vehicle maintenance conditions after the road transport operators have eliminated the hazards of dangerous goods.

Chapter V Vehicle Inspection Management

Nineteenth road transport operators should regularly go to the comprehensive performance testing institutions of motor vehicles to conduct comprehensive performance testing of road transport vehicles.

Twentieth road transport operators shall, from the month when road transport vehicles obtain the road transport license for the first time, entrust an automobile comprehensive performance testing institution to conduct comprehensive performance testing and technical grade evaluation in accordance with the following cycles and frequencies:

(1) Passenger cars and dangerous goods transport vehicles have been registered in the national motor vehicle registration authority for less than 60 months, and are tested and evaluated every 12 months; More than 60 months, every 6 months 1 test and evaluation.

(2) If other transport vehicles have been registered in the national motor vehicle registration authority for the first time, they shall be tested and evaluated every 12 months.

Twenty-first comprehensive performance testing of passenger cars and dangerous goods transport vehicles shall be entrusted to the comprehensive performance testing institution in the vehicle registration place.

The comprehensive performance testing of freight cars can be entrusted to the comprehensive performance testing institution of ground transport vehicles.

Article 22 Road transport operators shall select testing institutions that have passed the metrological certification of market supervision and management departments, obtained metrological certification certificates and met the General Requirements for the Capability of Automobile Comprehensive Performance Testing Stations (GB 17993) and other relevant national standards to conduct comprehensive performance testing on vehicles.

Twenty-third automobile comprehensive performance testing institutions shall, in accordance with the "list of vehicles with fuel consumption reaching the standard for road transport vehicles", compare the vehicles newly entering the road transport market. New cars and in-use vehicles that meet the standards shall be tested and evaluated in accordance with the Items and Methods of Motor Vehicle Safety Technical Inspection (GB 38900), and a comprehensive performance test report of road transport vehicles with a unified national style shall be issued to evaluate the technical level of vehicles, and the report shall be marked. The transportation department in the place where the vehicle is registered shall indicate the technical level of the vehicle on the road transport certificate.

Automobile comprehensive performance testing institutions shall ensure that the testing and evaluation results are objective, fair and accurate, and bear legal responsibility for the testing and evaluation results.

Article 24 The transportation authorities and the automobile comprehensive performance testing institutions entrusted by them to undertake the bus type rating work shall conduct bus type rating or annual type rating in accordance with the Classification and Rating of Operating Bus Types (JT/T 325), and issue a unified bus type rating report.

Article 25 An automobile comprehensive performance testing institution shall establish vehicle testing files, which mainly include: vehicle comprehensive performance testing reports (including basic information of vehicles and technical grades of vehicles) and passenger car type grade evaluation records.

Vehicle inspection files shall be kept for a period of not less than two years.

Chapter VI Supervision and Inspection

Twenty-sixth transportation departments shall supervise and inspect the technical management of road transport vehicles in accordance with their duties and powers.

Road transport operators shall cooperate with the supervision and inspection of the competent department of transportation, truthfully reflect the situation and provide relevant information.

Twenty-seventh transportation departments shall incorporate the technical conditions of vehicles into the annual inspection of road transport vehicles, and check the following corresponding certification materials:

(a) vehicle technical grade evaluation conclusion;

(2) Bus model grade certificate.

Twenty-eighth transportation departments should establish a vehicle management file system. The contents of the archives mainly include: basic information of vehicles, technical rating of vehicles, rating of bus types or annual rating review, vehicle changes and other records.

Twenty-ninth transportation departments should incorporate the technical management of transport vehicles into the quality credit assessment and credit management system of road transport enterprises.

Thirtieth transportation departments should actively promote the use of modern information technology, and gradually realize the sharing of technical management information resources of road transport vehicles.

Chapter VII Legal Liability

Thirty-first in violation of the provisions of this regulation, the road transport operators have one of the following acts, and shall be ordered by the transportation department to make corrections and give a warning; If the circumstances are serious, a fine ranging from 1000 yuan to 5,000 yuan shall be imposed:

(a) the technical condition of road transport vehicles does not meet the "motor vehicle safety technical inspection items and methods" (GB 38900);

(two) the use of scrapped, unauthorized modification, assembly, testing unqualified and other vehicles that do not meet the requirements of the state to engage in road transport business activities;

(3) failing to carry out comprehensive performance testing and technical grade evaluation of vehicles in accordance with the prescribed period and frequency.

Article 32 If, in violation of these Provisions, a road transport vehicle comprehensive performance testing institution commits one of the following acts, the competent department of transportation shall not accept the test report and send a copy to the market supervision and management department at the same level for handling.

(1) Failing to test road transport vehicles in accordance with technical specifications;

(2) Issuing the test results of road transport vehicles without testing;

(three) the test results are not truthfully issued.

Article 33 Any staff member of the transportation department who abuses his power, neglects his duty or engages in malpractices for personal gain in the supervision and management work shall be given administrative sanctions according to law; If the case constitutes a crime, it shall be dealt with by judicial organs according to law.

Chapter VIII Annex _ _

Article 34 These Provisions shall not apply to ordinary freight vehicles with a total mass of 4,500 kg or less engaged in general freight operations.

Article 35 These Provisions shall come into force on March 1 day, 2065. The Regulations on Technical Management of Vehicles in Automobile Transportation Industry (Order of the Ministry of Communications 1990No. 13) and the Regulations on Maintenance and Management of Road Transport Vehicles (Order of the Ministry of Communications No.200 1 4) issued by the Ministry of Communications shall be abolished at the same time.
